What Is Save Hosting?Whether you know it or not, there are ongoinglegislative and regulatory initiatives under seriousconsideration that could effectively put you out ofbusiness -- and the time to put a stop to these ill-considered ideas is now.That’s why we have organized a meeting of hostingindustry leaders to discuss these issues.
    • 3. When Is It?The gathering, entitled “Save Hosting!”, will takeplace on Monday, August 8th at noon at the SanDiego Convention Center in conjunction with theHostingCon trade show. The meeting room will bewell marked near HostingCon’s generalpresentations.
    • 4. Why Should You Be Concerned?Here are just a few of the proposedlegislative and regulatory initiativesthat threaten our industry:
    • 5. PROTECT IP ACTOnly kept from Senate floor by a single member’sprocedural intervention, this act stipulates that: ◦ Hosts are “acting in concert” with customers who are violating other’s rights. ◦ There is no safe harbor: even if you comply, you can still be sued. ◦ No court orders are required for hosts to be “technically feasible.”
    • 6. Protecting Children From Internet Pornographers ActRequires hosts to “securely” maintain networkaccess logs for 18 months.
    • 7. Data Accountability & Trust ActEstablishes jurisdiction of Federal TradeCommission over personal data.Allows enforcement by state attorneys general.
    • 8. Personal Data Privacy & Security Act of 2011Requires creation of a security program, but nosafe harbor from customer suits.Establishes jurisdiction of Federal TradeCommission over certain security issues.
    • 9. Data Security & Breach Notification Act of 2011Establishes jurisdiction of Federal TradeCommission over certain security issues.No safe harbor.
