Meeting the Mandates of HB 1321 <ul><li>establish and local school systems implement a state mandated process for students to follow in reporting instances of alleged inappropriate behavior by a teacher, administrator, or other school employee toward a student; and </li></ul>House Bill 1321 passed by the Georgia Legislature amended O.C.G.A. 20-2-751.7 to require that the PSC:

Student Reporting of Acts of Sexual Misconduct <ul><li>(a)  Any student (or parent or friend of a student) who has been the victim of an act of sexual abuse or sexual misconduct by a teacher, administrator or other school system employee is urged to make an oral report of the act to any teacher, counselor or administrator at his/her school. </li></ul>

Student Reporting of Acts of Sexual Misconduct <ul><li>(b) Any teacher, counselor or administrator receiving a report of sexual abuse or sexual misconduct of a student by a teacher, administrator or other employee shall make an oral report of the incident immediately by telephone or otherwise to the school principal or principal’s designee, and shall submit a written report of the incident to the school principal or principal’s designee within 24 hours. If the principal is the person accused of the sexual abuse or sexual misconduct, the oral and written reports should be made to the superintendent or the superintendent’s designee. </li></ul>

Student Reporting of Acts of Sexual Misconduct <ul><li>(c)  Any school principal or principal’s designee receiving a report of sexual abuse as defined in O.C.G.A. 19-7-5 shall make an oral report immediately, but in no case later than 24 hours from the time there is reasonable cause to believe a child has been abused. The report should be made by telephone and followed by a written report in writing , if requested, to a child welfare agency providing protective services, as designated by the Department of Human Resources, or, in the absence of such agency, to an appropriate police authority or district attorney. </li></ul>

  27. 28. 20-2-1184 <ul><li>Any employee of a public or private elementary or secondary school ... who has reasonable cause to believe that a student at that school has committed any of the following acts upon school property or at any school function, shall immediately report the act and the name of the student to the principal or the principal´s designee. </li></ul><ul><ul><li>Aggravated assault involving a firearm; </li></ul></ul><ul><ul><li>Aggravated battery; </li></ul></ul><ul><ul><li>Sexual offenses; </li></ul></ul><ul><ul><li>Carrying a deadly weapons at public gatherings; </li></ul></ul><ul><ul><li>Carrying weapons at school; </li></ul></ul><ul><ul><li>Illegal possession of a pistol or revolver by a person under 18 </li></ul></ul><ul><ul><li>Possession or any use of marijuana and controlled substances, </li></ul></ul><ul><li>The principal ... shall make an oral report thereof immediately by telephone or otherwise to the appropriate school system superintendent and to the appropriate police authority and district attorney . </li></ul><ul><li>Any person who fails to make a report shall be guilty of a misdemeanor . </li></ul>
  28. 29. <ul><li>O.C.G.A. § 20-2-984.2 </li></ul><ul><li>(a) Superintendents shall make an immediate written report to the local board of education upon receiving a written report that any educator employed by the local unit of administration has committed any of the following specifically identified crimes: </li></ul><ul><ul><li>Murder, voluntary manslaughter, aggravated assault, aggravated battery, or kidnapping </li></ul></ul><ul><ul><li>Any sexual offense , </li></ul></ul><ul><ul><li>Any sexual exploitation of a minor </li></ul></ul><ul><ul><li>Any offense involving marijuana or a controlled substance </li></ul></ul><ul><ul><li>Any offense involving theft , </li></ul></ul><ul><ul><li>Unlawfully operating a motor vehicle after being declared a habitual violator </li></ul></ul><ul><li>(b) If the administrator and the local board of education have a good faith, reasonable basis to believe that the incident occurred or evidence exists, the local board of education shall, within a reasonable period of time but not later than 30 days from receipt of the report, transmit such report to the commission with a request for investigation . </li></ul>

Educators are required to report a breach of one or more of the Standards in the Code of Ethics for Educators as soon as possible but no later than ninety (90) days from the date the educator became aware of an alleged breach unless the law or local procedures require reporting sooner. Educators should be aware of local policies and procedures and/or the chain of command for reporting unethical conduct. Complaints filed with the Professional Standards Commission must be in writing and must be signed by the complainant (parent, educator, personnel director, superintendent, etc.).   49. 50. Older Women The educator engaged in sexual misconduct with a male student that she taught in the sixth grade the previous year. The relationship involved telephone, text messaging, e-mail and internet contacts, and the student and the educator engaging in sexual activity.
  50. 51. High School Band Director The educator engaged in a sexual relationship with a 15 year-old female student in the band room of the high school. Physical evidence, including a used condom, was retrieved from the incident location.
  51. 52. The educator admitted that she and a student slept together and that she and a student had &quot;French kissed. &quot; She indicated that they had kissed more than once and less than five times. French Kiss

  53. 54. Predator The educator provided cigarettes, alcohol and pornography to a 14 year-old student who frequently spent the night at his home. During a computer chat, the educator admitted that he found the student sexually attractive, that the student’s appearance and actions sexually stimulated him and asked for advice on how to initiate sexual interaction between himself and the student. Child pornography was found on the educator's computer. He pled guilty to Enticing A Child For Indecent Purposes.

Three Forms of Educator Sexual Harassment <ul><li>Physical : fondling, touching or sexual abuse </li></ul><ul><li>Verbal : commenting on a student's body parts or making sexually explicit jokes </li></ul><ul><li>Visual : showing sexually explicit photographs, or exposing one's genitals </li></ul>

  64. 65. PSC Cases Involving Sexual Misconduct
  65. 66. A 15 year old special education student accused the educator of rubbing/patting his bare stomach, telling him that he had gotten fat and then squeezing his penis through his clothes. The student has consistently told the same story. No one was present except the student and the educator when the incident occurred. A Touching Story
  66. 67. The Good Deed The Educator allegedly engaged in inappropriate behavior with a student she had previously mentored. The student lived in a dirty and crowded housing project where he had to sleep on the floor. The educator took him to eat, purchased him new clothes, and allowed him to sleep on the couch at her home on a couple of occasions.

The educator hugged students, called them “baby,” told them he loved them, told one student that she was “hot”, kissed one student on the forehead and placed his hands on the shoulders of another student. He said that his actions were paternalistic and not romantic or sexual in nature. Who Loves You Baby?

  69. 70. The educator, an assistant principal, was involved in a consensual sexual relationship with a subordinate teacher. Photographs of the educator in lingerie and sexually suggestive poses were posted on the internet and circulated throughout the educator’s school. The photos were downloaded from another teacher’s computer by a student while making repairs to the teacher’s computer. Model
  70. 71. The educator used his school system computer and cell phone to communicate with someone that he believed to be a 14 or 15 year-old female who was, in reality, a law enforcement officer. He expressed an interest in having a sexual relationship with the underage female persona. Pornography was discovered during a search of the educator’s school system office and school system computer. Superintendent

  73. 74. Be Friendly, Not a Friend. Conversations with students should be warm, caring and provide support for their learning and growth. Relationships should be centered on school events and activities.
  74. 75. Choose Appropriate Settings <ul><li>Schedule student meetings at regular times and when other staff members are present. </li></ul><ul><li>Hold meetings with individual students in rooms with a door open or with an unobstructed window view. </li></ul>

You are a private citizen, but you also are always an educator!  Electronic Communications Your out-of-school conduct can affect your job security.  What you post on a blog, on MySpace , or on Facebook can be accessed by students.   If you wouldn't want it on the front page of the local newspaper don't post it on the web!
  80. 81. Dress Professionally Clothing and grooming should reflect the professional status of the educator and should never be provocative or a distraction to students.
  81. 82. Touching Do not touch students in a manner that a reasonable person could interpret as inappropriate.
  82. 83. Engage in age-appropriate forms of &quot;non-sexual touching.&quot; This means, in Frances M. Carlson's words, &quot;the touch must meet a child's age-appropriate expectations, as well as meet standards for what each individual child finds acceptable.&quot; Examples include: a Kindergarten teacher using a hug to comfort a student with a skinned knee; a coach patting a student on the back after winning a game.
  83. 84. Use the Touch Test &quot;Would you allow a stranger, teacher, coach, counselor, or anyone with whom you do not have a close personal or familial relationship to do this to you? Your answer to this can tell you whether or not your touch is appropriate.&quot;
  84. 85. Consider the student's needs. &quot;Does the student want to be touched or hugged? Some children who have been abused or who have tactile issues do not want to be touched. In fact, touching or hugging such a child may escalate a situation rather than enhance it.&quot;
  85. 86. Educators that have questions about how to handle situations involving professional relationships should consult with a supervisor.

Action Steps for Board Members and Administrators <ul><li>Acknowledge that some educators sexually exploit children. </li></ul><ul><li>Train all staff to ensure that they know the behaviors that are prohibited. </li></ul><ul><li>Make it clear that all staff members are expected to be alert for, and report, signs of possible exploitation. </li></ul>
  87. 88. Action Steps for Board Members and Administrators <ul><li>Promptly investigate all rumors and complaints. </li></ul><ul><li>Don’t allow bias to cause judgment errors. The educator that exploits his or her students is often the one who seems to be above suspicion. </li></ul><ul><li>Resist any inclination to discount data that points to a trusted educator. </li></ul>

Action Steps for Board Members and Administrators <ul><li>Enforce an anti-fraternization policy. </li></ul><ul><li>Educate parents and students about sexual exploitation. </li></ul><ul><li>Keep a log of each critical incident that takes place on campus to identify any patterns of misbehavior. </li></ul>
