Many people have asked me in the past what is probate real estate investing and is it a good real
estate investing strategy? I wrote this article to help people better understand the entire process
of probate real estate investing as well as give my opinion on if it’s a profitable real estate
investing strategy.

What is the legal definition of probate? Probate is the process of legally establishing the validity
of a will before a judicial authority and probate court is necessary when someone dies without a
proper will in place and decides the legal validity of the person’s will. An executor(personal
representative) who is usually named in the will and if not one is appointed and has the legal
power to dispose the assets to the heirs selected by the deceased.
However many people die without a will so therefore probate court is necessary to determine
what to do with all property of the deceased including their house. Many times the family does
not want to keep the house of the deceased and would much prefer to pay off all creditors and
divide the remaining funds equally.
So, what is probate real estate investing? This is a real estate investing strategy where
investors seek to purchase the property from the motivated sellers at a discount and usually they
get a discount because the sellers are not wanting to hire a real estate agent and pay them
commissions because it cuts into the profits and it also can drag out into a long process.
Can Anyone Do Probate Real Estate Investing
Yes, anyone can use probate real estate investing as a strategy, there are no licenses or permits
needed at all, it’s just about learning the process and going for it. Many investors choose to not
use probate real estate investing as a part of their investing strategies because they feel like it is
insensitive because a death has taken place, however many family member are relieved to have
someone they can quickly sell the house to and move forward with their lives.
In most situations the heirs do not have the money or simply don’t want the responsibilities of
fixing the repairs to the house in order to get it ready to sell so they are very motivated to sell fast
and at a lower cost than it’s actually worth and this is what makes probate real estate investing
such an attractive opportunity for the ones who chooses to use it. Also there may be an existing
mortgage on it that must be paid first from all proceeds from the sale and this is yet another great
reason for them to sell fast!
There are a few other issues that must be dealt with before the property can actually be sold such
as posting it in the local newspaper in order to give anyone who may have a claim on that
2. property including all creditors. This can make the process take a little longer however it’s
usually worth the investors wait.
