How does the Federal Government define marriage?

DOMA
The federal government defines marriage as the union between one man and one woman; per Defense of Marriage Act (DOMA 1996). DOMA reserves federal rights and benefits to heterosexual couples and prevents same-sex couples from receiving federal rights and benefits in any state.

Is it a crime to be gay?

No. Lawrence and Garner v. Texas (2003) was a landmark case that made it unconstitutional for same sex relationships to be considered criminal acts. Houston, Texas police entered Lawrence’s apartment and found him and another adult male engaging in a private, consensual sexual act. The court reasoned that the case turned on whether Lawrence and Garner were free as adults to engage in the private conduct in the exercise of their liberty under the Due Process Clause.
Justice Kennedy wrote “Their right to liberty under the Due Process Clause gives them the full right to engaged in their conduct without intervention of the government.
