The month of May was all about cross pollination of ideas wherein SahilKapoor & Anmol Aggarwal from the RE/MAX Delhi NCR team visited the region ofRE/MAX North Gujarat to share and learn best practices and I visited the region ofRE/MAX Bengaluru along with Manpreet & Puneet.With office visits, training sessions, 60 minutes with RE/MAX and an Awards Nightscheduled during our trip to the region, the 3 days that we spent there were totally action packed. The enthusiastic and passionateteam of Broker Owners & Broker Associates led ably by the Regional Owner, Siva Kyasa has made me believe that the region willsurely be vying for the top awards at the next annual awards ceremony. I would like to make a special mention of Bakianathun,Regional Owner of RE/MAX Chennai and Anand Choksi, Broker Owner of RE/MAX Advantage for extending their support to the regionby attending the event and participating as speakers; their presence is truly a testimonial of the real meaning of RE/MAX being onebig family!!Union Cabinet’s approval on the Real Estate Regulatory Bill is a welcome step, we can now envision more transparency in our industryas the bill would help in enforcing fair practices and will also help in speedy dispute resolutions...let’s just hope that very soon it willbecome compulsory for even Property Brokers to obtain a license before conducting business.Hoping for the best, wish all of you a super profitable month!!RegardsSam

R S working with REMAX Ultimate since 2010 April. I was born and brought up in Bangalore. My job experienceincludes Shoppers Stop (sales), ICICI banking in (selling S/B accounts). I then worked part time in Cyber Cafe quitting my previous jobas system engineer. In the meantime I realized I was not comfortable in working under somebody. I decided to be an entrepreneurthen I choose Real Estate as the Real Estate market was in boom. I worked with my associates for 2 years to learn the business, gotexperience and decided to be on my own. I then got an opportunity which made me happy because of their entrepreneur model whereI can be my own boss which is RE/MAX. I then joined REMAX Ultimate in 2010 with lot of expectations and have achieved a few yet tocomplete a lot.In these three years since I joined REMAX, I have dealt with different types of customer. One of my challenging transaction was tosell a property in Indiranagar, where the buyer was tough person. It took some time to close the transaction but finally completed.Persistence and patience helped in closing the transaction.RE/MAX is a platform for my success. Nobody in the world sells more real estate than RE/MAX RFor Details SMS: REMAX to 53456REALTY BYTESUnion Cabinet approves Real Estate Regulatory BillA Bill providing for setting up a regulator for the real estate sector and having provisions like a jail term of up to three years fordevelopers who make offences like putting up misleading advertisements about projects repeatedly was approved by the governmentTuesday.The Real Estate (Regulation and Development) Bill, approved by the cabinet, seeks to provide a uniform regulatory environment to thesector. It also intends to make it mandatory for developers to launch projects only after acquiring all statutory clearances fromrelevant authorities. Builders and developers who become repeat offenders may even face a jail term of up to three years.The Bill makes it mandatory for builders to clarify the carpet area of the flat. This would be made uniform for the entire country. Thisrule would make the concept of super area - which is often used to mislead owners - virtually non-existent. The Bill has provisionsunder which all relevant clearances for real estate projects would have to be submitted to the regulator and also displayed on awebsite before starting the construction, sources said.The proposed legislation has tough provisions to deter builders from putting out misleading advertisements related to the projectscarrying photographs of the actual site. Failure to do so for the first time would attract penalty which may be up to 10 percent of theproject cost and a repeat offence could land the developer in jail. The Ministry of Housing and Urban Poverty Alleviation is working onbringing all projects under a single-window clearance. While the Airports Authority of India and municipal bodies have come on board,there are some objections from the Environment Ministry which are being looked into.Ministry sources said 22 states had given their approval to the Bill while five states wanted certain amendments. These changes havebeen incorporated in the Bill cleared by the Cabinet today, sources said. Chhattisgarh is the sole state to still oppose the Bill. Buildersand developers will have to get all clearances - from title deed to project cost - cleared before construction begins. FAR (Floor AreaRatio) will also have to be specified clearly by the builder.While the Regulator in the states will be appointed by the state governments, in Delhi the Urban Development Ministry will appoint theregulator. DDA is likely to be made the regulator in Delhi, sources said. The Regulator will also be the appellate authority in cases ofdispute. This will save the owners the hassle of running around to different authorities for redressal. The developers will also have tospecify the common area in the society. The term "apartment" has been specified in the Bill and will include the space to be providedfor a garageKey provisions of the Bill1. Establishment of a Real Estate Regulatory Authority - Government has proposed to appoint a chairperson with two other memberssupporting him. The people who get appointed as part of the regulatory authority should have sufficient professional knowledge andexperience in the field of public administration, urban development, finance, law or management.

Transparency and Powers of the Regulatory Authority - This authority is also going to maintain a website which will have therecords of all real estate projects with all other details as provided in the application at the time of registration.3. Registration with the Regulatory Authority - The builder is going to file all the details of his project with the regulatory authority andprovide all necessary details of property dealers or middlemen dealing in the project.4. Establishment of Appellate Tribunal - The bill will also provide for the establishment of a real estate appellate tribunal, which willdecide upon any dispute and will hear appeals against any decision of the regulatory authority.5. Obligations of a Promoter - This model bill has also outlined the role of the property developer and their duties towards theregulatory authority and also the property buyers. The developer is obligated to provide all documents and information for inspectionto the prospective buyers. The builder enters into a written agreement with the buyer before taking any advance money. After theexecution of the agreement, the builder will not be entitled to create a mortgage charge on the plot, building or apartment, without theprior written consent of the buyer.6. Offences and Penalties - In order to make the proposed act effective, the Government will also penalize those who will not complywith its clauses. The penalties range from up to three years imprisonment for not registering a project or for not complying with theorders of the Appellate Tribunal to monetary penalties which may be ascertained on a daily basis for non compliance or as apercentage of the development costs or sale price.The Model Real Estate Bill seeks to bring clarity and consistency in the fast growing Indian real estate sector. The proposed Act willlead to better information sharing and decision making, between builders and the consumers. Further, by seeking to establish theRegulatory Authority and Appellate Tribunal, the Model Act provides for a forum where disputes could be heard by a specialized expertbody, which would result in speedy dispensation of justice.
