  • The Right of Self-DefenseThe use of physical force as itrelates to Self-defense is the right forcivilians acting on their own behalf todefending ones own life or the life ofothers, including the use of deadlyforce.
  • Self-defense is clearly identified in the criminal law, and whenexercised correctly; as I will explainin a moment, exonerates the author thereby making it justified. Any violent act as outlined in the Criminal Law of Panama
  • would normally be considered punishable by fine or imprisonment, however, do to the circumstances which led to the use of force, thecourts may deem the actions taken orthe degree of self-defense used to be justified and exonerate the user or author.
  • Features of Self-Defense in accordance with Panamanian Criminal Law.Acts of self-defense that the local courts may find justified are as follows: The existence of an unjust aggression, actual or imminent. Using a rational means to prevent or repel aggression. Lack of sufficient provocation on the part of one who advocates or is defended. It is presumed to be acting reasonably in self- defense to repel an attack against you when without your consent, a person has entered your residence, dwelling, house or room.
  • This is regulated in Articles 31 and 32 ofthe Criminal Code of Panama.Keep in mind that the use of force indefense of one’s self must be reasonable.For example, if someone strikes you withtheir hand, it would be unjustified to usedeadly force. In this scenario, you canexpect to be arrested and prosecuted foryour actions.
  • La Legítima Defensa o Defensa PropiaLa legítima defensa o defensa propia es, enDerecho Penal, una causa que justifica larealización de una conducta sancionadapenalmente, eximiendo de responsabilidad a suautor, y que en caso de no cumplirse todos susrequisitos, permite reducir la pena aplicable aeste último.
  • En otras palabras, es una situación quepermite eximir, o eventualmente reducir, lasanción ante la realización de unaconducta generalmente prohibida.Una definición más concreta revela que ladefensa propia es: el contraataque orepulsión de una agresión actual,inminente e inmediata con el fin deproteger bienes jurídicos propios o ajenos.
  • Legítima defensa y sus características deconformidad con las leyes penales panameña La existencia de una agresión injusta, actual o inminente. Utilización de un medio racional para impedir o repeler la agresión. Falta de provocación suficiente por parte de quien se defiende o es defendido. Se presume que actúa en legítima defensa quien razonablemente repele al que, sin su consentimiento, ha ingresado a su residencia, casa o habitación.
  • Esto se encuentra regulado en losartículos 31 y 32 del Código Penal dePanamá. GRACIAS
