On 30 June 2004, the Attorney General will officially open the 7 Bi-annual
Mediation Conference in Darwin, Northern Territory. This highlight on the
Australasian calendar attracts those at the forefront of dispute resolution
and negotiation in Australia and overseas.
Theme

The theme of the 7 National Mediation Conference is t r u e t a l k i n g , f o r w a r d
w a l k i n g . T r u e t a l k i n g : respectful, inclusive and critical practice in mediation
for creative choices in management, planning and dispute resolution.
F o r w a r d w a l k i n g : determined, collaborative and practical implementation of
decisions in the professional and corporate domain.

Building on the 6 National Mediation Conference “Pathways towards
th
dispute management” the 7 National Mediation conference aims to promote
conversations and practical action towards national professional standards
and accreditation; to provide opportunities for cross fertilization between
our expanding fields of practice and to deliver a strong cross-cultural flavor
to both.

Wukindi-Rom Ceremony
(W ed nesd ay 30 Ju ne, Thu rsday 1 Ju ly a nd Fr id ay 2 July)
O PT IO NA L
Wukindi is pronounced as wookindi. Wukindi-Rom is a ceremony of the
Yolgnu Golumala Clan Nation People of East Arnhemland that has been
used traditionally for centuries as a conflict resolution and healing process
to restore relationships between individuals, groups and clan nations.
‘Wukindi-Rom’ connotes a place of healing, a sacred place, a place of law.
Indigenous Peoples from around Australia and over-seas have their own
similar traditional ceremonies for peace-making and conflict resolution.
Traditional Elders from other clan nations will join with Yolgnu Golumala
Clan Nation Elders in conducting a demonstration of their deeply reflective
and ceremonial approach to dispute resolution. They extend an invitation to
conference delegates to bring their own breakfast to the Darwin Esplanade on each morning of the
conference and listen to and reflect upon the richness of their wisdom.

Talking-table Sessions
In the week preceding the conference, the inaugral Wukindi-Rom Cross-Cultural Mediation &
Leadership Training Project will have been concluded on Elcho Island, East Arnhemland. Once on
each day of the conference, graduates of this joint Yolgnu Golumala Clan Nation / Charles Darwin
University project, will facilitate small group discussions among conference delegates. It is hoped that
such discussions will be opportunities for delegates to foster appreciation of the breadth & depth of our
emerging profession and at the same time provide some informal opportunities for mentoring and
collegiality.
Breakout Sessions
Cross Cultural Sector
There will be presentations and workshops concerning family mediation; in an Indigenous context;
community based and court referred Indigenous mediation models; issues of power and authority in
Indigenous ADR; facilitating regional governance; international perspectives on cross-cultural models;
and a colloquium “Mediation applications in the Indigenous context”.
Community Sector
There will be presentations and workshops concerning quality and standards in PDR; developments
and family mediation; domestic violence and child protection; ADR in schools; Universities and ADR;
the “Power of apology” and a National Community Justice Centre colloquium.
Corporate Sector
There will be presentations and workshops concerning extending the application of ADR technologies
in the making of business choices; ADR in urban planning; ADR in major infrastructure development;
capacity building conflict coaching; workplace conflict and bullying.
Professional Practice
There will be presentations and workshops concerning “Tools for Tool boxes” complaints and ADR;
quality ADR Cost benefit analysis; online ADR; International ADR program design; ADR professional
attitudes and behaviors.
Rapporteur
Shirli Kirschner
Shirli Kirschner has been a qualified mediator for 12 years and is the
principal of Resolve Advisors Pty Ltd, which she established in August 1996.
Resolve provides mediation, facilitation and ADR and system design services
to a wide client base.
Shirli is on a number of mediator panels including the LEADR Advanced
panel, UTS/CDR and LawCover panels. She was on the standby panel for
Sydney Ferries for the Sydney Olympic games. Recent mediations include
disputes in the wholesale telecommunications market between stakeholder
carriers and a partnership disputes within a small ($8 million turnover)
company.
Shirli is the NECA dispute resolution adviser for the National Electricity Market.
She is on the editonal panel of the ADR bulletin.

Opening Speakers
Dr Peter Toyne, MLA
Minister for Justice & Attorney General
Dr Peter Toyne MLA has been a member of the legislative assembly since
1996. When the Labor party came to government in 2001 Dr Toyne formed
part of the Ministry as Attorney General of the Northern Territory.
Prior to his political career Dr Toyne was principal of Yuendumu Community
Education Centre which was responsible for all education programs from
pre-school to adult education, promoting the process of Aboriginalisation
and resulting in Aboriginal teachers joining the staff.
From 1990 to 1994 he was a Consultant to Government and other
agencies in a variety of areas where he is recognised as having developed
expertise including training, community development, telecommunications, water supply, road and
other infrastructure development. Dr Toyne completed his Ph D at the la Trobe University in 2000.
As Attorney General he has been instrumental in promoting ADR and in 2003 opened the Northern
Territory Justice and Community Centre.
The Hon. John von Doussa - President Human Rights & Equal Opportunities Commission
The Hon. John von Doussa was appointed President of the Human Rights and
Equal Opportunity Commission on 1 May 2003 for a five year term.
At the time of his appointment he was a Judge of the Federal Court of
Australia, an appointment he had held since 1988. He was also the President
of the Australia Competition Tribunal, a Presidential Member of the
Administrative Appeals Tribunal, an Additional Judge of the Supreme Court of
the Australian Capital Territory, and a Judge of the Industrial Relations Court
of Australia. From 1992 until shortly before his appointment he was also a
part-time Commissioner of the Australian Law Reform Commission. From 1986
to 1988 he was a Judge of the Supreme Court of South Australia.
Before his appointment as a Judge he was a Queens Counsel practicing mainly in South Australia,
and had served terms as the President of the Law Society of South Australia, and Vice-President of the
Law Council of Australia.
In South Australia he had a close interest in the organisation and provision of practical legal training
for newly qualified graduates in law. At different times he was the chair of advisory committees for the
graduate diploma courses in legal practice conducted by the University of South Australia and by the
Law Society of South Australia. In 1996 he was awarded an Honorary Doctorate of the University of
South Australia in recognition of that involvement. He received a Centenary Medal in 2003.
In 1993 he sat as an Acting Judge in the Supreme Court of Vanuatu. In 1997 he became a member of
the Court of Appeal of Vanuatu. In 2003 he was appointed a non-resident member of the Supreme
Court of Fiji. He continues to hold these appointments.

Rev. Dr. Djiniyini Gondarra AOM - Former member Council Aboriginal Reconciliation
Rev Dr Djiniyini Gondarra OAM has served a long career in
the Methodist and Uniting Churches. Ordained in 1976, he
was awarded the Order of Australia Medal in 1985.
He has held the positions of Director, Reconciliation Australia
Limited, Chief Executive Officer Aboriginal Resource and
Development Services Inc. & Northern Regional Council of
the Uniting Aboriginal and Islander Christian Congress.
Rev Djiniyini is currently a member of the Australian
Indigenous Cultural Network Steering Committee, Director of Yirrkala Business Enterprises and has
been Chairman of the Arnhem Land Progress Association Inc since 1993.

General Darwin Information
Darwin
The scenic modern town of Darwin and its huge harbor take visitors by
surprise. The unexpected lushness of the tropical city surrounded by blue
water and sandy beaches make it an ideal place to stay whilst visiting the
many beautiful natural attractions of the Top End.
Darwin offers all the sophistication of an international city with restaurants,
hotels, museums, art galleries, as well as nightlife. Yet Darwin's tropical
boundaries are the glittering allure of the Timor Sea and the luxuriant
greens of the tropical wetlands.
The history of Darwin and the Top End is also on display with many
historical reserves, museums and attractions charting the progress of the
region. From the pioneering days of early settlement, the mining boom times,
the war years of WWII, and the impact of cyclones and the natural
environment. The endeavors of the spirited pioneers that made Darwin what
it is today.
Local attractions include the Mindil Beach, crocodile farms, George Brown
Darwin Botanic Gardens, the Aviation Heritage Centre, Casuarina Coastal
Reserve, NT Art Gallery, and the East Point Military Museum.
Australia's only tropical capital city boasts a population of 77,000 with
about 20,000 more in the combined satellite city of Palmerston and the
surrounding rural area. Approximately half the Northern Territory
population lives within a 40km radius of Darwin and like the city itself, on
average they are younger than the rest of Australia.
It may be the city's relaxed lifestyle, the magnet of its attractions, the
haunting majesty of the monsoonal storms, or the smell of the tropics, but
people who experience Darwin never forget it.

The Conference will be held at the Darwin Entertainment Centre (DEC)
and the Holiday Inn Esplanade. This complex houses both DEC and the
Holiday Inn Esplanade. It has magnificent views overlooking tropical
parklands, foreshore of the Esplanade and is ideally located within the
central business district.
The DEC is the premier Entertainment and Convention venue in the Top
End of the Northern Territory of Australia. The Darwin Entertainment Centre hosts major
national and international acts as well as local theatre concerts and Darwin based artists.
For those delegates that have chosen accommodation from the wide variety offered for the

Weather and Dress Standard
In Darwin the weather is tropical – always warm, sometimes humid and with
lots of sunshine. With temperatures in June/July ranging from 19°C to 30°C
it is a time when the locals feel the cold and the visitors embrace the
warmth!
Territorians believe they have the best lifestyle in Australia, and with good
reason. The lifestyle in Darwin is casual and this is reflected in what people
wear. Neat casual wear is appropriate for both Conference sessions and
most social functions.
Conference sessions will be held in an air-conditioned venue, therefore you
may consider bringing a light pullover or jacket in case you get cool.
The Welcome Reception and Gala Dinner are both more formal occasions.
This calls for what you may hear referred to as “Darwin Rig” or “Territory
Rig”. This means for women, casual but elegant, and for men long trousers
and collared shirt, ties and Jackets are not necessary.
Transport & Transfers
The Cost: of taxis or private hire cars to and from the airport to the city
centre is approximately A$22.00 one way.
An alternative to this is the airport shuttle bus. This bus operates from the
front of the airport and Cost: A$7.50 one way or A$13.00 return.
Within the City Centre and for the budget minded there are cheaper
alternatives for transport, such as mini buses, that operate within Darwin
City Centre and Cost: approximately A$2.50 per person.

Throughout the duration of the conference, there will be a fully
operational tour desk available to take bookings for post forum tours.
