But as those affected by surrogacy know, this is far from the reality. Having advised hundreds of families created through surrogacy, I know that parents do not choose that option lightly. The vast majority have heart-wrenchingly long and painful journeys behind them (tales of miscarriages, stillbirths and gruelling years of IVF disappointments). For gay couples, surrogacy gives the hope of a much-wanted family, and arrangements are entered into with planning and care. Surrogate mothers take pride in helping to create families and, whether or not they are paid, the parents involved do not treat the enormous and life-changing gift they make lightly. Children born through surrogacy arrangements are far from commodities or accessories.


Canadians seeking Indian surrogates to carry their children.

One of the most memorable stories I did this year was on reproductive tourism — infertile Canadians who are travelling abroad for surrogates and egg donors because of the law in Canada banning payment of donor sperm or eggs or surrogacy services.

Those who counsel infertile couples told me that it is almost impossible for anyone who hasn't struggled with infertility to understand how overwhelming, and almost primal is the urge to have babies.

Let's embrace surrogacy and recognise the hope and wonderful gift that it brings, and let's celebrate and support families created in this way.

Intrusive laws set parent trap  IN 21st-century Australia, the typical family who arrives at the complicated crossroads ofcommercial surrogacy is afraid and demoralised.While many commentators would have us think they are a gay couple wanting a designer baby,they are more likely to be heterosexual.Increasingly Australian women are leaving childbearing until their late 30s or early 40s, either toestablish a career or given the absence of a partner. No longer producing as many or as healthyeggs, they commonly endure repeated miscarriages and unsuccessful IVF attempts, an emotionaltightrope that can place enormous strain on relationships. Research has shown the human desireto parent can far outweigh other life goals. And so intending parents remain determined toexplore all options to create a family.Most of these involuntarily childless go unnoticed; embarrassed to talk about their infertility,they suffer silently. Many have looked into adoption, only to discover just a handful ofAustralian babies available each year and waiting lists of five or more years for internationaladoptions. Some look at fostering, yet are deterred by the fear the child may be returned to itsbiological parents.For some it is their doctor who suggests surrogacy. Do they know a long-time friend or familymember who may agree to carry their child for love alone?For the tiny proportion who have a potential surrogate of the right age and motivation, the longconversation begins. Public debate on surrogacy and IVF has rightly agreed the interests of theunborn child need to be paramount.

In Greg Donnellys opinion piece in this paper on January 5, he quoted from a paper by ethicistMargaret Somerville in which she wonders whether science will someday show that having botha mother and father does matter for childrens wellbeing. Thats the problem with ethicists. Theystew over possibilities without talking to those affected. More useful is to consider research thathas followed up children brought up by one parent, or two parents of the same sex. For decadessuch research has consistently shown it is the processes of parenting rather than the familystructure that matters. Children in same-sex or single parent families do not demonstrate anyimportant differences in development, happiness, peer relations or adjustment.But what about the psychological wellbeing of children conceived through surrogacy?Researchers from City University London published a 2006 study in the journal HumanReproduction comparing three-year-olds conceived via surrogacy, donor insemination andnatural conception. Absence of a genetic and-or gestational link with the parents raising themwas found to have no negative influence on parent-child relationships or the psychologicalwellbeing of the children.Back in the consulting room, the reality of altruistic surrogacy "Australian style" continues tounfold for intending parents. Would all parties agree to psychological testing? Are they awarethey have no claim on the baby if their surrogate decides to keep the child? Are they and theirsurrogate prepared to undergo mandatory counselling and psychological tests? Are they preparedfor a 12-18-month work-up process, allowing for all the necessary ethics approvals?Such a tightly regulated process means most think twice before involving a female familymember, let alone a friend. In reality, Australias improved altruistic surrogacy laws protectingthis process will assist only a handful of parents in each state each year.The vast majority will leave Australia to chase their dream of having children, risking much inthe process. Two Australian couples recently had their own embryos couriered to India inpreparation for implantation in a surrogate. On arrival, the embryos were refused entry, giventhey lacked the correct paperwork. A Byron Bay man whose Thai surrogate bore twin girls foundhimself a prisoner in his Bangkok apartment for weeks as mass demonstrations provokedacurfew, street battles and arson.A Queensland medical specialist ignored that states laws banning commercial surrogacy andentered an overseas contract, risking a criminal charge and being struck off as a doctor.As well as such risks, intending Australian parents spend tens or hundreds of thousands ofdollars in medical, legal, travel and compensation costs in the hope of creating a family. AMelbourne childless couple I know sold their large home, moving to a smaller one with a largermortgage, to afford the escalating costs in the US.A NSW man was expecting twins by a surrogate in San Diego. He panicked when the surrogatemother looked likely to deliver at 32 weeks. The US offers no medical insurance for twins bornto non-residents and he faced a potential neonatal intensive care bill of $US140,000, doubling hiscosts.

On top of that, Australians in Queensland, the ACT and soon NSW (and Tasmania if its bill ispassed) risk a criminal penalty of $110,000, two years in prison or both, if they admit to creatinga family by compensating a woman for surrogacy overseas.Labor MP Linda Burney, who tabled this criminalisation amendment in the NSW parliament lastDecember, believes children born through surrogacy "should have access to information aboutthe circumstances of their birth and their genetic history". I agree. Such insight is likelyimportant for a childs psychological wellbeing and their sense of identity.But Australians utilising commercial surrogacy are now being pushed to do the opposite; toconceal the childs biological parentage. Not because they dont believe in telling their child, butto avoid a jail term.Evidence is already showing such disincentives to commercial surrogacy are not changingbehaviour. Inquiries across Australia have shown that when faced with legal obstacles includingcriminal sanctions, intending parents travel wherever necessary and pay whatever they can affordto pursue their dream of children.In 1938, the US magazine Fortune ran an article on contraception. The practice was still illegal inmany US states and restricted in the majority, viewed as distastefully as is surrogacy today; anaberration of nature; an attempt by humans to interfere in Gods will, robbing women of aprecious reproductive function. Yet the demand for contraception, like surrogacy, was too strongto maintain its effective prohibition.Western societies have seen similar problems when they have outlawed abortion, prostitution,alcohol and illicit drug use. Australian legislators are clearly irked by the fear that surrogacycommodifies and unfairly exploits female reproduction. Again they have not consulted theliterature or spoken with surrogates. Ironically, in the US, regardless of the monetarycompensation, the most common reason surrogates carry anothers baby is to give the ultimategift to an otherwise childless parent. Thats real altruism. In contrast, Australian legislatorsattempts to protect surrogates and intending parents are failing miserably.
