Under the Employees’ Provident Funds and Miscellaneous Provisions Act, 1952 the statutory wage ceiling for enrolling employees, as well as for making contributions, is INR 6,500 per month (except for some special classes of employees).

In the Union Budget 2014, this statutory wage ceiling is proposed to be revised to INR 15,000 per month.

In this context, the Employees’ Provident Fund Organisation has issued a circular to its field officials for undertaking preparatory activities to implement this proposed changes.

KPMG FLASH NEWS KPMG IN INDIA Employees’ Provident Fund Organisation issues circular to its field officers to implement the proposed enhancement in statutory wage ceiling from INR6,500 to INR15,000 22 July 2014 Background Under the Employees’ Provident Funds and Miscellaneous Provisions Act, 1952 (EPF Act) the statutory wage ceiling for enrolling employees, as well as for making contributions, is INR6,500 per month (except for some special classes of employees). In the Union Budget 2014, this statutory wage ceiling is proposed to be revised to INR15,000 per month. In this context, the Employees’ Provident Fund Organisation (EPFO) has issued a circular to its field officials for undertaking preparatory activities to implement these proposed changes. Key points in the circular The key points highlighted in the circular are as under:  The notification for enhancement of statutory wage ceiling is likely to be issued shortly.  Enforcement officers to visit the establishments to check the total number of employees drawing salary beyond INR6,500, and up to INR15,000 per month, and not enrolled as members.  Enforcement officers to visit establishments with large employee strength, especially in the building and construction industries, placement agencies, etc.  Enforcement officers to meet the representatives of the employees’ unions and apprise the establishments about the intent of the notification and implementation requirements.

All establishments covered under the EPF Act will need to revise their compliances. Employers will have to enroll new employees who become eligible because of this revision of statutory wage ceiling. Secondly, they will have to contribute mandatorily upto the monthly pay of INR15,000 (as defined under the EPF Act) for the eligible employees. This will result in increase in the cost of compliances under the EPF Act. For the employees, this may mean increased contributions under the EPF Act which may impact their net take home salary. The employees will also be eligible for corresponding higher benefits. Companies pay various allowances as part of the compensation structure. These allowances may be questioned by the PF authorities if the contributions towards provident fund is on a monthly pay below INR15,000. In addition, companies will also have to monitor the compliance of employees who are engaged through contractors to ensure their proper enrollment and contributions.
