Dr. Arbind Prasad Tel.No.: 011-2338 4284 Fax No.:011-2338 8152 Dated the 4th September, 2009 Dear As you are aware, the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995, is our basic legislation on disability matters, and covers prevention and early detection of disabilities and aspects of rehabilitation like early intervention, education, employment and vocational training, reservation of jobs in the State Sector, non-discrimination, research and manpower and creation of barrier-free environment. 2. Keeping in view the felt need for amendment to the PwD Act, 1995, arising out of the developments in the sector during the last 14 years, adoption of National Policy for Persons with Disabilities in 2006, consultation meetings with stakeholders, State Governments, NGOs, disabled persons, organizations and experts were held in four zonal meetings at Patna, Chennai, New Delhi and Goa in 2006-07. 3. As United Nations Convention on the Rights of Persons with Disabilities (UNCRPD) was ratified by India and has come into effect on 03.5.08, a need was also felt to harmonize the Act with its provisions as well as those of National Trust Act, 1999. 4. Thereafter, draft amendments were deliberated in the meeting of the Central Coordination Committee, on 21.7.09 and their suggestions were examined and have been incorporated. 5. A copy of the draft amendments developed as a whole, along with an Explanatory Note are enclosed, with the request that considered comments/ views of your State Government on the proposed amendments may please be sent to the undersigned latest by 15.10.2009.
