The broker used written financial plans that contained misleading statements and omitted material information with clients. The plans were not approved by her firm or filed with FINRA as required. In the financial plans, the broker recommended variable universal life insurance policies to clients. The recommendations were not suitable based on each client’s financial situation and needs. A broker from another firm was permanently barred from the industry by FINRA for making recommendations to clients to invest in collateralized mortgage obligation (CMO) securities without having reasonable grounds for believing his recommendations were suitable based on the clients’ financial situations and needs. In addition, the broker, made misstatements of material fact and omitted material facts in connection with the • CMO recommendations. used discretion to select particular CMO investments for his clients, decided how much • of security his clients should buy and when to buy them, and decided how much margin borrowing would be utilized to purchase the CMOs. A broker from another firm was fined $5,000 by FINRA and suspended 40 days for settling a client complaint outside his firm and without his firm’s knowledge.
