And whoeverthrew the charge of kufr as a believer, it is as if hekilled him.’ 22Both ahaadith are collected by the Imaams Ahmad, alBazzaar, at-Tabaraani, alBaihaqi and mentioned in the Majma` uz-Zawaa’id andMusnad Abu `Awaanah‫ﺍﷲ‬ ‫ﺭﺣﻤﻬﻢ‬.
  2. 2. BE AWARE OF TAKFIR!REFUTING TAKFIRI STATEMENTSIntroduction:Dear brothers and sisters, this small work is to serve asanother installment of warning the Ummah againstfuture dangers. It should be the priority of those whohave the ability to that they hasten to warn the Ummahagainst things that could harm them in this life and haveconsequences for the Hereafter.For the past few years, the forces of Takfiri thinkinghave had their way. And that has included the physicalassault of others, the injury of others, forced divorceswithout the permission of one of or both of the spousesinvolved, the self-appointment of walis without thepermission of the sister and the sale and purchasing ofnarcotics to fund haraam activities.But the most terrible of all is that the forces ofexaggerated takfir have been responsible for theblurring of the clear and basic understanding of Ahl us-Sunna walJama`ah in the matter of takfir. From this, allthe other acts mentioned above were made possible. Itis absolutely necessary that these beliefs that are taughtare answered and exposed for the benefit of the Ummahand for their safety.BE AWARE OF TAKFIR!WHAT IS KUFR AND WHO IS A KAAFIR?With the abuse of takfir and the methodology of Ahl us-Sunna in regards to investigating the kufr of anindividual, people have become targets for those whomight have a personal grievance or show hatred towardsthem. This has led to some people being accused ofmajor kufr, when in fact that has not been the case at all.It is now imperative, in order to block this type ofintimidation, that an explanation of what exactly kufr isbe forthcoming. After this explanation, the people canno longer be bullied with takfir or be bullied intomaking takfir when they are not in a position to do so.Kufr (unbelief) in the linguistic sense: “It is coveringsomething and veiling it. And all of what coverssomething, then it has done kufr to it. And from this, thefarmer can be called a kaafir, for he covers the seed withthe dirt. Likewise, Allah Ι has said,‫ﻧﺒﺎﺗﻪ‬ ‫ﺍﻟﻜﻔﺎﺭ‬ ‫ﺃﻋﺠﺐ‬ ‫ﻏﻴﺚ‬ ‫ﻛﻤﺜﻞ‬‘The likeness of vegetation after rain, thereof thegrowth is pleasing to whoever (kuffar) that planted it.’3“This means it is pleasing to the tiller, and from that thetiller is named to be a kaafir, for he has veiled the favourof Allah Ι. Al Azhari says,3Surat ulHadid, ayah 20

BE AWARE OF TAKFIR!‘And His favours are his proven signs of His Tawhid.And the favours, which the kaafir has veiled, are thesigns that enable the people to make the distinction thatthe Creator is One without partner. And likewise, hesent the Messengers with miraculous signs, books andabundant obvious proofs as a favour from Him.‘Thus whoever is not truthful to the favour, and herejects it, then he has become a kaafir (showed unbelief)in the favour of Allah, meaning that he has covered andveiled the favour from himself.’ ”4Shari`a definition of kufr: It is the complete decrease ofimaan and it is the opposite of imaan. It is the unbeliefin Allah, Mighty and Majestic, and His favours and thekufr here has two matters, kufrun akbar (major kufr)and kufrun asghar (minor kufr). In this case, the kufr iswhat the person is doing by covering the bounty andfavour of Allah Ι from himself or others.KUFRUN AKBAR (major kufr) In general, it isdisbelief in Allah Ι, His Angels, His Messengers, HisBooks, The Day of Judgement and Divine Decree andPre-ordainment, the good and the bad of it, in total or inany of these pillars. This also includes showing what isthe opposite of the belief, for example by statements,actions and expressed beliefs of kufr that nullify imaan.Also, if he is not practicing the pillars of Islam thatAllah Ι made as an apparent sign for a person to4Taken from Lisaan ul`Arabi, under the word ‘kufr.’BE AWARE OF TAKFIR!preserve his blood, honour and money, then this as wellleads to apostasy. In our time, many people think thatkufr is only to belie with the tongue, but this is not thebelief of Ahl us-Sunna. There are many types of kufrthat Allah mentioned in the Qur’an and the Sunna, butthere are six in particular that constitute the major kufr.a. Juhud. This is the denial of the signs of Allah Ι,whether it is a prophet, a miracle, an angel or a bookbrought by that prophet.It has three forms,1. Juhud alQalb (the denial of the heart). This is majorkufr and happens to the people who have no linkbetween their heart and their mind.2. Juhud alLisaan, which is denying of the signs withthe mouth, although the heart is satisfied with thetruth. This denial is also called the juhud ofarrogance and self-oppression (zulm). This is themost well known juhud for the evil tyrants. ThePharaoh of Egypt and his army remains one ofhistory’s greatest examples of Juhud al-Lisaan,‫ﺍﺳﺘﻴﻘﻨﺘﻬﺎ‬ ‫ﻭ‬ ‫ﺑﻬﺎ‬ ‫ﺟﺤﺪﻭﺍ‬ ‫ﻭ‬ ‫ﻣﺒﻴﻦ‬ ‫ﺳﺤﺮ‬ ‫ﻫﺬﺍ‬ ‫ﻗﺎﻟﻮﺍ‬ ‫ﻣﺒﺼﺮﺓ‬ ‫ﺁﻳﺎﺗﻨﺎ‬ ‫ﺟﺎءﺗﻬﻢ‬ ‫ﻓﻠﻤﺎ‬‫ﺍﻟﻤﻔﺴﺪﻭﻥ‬ ‫ﻋﺎﻗﺒﺔ‬ ‫ﻛﺎﻥ‬ ‫ﻛﻴﻒ‬ ‫ﻓﺎﻧﻈﺮ‬ ً‫ﺍ‬‫ﻋﻠﻮ‬ ‫ﻭ‬ ً‫ﺎ‬‫ﻇﻠﻤ‬ ‫ﺃﻧﻔﺴﻬﻢ‬“Whereas when Our signs came to them, clear to seewith insight, they said, ‘This is clear and obviousmagic. And they denied (juhud) them arrogantly and
  4. 4. BE AWARE OF TAKFIR!without reason, although they were convinced of it inthemselves. So see what was the penalty of the corruptones. ’”53. Juhud al`Amal, that being the juhud in action. Thisconsists of the person not denying by the tongue, butdenying by his action. This happens when heannounces something opposite to what he has beentold by Allah Ι, without contesting it directly. It isalso when he acts opposite to the order deliberately,without contesting with the mouth.The example for this type would be the individual that isa ruler and knows that the penalty for adultery in Islamis the death penalty. However, rather than implement thejudgement of Allah Ι, he makes a rule that those whocommit adultery are to be jailed only. Although he neverdenied the law per se, he has denied it simply by actingopposite to the order deliberately.b. Takdhib. This matter here is to belie or to denysomething from the words, signs or promise of AllahΙ, for example, the Judgement Day. There are threetypes,1. Takdhib alQalb, where the heart rejects the truth.2. Takdhib alLisaan, which has two forms,5Surat un-Naml, ayaat 13-14BE AWARE OF TAKFIR!a. This is to directly contest by saying, “Allah Ι saidthis, but that can’t be right.”b. This is the takdhib of hinting about. An example ofthis is if someone were to say, “Allah Ι said X.” Youthen reply by saying, “No, Allah Ι said Y.” TheMushrikun (pagans) said the same thing,‫ﺷﻲء‬ ‫ﻣﻦ‬ ‫ﺣﺮﻣﻨﺎ‬ ‫ﻻ‬ ‫ﻭ‬ ‫ﺍﺑﺎﺅﻧﺎ‬ ‫ﻻ‬ ‫ﻭ‬ ‫ﺃﺷﺮﻛﻨﺎ‬ ‫ﻣﺎ‬ ‫ﺍﷲ‬ ‫ﺷﺎء‬ ‫ﻟﻮ‬ ‫ﺃﺷﺮﻛﻮﺍ‬ ‫ﺍﻟﺬﻳﻦ‬ ‫ﺳﻴﻘﻮﻝ‬‫ﺑﺄﺳﻨﺎ‬ ‫ﺫﺍﻗﻮﺍ‬ ‫ﺣﺘﻰ‬ ‫ﻗﺒﻠﻬﻢ‬ ‫ﻣﻦ‬ ‫ﺍﻟﺬﻳﻦ‬ ‫ﻛﺬﺏ‬ ‫ﻛﺬﻟﻚ‬“Those who make shirk (polytheism) will say, ‘If Allahwilled, we would not have associated partners, neitherourselves nor our fathers, and we would not have madeharaam anything.’ Likewise, those from before themlied until they tasted punishment.”6‫ﺍﺑﺎﺅﻧﺎ‬ ‫ﻻ‬ ‫ﻭ‬ ‫ﻧﺤﻦ‬ ‫ﺷﻲء‬ ‫ﻣﻦ‬ ‫ﺩﻭﻧﻪ‬ ‫ﻣﻦ‬ ‫ﻋﺒﺪﻧﺎ‬ ‫ﻣﺎ‬ ‫ﺍﷲ‬ ‫ﺷﺎء‬ ‫ﻟﻮ‬ ‫ﺃﺷﺮﻛﻮﺍ‬ ‫ﺍﻟﺬﻳﻦ‬ ‫ﻗﺎﻝ‬ ‫ﻭ‬‫ﺷﻲء‬ ‫ﻣﻦ‬ ‫ﺩﻭﻥ‬ ‫ﻣﻦ‬ ‫ﺣﺮﻣﻨﺎ‬ ‫ﻻ‬ ‫ﻭ‬.‫ﺍﻟﺮﺳﻞ‬ ‫ﻋﻠﻰ‬ ‫ﻓﻬﻞ‬ ‫ﻗﺒﻠﻬﻢ‬ ‫ﻣﻦ‬ ‫ﺍﻟﺬﻳﻦ‬ ‫ﻓﻌﻞ‬ ‫ﻛﺬﻟﻚ‬‫ﺍ‬ ‫ﺍﻟﺒﻼﻍ‬ ‫ﺇﻻ‬‫ﻟﻤﺒﻴﻦ‬“And those who make shirk (polytheism) say, ‘If Allahhad willed, we would have never worshipped anythingbesides Him, neither us nor our fathers. Takdhib al`Amal, a person is doing an action thatshows that he is denying. This example can be actedout with the following verses from the Qur’an,‫ﺍﻟﻴ‬ ‫ﻳﺪﻉ‬ ‫ﺍﻟﺬﻱ‬ ‫ﻓﺬﻟﻚ‬ ‫ﺑﺎﻟﺪﻳﻦ‬ ‫ﻳﻜﺬﺏ‬ ‫ﺍﻟﺬﻱ‬ ‫ﺭﺃﻳﺖ‬ ‫ﺃ‬‫ﻃﻌﺎﻡ‬ ‫ﻋﻠﻰ‬ ‫ﻳﺤﺾ‬ ‫ﻻ‬ ‫ﻭ‬ ‫ﺘﻴﻢ‬‫ﺍﻟﻤﺴﻜﻴﻦ‬“Have you not seen the one who denied (takdhib) thereligion? Then that is who was hard on the orphansand did not hasten to feed the poor. 8”9These simple three verses here refute the false belief thatyou have to do major kufr in speech before you canleave the religion due to major kufr. These verses hereshow that this is not the case. The verse doesn’t read,“Have you not heard” nor “Did he not deny withspeech?” Of equal weight as well is the one whomarries his mother. This Muslim who goes and commitsthis act exits from the religion of Islam and becomes akaafir. He did not have to say anything in order to leavefrom the religion. The actions that he advertised showed7Surat un-Nahl, ayah 358This does not mean that the person that doesn’t feed the poor a kaafir,but this evidence shows clearly that Allah Ι has said that those who do theopposite of what they are told, they are doing the highest form of takdhib,which is the worse of all the forms. The rulers of today do this type oftakdhib as well. If this is being done with the Shari`a, it causes one to goout of the religion, as with the case of the rulers.9Surat ulMa`un, ayaat 1-3BE AWARE OF TAKFIR!that he was denying the rights of Allah Ι. The versesbelow can fit into the general category of Takdhib,‫ﺍﻷﻭﻟﻴﻦ‬ ‫ﻧﻬﻠﻚ‬ ‫ﺃﻟﻢ‬ ‫ﻟﻠﻤﻜﺬﺑﻴﻦ‬ ‫ﻳﻮﻣﺌﺬ‬ ‫ﻭﻳﻞ‬ ‫ﺍﻟﻔﺼﻞ‬ ‫ﻳﻮﻡ‬ ‫ﻣﺎ‬ ‫ﺃﺩﺭﺍﻙ‬ ‫ﻣﺎ‬ ‫ﻭ‬“And what will cause you to know what is the Day ofSorting (Judgement)? Woe be to the deniers (of theDay of Sorting) (takdhib). Did We not destroy thosebefore?”10c. Istakbaar. This kufr is actually being proud andhaughty towards the truth and expressing arrogancewhen the signs of Allah Ι are presented,‫ﻣﻦ‬ ‫ﻓﻴﻪ‬ ‫ﻧﻔﺨﺖ‬ ‫ﻭ‬ ‫ﺳﻮﻳﺘﻪ‬ ‫ﻓﺈﺫﺍ‬ ‫ﻃﻴﻦ‬ ‫ﻣﻦ‬ ً‫ﺍ‬‫ﺑﺸﺮ‬ ‫ﺧﺎﻟﻖ‬ ‫ﺇﻧﻲ‬ ‫ﻟﻠﻤﻼﺋﻜﺔ‬ ‫ﺭﺑﻚ‬ ‫ﺇﺫ‬‫ﻓ‬ ‫ﺳﺎﺟﺪﻳﻦ‬ ‫ﻟﻪ‬ ‫ﻓﻘﻌﻮﺍ‬ ‫ﺭﻭﺣﻲ‬‫ﻭ‬ ‫ﺍﺳﺘﻜﺒﺮ‬ ‫ﺇﺑﻠﻴﺲ‬ ‫ﺇﻻ‬ ‫ﺃﺟﻤﻌﻮﻥ‬ ‫ﻛﻠﻬﻢ‬ ‫ﺍﻟﻤﻼﺋﻜﺔ‬ ‫ﺴﺠﺪ‬‫ﺍﻟﻜﺎﻓﺮﻳﻦ‬ ‫ﻣﻦ‬ ‫ﻛﺎﻥ‬“And when your Lord said, ‘I am going to create ahuman being from clay. So when I have fashioned andshaped him and breathed into him his soul created byMe, then you are to prostrate to him.’ So all of theangels prostrated, except Iblis. He was proud(istikbaar) and became a kaafir.”11d. Istihzaa’. This sin is the mocking or making jest ofany of the signs of Allah Ι. This could be in jestingabout the religion of Islam, or it could be mocking10Surat ulMursalaat, ayaat 13-1611Surah Saad, ayaat 71-74

Allah Ι mentions thefate of such a people,‫ﺇﻳﻤﺎﻧﻜﻢ‬ ‫ﺑﻌﺪ‬ ‫ﻛﻔﺮﺗﻢ‬ ‫ﻗﺪ‬ ‫ﺗﻌﺘﺬﺭﻭﺍ‬ ‫ﻻ‬ ‫ﺗﺴﺘﻬﺰﺋﻮﻥ‬ ‫ﻛﻨﺘﻢ‬ ‫ﺭﺳﻮﻟﻪ‬ ‫ﻭ‬ ‫ﺁﻳﺎﺗﻪ‬ ‫ﻭ‬ ‫ﺑﺎﷲ‬ ‫ﺃ‬ ‫ﻗﻞ‬‫ﻣﺠﺮﻣﻮﻥ‬ ‫ﻛﺎﻧﻮﺍ‬ ‫ﺑﺄﻧﻬﻢ‬ ‫ﻃﺎﺋﻔﺔ‬ ‫ﻧﻌﺬﺑﻜﻢ‬ ‫ﻣﻨﻜﻢ‬ ‫ﻃﺎﺋﻔﺔ‬ ‫ﻋﻦ‬ ‫ﻧﻌﻒ‬ ‫ﺇﻥ‬“Say, ‘Was it in Allah, His verses or His Messengerthat you were mocking (istihzaa’)? Make no excuseabout it, you have disbelieved (become kuffar) afteryou had imaan. If we pardon a some of you, surely wewill punish the others, for they were the criminals.’ ”12e. I`raad. This aspect is turning away from and fleeingfrom whatever admonition and signs that Allah Ιgives to guide someone from the darkness to thelight. These people are mentioned in the followingmanner,‫ﺑﻞ‬ ‫ﻗﺴﻮﺭﺓ‬ ‫ﻣﻦ‬ ‫ﻓﺮﺕ‬ ‫ﻣﺴﺘﻨﻔﺮﺓ‬ ‫ﺣﻤﺮ‬ ‫ﻛﺄﻧﻬﻢ‬ ‫ﻣﻌﺮﺿﻴﻦ‬ ‫ﺍﻟﺘﺬﻛﺮﺓ‬ ‫ﻋﻦ‬ ‫ﻟﻬﻢ‬ ‫ﻓﻤﺎ‬‫ﺍﻵﺧﺮﺓ‬ ‫ﻳﺠﺎﻓﻮﻥ‬ ‫ﻻ‬ ‫ﺑﻞ‬ ‫ﻛﻼ‬ ‫ﻣﻨﺸﺮﺓ‬ ً‫ﺎ‬‫ﺻﺤﻔ‬ ‫ﻳﺆﺗﻰ‬ ‫ﺃﻥ‬ ‫ﻣﻨﻬﻢ‬ ‫ﺍﻣﺮﺉ‬ ‫ﻛﻞ‬ ‫ﻳﺮﻳﺪ‬“Then what is wrong with them that they flee (I`raad)from the remembrance (the Qur’an) as if they weredonkeys fleeing from a lion? On the contrary, everyone of them wants that he should be given pages12Surat ut-Tawba, ayah 65-66BE AWARE OF TAKFIR!spread out (of the revelation). By no means! On thecontrary, they do not fear the Hereafter.”13f. `Inaad. This type of kufr is to be stubborn againstAllah Ι and His signs and to insist on keeping othersor oneself in kufr. Allah Ι has said,ً‫ﺎ‬‫ﺇﻟﻬ‬ ‫ﺍﷲ‬ ‫ﻣﻊ‬ ‫ﺟﻌﻞ‬ ‫ﺍﻟﺬﻱ‬ ‫ﻣﺮﻳﺐ‬ ‫ﻣﻌﺘﺪ‬ ‫ﻟﻠﺨﻴﺮ‬ ‫ﻣﻨﺎﻉ‬ ‫ﻋﻨﻴﺪ‬ ‫ﻛﻔﺎﺭ‬ ‫ﻛﻞ‬ ‫ﺟﻬﻨﻢ‬ ‫ﻓﻲ‬ ‫ﺍﻟﻘﻴﺎ‬‫ﺍﻟﺸﺪﻳﺪ‬ ‫ﺍﻟﻌﺬﺍﺏ‬ ‫ﻓﻲ‬ ‫ﻓﺄﻟﻘﻴﻪ‬ ‫ﺃﺧﺮ‬“I will put in the Hellfire every stubborn (`inaad)kaafir, hindering from the good and increasing in eviland doubt, who made with Allah another god. Thus Iwill put him in the most severe punishment.”14g. Istibdaal. This is the kufr of replacing the Shari`a,and it has three manifestations, as has been listed byal `Allamah Ibrahim ibn Muhammad ibn Ibrahim15,13Surat ulMuddaththir, ayaat 49-5314Surah Qaaf, ayaat 24-2615This is the son of the great scholar al `Allamah Muhammad ibnIbrahim. Most of his life, he has spent in exile and is denied his basicrights as a human being. The underground Islamic movements do notprint except his books, and he is not able to leave from the Peninsula or tomake contact with most of the outside world. Upon the death of hisfather, he was considered the most knowledgeable for the position ofMufti, but he was over ruled and removed. This particular statements ofhis and similar pronouncements can be found in the introduction to TafsirSurat ulFatihah by Muhammad ibn `Abdul Wahhaab, p. 1-5 as well asMuhammad Nasib ar-Rifaa`ii’s book of tafsir in Baab ulKufr and Baabudh-Dhunub, which is distributed in Syria, Lebanon and other places.
  7. 7. BE AWARE OF TAKFIR!i. Replacing the law of Allah Ι with man madelaws. This is where someone actually legislates anew law and attributes it to the Shari`a or hemakes his own fabricated Shari`a. This exampleis spoken of below,‫ﺍﻟﻔﺼﻞ‬ ‫ﻛﻠﻤﺔ‬ ‫ﻻ‬ ‫ﻟﻮ‬ ‫ﻭ‬ ‫ﺍﷲ‬ ‫ﺑﻪ‬ ‫ﻳﺄﺫﻥ‬ ‫ﻟﻢ‬ ‫ﻣﺎ‬ ‫ﺍﻟﺪﻳﻦ‬ ‫ﻣﻦ‬ ‫ﻟﻬﻢ‬ ‫ﺷﺮﻋﻮﺍ‬ ‫ﺷﺮﻛﺂء‬ ‫ﻟﻬﻢ‬ ‫ﺃﻡ‬‫ﺍﻟﻴﻢ‬ ‫ﻋﺬﺍﺏ‬ ‫ﻟﻬﻢ‬ ‫ﺍﻟﻈﺎﻟﻤﻴﻦ‬ ‫ﺇﻥ‬ ‫ﻭ‬ ‫ﺑﻴﻨﻬﻢ‬ ‫ﻟﻘﻀﻰ‬“Or do they have partners for them legislating areligion that Allah did not give permission for atall. Had it not been for the word of decision anddecree, the matter between them would have beenjudged. And truly, for the oppressors is a torturouspunishment.”16Allah Ι also asked those who want to legislate oreven head for the false legislators,‫ﻟﻘﻮﻡ‬ ً‫ﺎ‬‫ﺣﻜﻤ‬ ‫ﺍﷲ‬ ‫ﺃﺣﺴﻦ‬ ‫ﻣﻦ‬ ‫ﻭ‬ ‫ﻳﺒﻐﻮﻥ‬ ‫ﺍﻟﺠﺎﻫﻠﻴﺔ‬ ‫ﺃﻓﺤﻜﻢ‬‫ﻳﻮﻗﻨﻮﻥ‬‘Is it the legislation of the Jaahiliyyah (Days ofIgnorance) that they seek? And who is better injudgement than Allah for a people who are certain?!’17ii. Denying the law of Allah Ι without renouncingthem. This is the equivalent of someone saying,16Surat ush-Shura, ayah 2117Surat ulMa’ida, ayah 50BE AWARE OF TAKFIR!“This particular law doesn’t suit this time period,but these other laws are still satisfactory.”‫ﻣﻨﻜﻢ‬ ‫ﺫﻟﻚ‬ ‫ﻳﻔﻌﻞ‬ ‫ﻣﻦ‬ ‫ﺟﺰﺍء‬ ‫ﻓﻤﺎ‬ ‫ﺑﺒﻌﺾ‬ ‫ﺗﻜﻔﺮﻭﻥ‬ ‫ﻭ‬ ‫ﺍﻟﻜﺘﺎﺏ‬ ‫ﺑﺒﻌﺾ‬ ‫ﻓﺘﺆﻣﻨﻮﻥ‬ ‫ﺃ‬‫ﺍﷲ‬ ‫ﻣﺎ‬ ‫ﻭ‬ ‫ﺍﻟﻌﺬﺍﺏ‬ ‫ﺃﺷﺪ‬ ‫ﺇﻟﻰ‬ ‫ﻳﺮﺩﻭﻥ‬ ‫ﺍﻟﻘﻴﺎﻣﺔ‬ ‫ﻳﻮﻡ‬ ‫ﻭ‬ ‫ﺍﻟﺪﻧﻴﺎ‬ ‫ﺍﻟﺤﻴﺎﺓ‬ ‫ﻓﻲ‬ ‫ﺧﺰﻯ‬ ‫ﺇﻻ‬‫ﺃﻭﻟﺌﻚ‬ ‫ﺗﻌﻤﻠﻮﻥ‬ ‫ﻋﻤﺎ‬ ‫ﺑﻐﺎﻓﻞ‬‫ﻋﻨﻬﻢ‬ ‫ﻳﺨﻔﻒ‬ ‫ﻓﻼ‬ ‫ﺑﺎﻵﺧﺮﺓ‬ ‫ﺍﻟﺪﻧﻴﺎ‬ ‫ﺍﻟﺤﻴﺎﺓ‬ ‫ﺍﺷﺘﺮﻭﺍ‬ ‫ﺍﻟﺬﻳﻦ‬‫ﻳﻨﺼﺮﻭﻥ‬ ‫ﻫﻢ‬ ‫ﻭﻻ‬ ‫ﺍﻟﻌﺬﺍﺏ‬“Is it you believe in a part of the book and youdisbelieve in another part?! Then what is the rewardfor the one who does that except disgrace in this lifeand on the Day of Judgement? They will be subjectedto a worse punishment and Allah is not unmindful ofwhat you do. They are those who have purchased thislife with the Hereafter. The punishment will not belightened for them nor will they have any help.” 18Essentially, this is disbelief in one law whilebelieving in another.iii. Denying the law of Allah Ι and renouncing them.This is when someone denies the law of Allahand fails to judge by what Allah sent down all ofthe time.This third type of Istibdaal is played out in the verseswhere Allah Ι says,18Surat ulBaqara, ayaat 85-86

BE AWARE OF TAKFIR!‫ﺍﻟﻜﺎﻓﺮﻭﻥ‬ ‫ﻫﻢ‬ ‫ﻓﺄﻟﺌﻚ‬ ‫ﺍﷲ‬ ‫ﺃﻧﺰﻝ‬ ‫ﺑﻤﺎ‬ ‫ﻳﺤﻜﻢ‬ ‫ﻟﻢ‬ ‫ﻣﻦ‬ ‫ﻭ‬“And whoever does not judge by what Allah sent down,then they are Kaafirun (unbelievers).”‫ﺍﻟﻈﺎﻟﻤﻮﻥ‬ ‫ﻫﻢ‬ ‫ﻓﺄﻟﺌﻚ‬ ‫ﺍﷲ‬ ‫ﺃﻧﺰﻝ‬ ‫ﺑﻤﺎ‬ ‫ﻳﺤﻜﻢ‬ ‫ﻟﻢ‬ ‫ﻣﻦ‬ ‫ﻭ‬“And whoever does not judge by what Allah sent down,then they are Zaalimun (oppressors).”‫ﺍﻟﻔﺎﺳﻘﻮﻥ‬ ‫ﻫﻢ‬ ‫ﻓﺄﻟﺌﻚ‬ ‫ﺍﷲ‬ ‫ﺃﻧﺰﻝ‬ ‫ﺑﻤﺎ‬ ‫ﻳﺤﻜﻢ‬ ‫ﻟﻢ‬ ‫ﻣﻦ‬ ‫ﻭ‬“And whoever does not judge by what Allah sent down,then they are Faasiqun (rebellious sinners).”19Looking at the evidence in front of us, if someone isruling by the Shari`a and he should refuse to hand out aShari`a punishment in one instance due to the fact thatthe guilty party is his close friend, family member, etc.,this is what we call the kufr duna kufr (a kufr less thankufr), a minor kufr.But when the person actually changes the rule, not justfor that one person, but for all times to come, this is amajor kufr. But if he goes and even invents a stipulationin the existing Shari`a law, this is a kufr fawqa kufr(kufr above kufr), a major kufr without doubt.‫ﺍﻟﻜﺎﻓﺮﻭﻥ‬ ‫ﻫﻢ‬ ‫ﻓﺄﻟﺌﻚ‬ ‫ﺍﷲ‬ ‫ﺃﻧﺰﻝ‬ ‫ﺑﻤﺎ‬ ‫ﻳﺤﻜﻢ‬ ‫ﻟﻢ‬ ‫ﻣﻦ‬ ‫ﻭ‬19These verses are located in Surat ulMa’ida, ayaat 44-47BE AWARE OF TAKFIR!“And whoever does not judge by what Allah sent down,then they are Kaafirun (unbelievers).”20This is the completely naked and obvious kufr that isobnoxious and grotesque. This disregard for the Shari`aearns nothing but the wrath of Allah Ι, and it should besomething that the sincere believers stay far away from.20Surat ulMa’ida, ayah 44

BE AWARE OF TAKFIR!WHAT IS TAKFIR AND WHAT ARE THETYPES?Now that the believers have the proper explanation ofwhat kufr is, then it becomes necessary to study whenexactly does it become the case that one can be giventhe title of kufr after his or her Islam. This is known astakfir. This matter is in all of the Books of Fiqh, but aswe will soon come to know, not everyone understandsthis principle.The main reason for the Khawaarij going astray andexaggerating in the matters of takfir was a direct resultof their blending the rules of takfir together, thus it wasall seen as one and the same. This major mistake mustbe answered and put straight, so the Ummah might notfall into confusion when we see these matters. In thissection, we will lay out the different types of takfirrelated to our topic, starting with the first one,1. TAKFIR UN-NASS (charge of kufr based on adecisive text). This is when there is a decisive textand after applying the rules of takfir, one levels thecharge of kufr. An example would be where Allah Ιhas said,‫ﺗﺐ‬ ‫ﻭ‬ ‫ﻟﻬﺐ‬ ‫ﺃﺑﻲ‬ ‫ﻳﺪﺍ‬ ‫ﺗﺒﺖ‬“The hands of Abu Lahab are destroyed and may he bedestroyed.”2121Surat ul-Lahab, ayah 1BE AWARE OF TAKFIR!It is clear from this text that Allah Ι has thus labelledAbu Lahab, one of the uncles of the Prophet ρ whohated Islam, without doubt to be a kaafir. If someoneshould come and say that Abu Lahab is not a kaafir, buta Muslim, then the charge of kufr (calling someone akaafir) can be leveled against this person. However, theimpediments and rules surrounding takfir should beexamined before coming to a ruling on the individual. Itmay be that he is a new Muslim and he doesn’t knowthis information. It may be he is insane or somethingelse of this nature. But the takfir should be given if theperson can not be excused from the rules of takfir andno one can deny that. This is not a takfir between twopeople, but it is between the person and Allah Ι sinceAllah Ι called Abu Lahab by name.2. TAKFIR ULIJTIHAAD (charge of kufr based onindividual judgement). This is when a particularverse or set of verses taken from the Qur’an state anaction to be kufr. An example of this would be whenAllah Ι said in his book,‫ﺍﻟﻜﺎﻓﺮﻭﻥ‬ ‫ﻫﻢ‬ ‫ﻓﺄﻭﻟﺌﻚ‬ ‫ﺍﷲ‬ ‫ﺃﻧﺰﻝ‬ ‫ﺑﻤﺎ‬ ‫ﻳﺤﻜﻢ‬ ‫ﻟﻢ‬ ‫ﻣﻦ‬ ‫ﻭ‬“Whoever doesn’t rule by what Allah sent down, thenthey are kaafirun (unbelievers).”2222Surat ulMa’ida, ayah 44
  10. 10. BE AWARE OF TAKFIR!This kufr is studied and understood. It is after all theverses related to the subject are studied carefully thatone could come to a judgement and say, ‘Any rulertoday who is not judging by what Allah sent down is akaafir.’ This type of takfir people could differ onbecause of some rules and regulations in regard to it. Itcould also have to do with the fact that there aredifferent grades of kufr with regard to the topic. Onegrade of kufr is that one who occasionally does notjudge by what Allah Ι sent down has not become akaafir, but he has indeed done a major sin, a kufr dunakufr (a kufr less than kufr) as reported in an authenticnarration by Ibn `Abbas τ. However, the one who makesa practice of it all the time has most certainly done kufrand is a kaafir according to another relation of Ibn`Abbas τ and that of Ibn Mas`ud τ.3. TAKFIR ALMU`AYYIN (charge of kufr wherethe individual is actually named). Themanifestation of this charge of kufr is where anactual person is named with the title of kufr.However, before this can happen, the takfir ofijtihaad must be exercised. If we relate this to thesame topic mentioned above regarding ruling bywhat Allah Ι sent down, namely being, “Whoeverdoes not judge by what Allah sent down, then he is akaafir,” the judgement in ijtihaad will of courseremain the same. If the ijtihaad has been made, and itis found that major kufr is involved, the next thing isthat it must be double- checked to make sure that theBE AWARE OF TAKFIR!verses from the Qur’an and the charge of kufr fits theperson.He (the one making the charge of takfir) then nextapplies it to a person, for example by saying, “PresidentQ or King Y is a kaafir because of this verse or theseverses, due to the fact that he is ruling by other thanwhat Allah sent down.” Due to the fact that mu`ayyin intakfir is arrived at by ijtihaad, there could be somedifference in it between one scholar and another. Anexample would be ta’wil (interpretation), where onescholar might pardon the individual under examinationfrom takfir due to lack of knowledge and understandingof the evidence on the part of the one under suspicion.Some will not pardon him, like in the case of the debatebetween Imaam ash-Shaafi`ii ‫ﺭﺣﻤﻪ‬‫ﺍﷲ‬ and Imaam Ahmad‫ﺭﺣﻤﻪ‬‫ﺍﷲ‬ , where Imaam Ahmad ‫ﺭﺣﻤﻪ‬‫ﺍﷲ‬ labelled the onewho leaves prayer in totality to be a kaafir. With thiskind of takfir, others may act on it and us it, butsometimes others might not exercise it and pardon theone in question.This type of difference of opinion in regards to takfir ofthe individual was explained by non other than ShaikhulIslam Ahmad ibn Taymiyyah,‘Takfir, it has conditions and also it has impediments.And it cannot be applied, these conditions, for a certainperson or the individual. And when we say generaltakfir, it does not mean we call an individual a kaafir,
  11. 11. BE AWARE OF TAKFIR!unless these conditions are there, and the impedimentsare not there any more.’ 234. TAKFIR TAA’IFAT ULKUFR (charge of takfirwhere a group is labelled with kufr). Allah Υ didnot leave this to our ijtihaad and this is a matter ofimaan and Kufr. Similar situations as these happenedin the time of the Messenger of Allah ρ. Whenpeople opposed the Islam and the Muslims, althoughthey were saying La ilaha Illallah, they were killed infront of the Messenger ρ, and their killing wasblessed by the Qur’an and endorsed by the Prophetρ. Now before we go into all of the evidences, wewould like to explain some principles in regard tothis topic. It should be known that Allah Ι has judgeda human being not just by himself, but by his group.We would like the brothers and sisters to understandthat Allah Ι has made for each person two rules withregard to his belief. One rule is the judgementconcerning him as an individual. Another rule isconcerning his group or the group who he or she isloyal to, moving about with, putting his energy intoand consuming his time with.These four categories of people mentioned are,1. A Muslim by himself and by his group as well.These are the people who do the five pillars and they23Majmu`a Fataawa, V. 12, page 487-489.BE AWARE OF TAKFIR!believe in Islam. They obey Islam according to theirability. They also work and are loyal to a guidedgroup. Examples are the Sahaaba ω from theimmigrants and the helpers, the Muslims asindividuals under the khilaafa (the Islamic governingbody) who were ruling by the Shari`a, even thoughthe Khalifa (Muslim ruler) might be doing someoppression. The Shari`a was still intact and the rightsof Muslims were preserved. Since 1924, after thedestruction of the khilaafa, the reality of thisexample has disappeared. All that is left now is thepeople that are doing Islam individually and thosestruggling and fighting to bring back the Shari`a.There are also those that help them, support themand help them, even if they can’t be with them asAllah Ι has said,‫ﻭﺳﻌﻬﺎ‬ ‫ﺇﻻ‬ ً‫ﺎ‬‫ﻧﻔﺴ‬ ‫ﺍﷲ‬ ‫ﻳﻜﻠﻒ‬ ‫ﻻ‬“Allah does not make a soul responsible except forwhat is according to its capacity.”242. A kaafir by himself and a kaafir by his group. Thelikes of these are the people who don’t do theapparent of the religion, either because they are theoriginal kuffar or they are apostates. Anotherexample also is a person that belongs to and defendsa kaafir or apostate group. An example is the24Surat ulBaqara, ayah 286
  12. 12. BE AWARE OF TAKFIR!Christians, Jews, fire-worshippers, deists, dualists,pantheists, atheists, agnostics and Masons in thearmies of Muslim countries. This is because we classthese armies as defenders of other than the IslamicShari`a.3. A kaafir by himself and a Muslim by his group.The like of whom would be a person who is showingIslam, but his heart has the kufr of hypocrisy. He ispart of a guided group that is supporting Allah Ι, HisMessenger and the believers. However, he deceivesthat group and is looking for chances to destroy itform the inside, all the while he has the apparent`ibaadah (worship). This is just to be saved and tocontinue on, like `Abdullah ibn Ubai ibn Sulul in thetime of the Messenger ρ and those like him. Theexamples of this in our time are the spies who workfor apostate governments and go to the front line tospy on the Mujaahidin. They also join study circlesand meetings. They are to be left to Allah Ι until Heexposes what they are doing then they can be dealtwith Islamically according to the evidence.4. A Muslim by himself and a kaafir by his group.This needs to be explained further, and if not handledappropriately, it can be abused. This abuse is a usualoccurrence with the Khawaarij, Takfiriyyah and theMurji’a. This situation is not new to the Ummah, asit existed in the time of the Messenger ρ and in thetime of the Sahaaba ω when incidents of apostasyBE AWARE OF TAKFIR!occurred. It occurred as well in the times of theTatars, when they entered the Muslim lands, and theMuslims were mixing with kuffar and vice versa. 25In fact, this is the situation of our Ummah right now.These kinds of Muslims might be good Muslims, as anindividual with regard to worship and obligations. Itcould even be the case that he is doing tahajjud at night,hajj and so forth. However, he supports whoever fightsthe Shari`a or those who are killing the believers andpreventing them from enjoining the good and forbiddingthe evil. He then gives his effort until a banner ofapostasy or original kufr is made manifest. Such was thetime of the Messenger ρ, when he took the believers tofight the people of Ta’if, who used to trade with Riba(usury) after their Islam. Once the Messenger ρprohibited them, they resorted to the sword and theyinsisted on dealing in riba, in addition to their Islam. Sothe Messenger ρ fought them for 21 days, surroundedthem and used the catapult to throw stones, fire andsnakes at them, including their women, children, elderlyand disabled as he could not see who was who and thewar must go on. They were all dealt with as a group ofkufr, although they used to pray, fast, and do the rest ofthe apparent signs of Islam.This is also what the Qur’an has revealed concerning theMuslims who used to live among the kuffar of the-Durar us-adir can be found in the work,These classifications of takf25, beginning with the chapter, Hukm ulMurtadd, as well9.VSunniyyah,as vols. 10-11, which discuss the situation at length.

When the Quraish were preparing for the battleof Badr, they forced the Muslims that did not makehijrah to come amongst them, just to swell their numbersto scare the Sahaaba ω and the other believers awayfrom the battle. These people who were coercedincluded al`Abbas τ, the uncle of the Prophet ρ. Addingto that, the Messenger ρ told the sahaaba as mentionedin Sahih Muslim, that there are some members of BaniHaashim that will be joining the kaafir forces and theyare being forced to do so. He urged the Sahaaba τ if theysee any of the Bani Haashim that they don’t kill thembecause they were forced.Then one sahaabi from the Ansaar said, “O, We aregoing to kill our families and leave our enemies and notkill them.” The Messenger ρ replied, “Would you likethe face of my uncle al `Abbas to be slapped?” Then`Umar τ asked for the Messenger’s ρ permission topunish the sahaabi who made such a comment. All ofthis would change during the war. When the battlebegan, some arrows from the Prophet’s ρ side tore intothe necks and hearts of Muslims who came amongst thepeople of the Quraish. The Muhaajirun ω (Emigrants)and the Ansaar (Helpers) ω at that point were terrifiedand shouted, “We have killed our brothers.” Allah Ιthen sent down these verses,‫ﻛﻨﺎ‬ ‫ﻗﺎﻟﻮﺍ‬ ‫ﻛﻨﺘﻢ‬ ‫ﻓﻴﻢ‬ ‫ﻗﺎﻟﻮﺍ‬ ‫ﺃﻧﻔﺴﻬﻢ‬ ‫ﻇﺎﻟﻤﻲ‬ ‫ﺍﻟﻤﻼﺋﻜﺔ‬ ‫ﺗﻮﻓﻔﺎﻫﻢ‬ ‫ﺍﻟﺬﻳﻦ‬ ‫ﺇﻥ‬‫ﻓﺘﻬﺎﺟ‬ ‫ﻭﺍﺳﻌﺔ‬ ‫ﺍﷲ‬ ‫ﺃﺭﺽ‬ ‫ﺗﻜﻦ‬ ‫ﺃﻟﻢ‬ ‫ﻗﺎﻟﻮﺍ‬ ‫ﺍﻷﺭﺽ‬ ‫ﻓﻲ‬ ‫ﻣﺴﺘﻀﻌﻔﻴﻦ‬‫ﻓﻴﻬﺎ‬ ‫ﺮﻭﺍ‬BE AWARE OF TAKFIR!‫ﻭ‬ ‫ﺍﻟﺮﺟﺎﻝ‬ ‫ﻣﻦ‬ ‫ﺍﻟﻤﺴﺘﻀﻌﻔﻴﻦ‬ ‫ﺇﻻ‬ ً‫ﺍ‬‫ﻣﺼﻴﺮ‬ ‫ﺳﺎءﺕ‬ ‫ﻭ‬ ‫ﺟﻬﻨﻢ‬ ‫ﻣﺄﻭﺍﻫﻢ‬ ‫ﻓﺄﻭﻟﺌﻚ‬ً‫ﻼ‬‫ﺳﺒﻴ‬ ‫ﻳﻬﺘﺪﻭﻥ‬ ‫ﻻ‬ ‫ﻭ‬ ‫ﺣﻴﻠﺔ‬ ‫ﻳﺴﺘﻄﻴﻌﻮﻥ‬ ‫ﻻ‬ ‫ﺍﻟﻮﻟﺪﺍﻥ‬ ‫ﻭ‬ ‫ﺍﻟﻨﺴﺎء‬“Those whom the angels take in death while they wereoppressing themselves, they will say, ‘What state wereyou in?’ They will say, ‘We were weak and oppressedin the earth.’ They will say, ‘Was not the earth of Allahspacious enough for you to make emigration in?’Their destination is the Hell fire and what an evil end.Except the truly weak and oppressed from the men andwomen and the one not able to devise a plan or find away.”2627Allah Ι then exempted the weak and disabled and theirlike from going into the fire if they don’t emigrate. Butin this story, there is something else to endorse theimportance of judging the group of kufr and dealingwith them. That is the strong words of the Messenger ρto his uncle al `Abbas τ, when he was insisting to theMessenger ρ that he was Muslim to exempt him frompaying the ransom for himself and his nephew. TheMessenger ρ said,“Leave that argument aside. You came with a groupfighting and you are going to be dealt with as a groupthat fought. Then Allah Υ revealed with regard tothat,ً‫ﺍ‬‫ﺧﻴﺮ‬ ‫ﻗﻠﻮﺑﻬﻢ‬ ‫ﻓﻲ‬ ‫ﺍﷲ‬ ‫ﻳﻌﻠﻢ‬ ‫ﺇﻥ‬ ‫ﺍﻻﺳﺮﻯ‬ ‫ﻣﻦ‬ ‫ﺍﻳﺪﻳﻜﻢ‬ ‫ﻓﻲ‬ ‫ﻟﻤﻦ‬ ‫ﻗﻞ‬ ‫ﺍﻟﻨﺒﻲ‬ ‫ﺍﻳﻬﺎ‬ ‫ﻳﺎ‬‫ﺭﺣﻴﻢ‬ ‫ﻏﻔﻮﺭ‬ ‫ﺍﷲ‬ ‫ﻭ‬ ‫ﻟﻜﻢ‬ ‫ﻳﻐﻔﺮ‬ ‫ﻭ‬ ‫ﻣﻨﻜﻢ‬ ‫ﺃﺧﺬ‬ ‫ﻣﻤﺎ‬ ً‫ﺍ‬‫ﺧﻴﺮ‬ ‫ﻳﺆﺗﻜﻢ‬“O Prophet! Say to whoever is in your hands, ‘If Allahknows any good in your hearts, He will give yousomething better than what was taken from you andHe will forgive you. So fight the friends and allies of the Shaitan.Truly the plan of Shaitan is weak.”31This ayah has three main rules with regard to the group,1. Those who fight in the cause of Allah Ι, they are ingeneral believers, even though there may behypocrites among them, they are still believers.2. Those who are fighting for the benefit of anopponent to Allah Ι, or other than the ideology ofIslam. They are a group of kufr, even if they haveamongst them people who are not kuffar. As a group,they are still all a group of kufr, according to theapparent.3. What position ***we should we take with regard tothese groups. Allah Ι shows which group we shouldbe linked with and which group we should fight.Allah Ι also orders us to fight the group according tothe apparent and the fight must go on.It is then clear that Allah Ι makes the reason to call agroup as kufr or imaan is the motive of what the group is31Surat un-Nisaa’, ayah 76

The other group is the group of kufr, in whichits motive is to fight in the cause of taghut. Taghut iswhatever and whoever people are using to judgeamongst themselves other than Allah Ι and are known asa group of kufr without doubt. This isclearly the methodology of Ahl us-Sunna walJama`ahand what is the balance between the two extremes.***And example of this balance is the verdict of Al`Allamah Shaikh Muhammad ibn Ibrahim Aala Shaikh(RH), who said in this regard to the takfir of a group,“The third division is the thing that involves innerthoughts. So this does not cause a person to apostate,until the proofs have been established upon him.Regardless of whether it is in the foundations of thesecondary matters. So we know from this that there isno takfir upon anyone except, the establishment ofproof upon him. (There is no takfir, upon anyone,except, with the establishment of proof upon him). Sothe division is apparent, and the second is in it’s place.In this case not the third. Then there are two thingshere, the ruling upon the thing that is disbelief, and theruling upon the person specifically, is a separate

BE AWARE OF TAKFIR!matter…Then there is the TAKFIR OF A GROUP, suchas the Jahmiyyah, which is another thing,” 33Thus in the takfir of the group, it is not the methodologyof Ahl us-Sunna to make takfir on each and every one inthat group, be they an army, as we mentioned above, orthose that belong to a deviant group, like the Jahmiyyah,as mentioned by the Shaikh. It may be that there arethose who are coerced; others are fussaaq (rebellioussinning Muslims), who want to make benefit. Therecould even be good believers, but believers hiding insideto help Muslims from the inside, such as KhaalidalIslaambuli ‫ﺍﷲ‬ ‫ﺭﺣﻤ“ﻪ‬ in the Egyptian military34or the onefrom the family of the Pharaoh mentioned below,‫ﺭﺑﻲ‬ ‫ﻳﻘﻮﻝ‬ ‫ﺃﻥ‬ ً‫ﻼ‬‫ﺭﺟ‬ ‫ﺃﺗﻘﺘﻠﻮﻥ‬ ‫ﺇﻳﻤﺎﻧﻪ‬ ‫ﻳﻜﺘﻢ‬ ‫ﻓﺮﻋﻮﻥ‬ ‫ﺁﻝ‬ ‫ﻣﻦ‬ ‫ﻣﺆﻣﻦ‬ ‫ﺭﺟﻞ‬ ‫ﻗﺎﻝ‬ ‫ﻭ‬‫ﺭﺑﻜﻢ‬ ‫ﻣﻦ‬ ‫ﺑﺎﻟﺒﻴﻨﺎﺕ‬ ‫ﻛﻢ‬ ‫ﺟﺎء‬ ‫ﻗﺪ‬ ‫ﻭ‬ ‫ﺍﷲ‬33Majmu`a Fataawa Shaikh Muhammad ibn Ibrahim Aala Shaikh (RH),V. 12, page 190-191. In the reign of Muhammad Ahmad Anwar as-Sadaat,the president of Egypt, Khaalid ‫ﺍﷲ‬ ‫ﺭﺣﻤ“ﻪ‬ was in the military. He slowlyworked his way up through the ranks, and not too long after his brotherwas jailed by the regime for speaking the truth, Khaalid ‫ﺍﷲ‬ ‫“ﻪ‬“‫ﺭﺣﻤ‬assassinated Sadaat on October 6, 1981. This heroic act was carried outon television and Khaalid ‫ﺍﷲ‬ ‫ﺭﺣﻤ“ﻪ‬ showed the entire world that enjoiningthe right and forbidding the wrong is still best carried out with the hand.Brother Khaalid ‫ﺍﷲ‬ ‫ﺭﺣﻤ“ﻪ‬ was later tried by the regime and murdered incold blood for the dirty throne of Mubaarak.BE AWARE OF TAKFIR!“And a believing man from the family of the Pharaoh,who hid his imaan (faith) said, ‘Would you kill a manbecause he says, My Lord is Allah, and he has come toyou with clear signs from his Lord.’ ”35These rare elements don’t change the judgement of thisgroup as a group of kufr. Allah Ι did not change thejudgement for the family of Pharaoh because some ofthem were defending Musa υ. So we can understand thatit is a group of kufr fighting the Muslims andMujaahidin in the cause of the taghut. These enemiesmust be fought harshly and sternly until they come backto the fold of Islam and the Shari`a of Islam. It must notrule in any matters with other than Islam, small or great.Although we don’t call every individual in this group akaafir or an apostate, we can call the high leaders of thisgroup that make decisions Tawaaghit (false legislators).However, in reference to our population in the Muslimcountries, they are weak and helpless Muslims and mostof them love Allah Ι, the Messenger ρ and the Shari`a.3635Surah Ghaafir, ayah 2836This is an important point, due to the fact that the Takfiriyyah preferthe practice of declaring all or most of the populations of today’s Muslimcountries to be hypocrites and/or kuffar. These people should then askthemselves why are they calling for people to liberate the lands if they arefilled with kuffar. Liberating these lands defeats the purpose if you aregoing to liberate apostates, which have to be killed anyway. These ideasjust show that the most jaahil and deceitful of Muslims can wieldauthority and hold captive an audience anytime the speech is madeentertaining.
  17. 17. BE AWARE OF TAKFIR!From all that is above, we can understand that this iswhat happened for all those who were not carryingweapons and fighting Muslims. Now the situation whichpeople are confused about now is this one. There arethose people who are employed full time in the military,carrying the most sophisticated weapons against theirweak and helpless brothers, most often capturing theirwives and relatives to force them to hand overthemselves to the Mushrikun. These Mushrikun(pagans) of course are legislating other than the Shari`aof Allah Υ. Let us also understand the nature of ourarmy, which is purely secular and anti-Islamic. It alsoconsists of:1. Some Muslims2. Jews and Christians3. Reverts from Islam or any other religion4. Freemasons as well as freemasonry5. Ruthless hired militia and most of the time they haveno war with the Jews and Christians and haveentered into indefinite treaties with them. Now theirenemies are genuine Islamic movements, whichmakes them the real Khawaarij described in thehadith of Muslim and Bukhaari regarding those whokill the Muslims and spare the Mushrikun (pagans).BE AWARE OF TAKFIR!WHAT ARE THE IMPEDIMENTS OF TAKFIR?Some of the rules misused by the Khawaarij and theTakfiri people led to their misguidance, as well as theothers. What was their most fatal mistake is when theymistook Takfir alMu`ayyin (takfir on a particularperson), Takfir UlIjtihaad (takfir based uponindependent judgement) and Takfir un-Nass (takfirbased on the text) and blended them into one thing. Therule of Takfir un-Nass (Takfir in which a clear text ismentioned) is a very great principle of Ahl us-SunnawalJama`ah and is in all of the books of Ahl us-SunnawalJama`ah, in addition to Shaikh ulIslam Muhammadibn `Abdul Wahhaab’s ‫ﺍﷲ‬ ‫“ﻪ‬“‫ﺭﺣﻤ‬ “Nawaaqid ulIslam”(What violates Islam). This rule states, “Anyone whodoesn’t declare the disbelief of the Mushrikun(pagans) or he doubts of their kufr or the truth of theirthinking, it is Kufr.”These people abused this rule blatantly and with malice.This was taken to mean that anyone who refused todeclare kaafir who they THOUGHT was a kaafir is akaafir. This case was born out when the Khawaarijdeclared `Ali τ and Mu`awiya τ kaafir and declared`Amr ibn al `As τ a kaafir for not declaring those two tobe kuffar. This thinking is an extreme view and does notreflect the core belief of Ahl us-Sunna walJama`ah.The authentic understanding of this rule is that anyonewho knows those who the Qur’an and Sunna hasreferred to as kuffar (i.e. Jews, Christians and

This same rule applies with those who declareto be Islamic such people as the Pharaoh, Abu Lahab,Jews, Christians as well as other religions after theProphet ρ.This is not the same as the one whose kufr is unknownto you, and a charge of kufr is made against him. No onemay come to another Muslim and force him to labelothers as kuffar if he either has no proof or he does notknow the proof of the kufr of those mentioned. EvenMuhammad ibn `Abdul Wahhaab ‫ﺍﷲ‬ ‫ﺭﺣﻤ““ﻪ‬ and thescholars previous to him, when they called the act kufr,every person that did the act was not declared kaafir. Toapply kufr to a specific person, which is called TakfirulMu`ayyin that has to go through specific rules andregulations according to Ahl us-Sunna walJama`ah. Forexample, when the sahaaba τ asked the Prophet ρ tomake the Dhat Anwaat, he did not call them kuffar, buthe said this is equivalent to asking for a god other thanAllah Υ.37Although it was an act of kufr andblasphemy, they were not declared kuffar. TheProphet ρ said, “What is this, O Mu`aadh?” He said, “Icame from Shaam and I observed them doing so, so Iloved for myself that we should do so to you.” Then theMessenger of Allah ρ said, “Do not do that. Truly, if Iwere to order anyone that he should to other thanAllah, I would have ordered that the wife prostrate toher husband. By the one in whose hand is the life ofMuhammad, the woman does not love the right of herLord, until she loves the right of her husband, even ifhe asks for her and she is at the oven cooking.”38 3938Sunan Ibn Maajah, Kitaab un-Nikaah, hadith 1843, classified sahih.39Mu`aadh τ had been to the Shaam and had seen the people bowing outof respect to their bishops and their priests. Naturally, he figured, why notshow this same type of respect to the Prophet ρ. This prostration was thusnot one of worship, but one of respect. This is the same for the parents ofYusuf υ, who along with his brothers prostrated to the prophet υ out ofrespect. Of course, any one who prostrates to someone with the intentionof worship of that person, of course this is major shirk and kufr withoutany excuse. But there is a difference to doing something from innovationand out of ignorance and doing something with intent of worship due toother than Allah Ι.
  19. 19. BE AWARE OF TAKFIR!To distinguish in this area is paramount to understandingthis great principle of Ahl us-Sunna walJama`ah. If thereis someone who is making du`a (supplication) to Allah Ιat a graveyard because he believes it is a holy place, thisis haraam and bid`a (innovation), but he does not leaveout of the religion. But if this same person is makingdu`aa to the people inside of the graves, then this ismajor kufr with no excuse for it whatsoever. Prostratingat an area or making du`a at an area because he believesit is a holy area, again this is haraam and bid`a. But ifthe one mentioned is prostrating or supplicating to thoseat that locale, again this is major kufr.The same is true when someone says a blasphemybecause he is ignorant or has made a mistake. This oneis not classed as a kaafir and out of the religion. On the ridingBE AWARE OF TAKFIR!animal is his food, drink, so then he said from extremepleasure, ‘O Allah, you are my slave and I am yourLord!’ out of a mistake from the severity of his joy.”40To say that Allah Ι is your slave and that you are HisLord is a statement of kufr, yet the man did not leave outof the religion. Why? It is because he had a slip of thetongue. This is what is known in Islam as kufr alAkhtaa’ (the kufr of mistake). Someone can say this intimes of extreme grief, in times of extreme joy and intimes of extreme anger. At these times, for saying such athing, the individual should not be precluded from thereligion and counted as a kaafir.From these and many other evidences, the scholars ofIslam have distinguished between labelling the act asan act of kufr and labeling the one who does it as akaafir. Another evidence is the hadith of the Prophet ρabout a person who was flogged after the third or thefourth time because of his alcoholism. Then one sahaabicursed him. The Prophet ρ prohibited him from doingso, and said to him τ, “Don’t call him that. He doeslove Allah and His Messenger.”41Although the ProphetΙ cursed ten activities with regard to intoxicants ingeneral, he did not allow a person who does this activityto be cursed specifically. This is because Ahl us-SunnawalJama`ah does the opposite of the Khawaarij, whoconsider everyone kaafir (even a Muslim) until they (thepeople being called kuffar) prove otherwise. Weconsider everyone who says they are Muslim as suchuntil we have reason to believe otherwise. This is inaccordance with what Allah Ι and His Messenger ρ hassaid. Therefore the scholars of Ahl us-SunnawalJama`ah are agreed upon the following impediments:1. The action for calling him a kaafir must beundoubtedly kufr; not what people think is kufr.2. The person must be sane.3. The person must have knowledge or access toknowledge about the action that he does.4. The person must have done this action deliberately5. The person is not to be sleepingBE AWARE OF TAKFIR!6. The person chose to do the act with free will, withoutcompulsion, and also he should not be the opposite of allthe above.7. Also, the person should not have a differentinterpretation, which would cause him to do the actionthinking that he is pleasing Allah Ι. It is particularlyimportant to make this point, due to the fact that thepeople doing it are interpreting. Ahl us-SunnawalJama`ah does not make takfir on them, even thoughthe act is kufr. The reason for this is that many of themare ignorant or misled by evil scholars away from thecorrect interpretation. Some of their leaders/scholarseven lie about the Prophet ρ in giving these people theirinterpretation.This is precisely why Muhammad ibn `Abdul Wahhaab‫ﺍﷲ‬ ‫,ﺭﺣﻤ“ﻪ‬ who reestablished this rule in our time, did notlabel the people who used to make supplication to Allahat a place called Qublat alKawwaaz as kuffar. He waskeen to this situation and he changed it, because manyof the evil scholars of his time invented hadith toconvince people that such a bid`a is halaal.Shaikh ulIslam Ibn Taymiyyah ‫ﺍﷲ‬ ‫ﺭﺣﻤﻪ‬ mentioned aboutthe impediments and conditions of takfir,‘Takfir, it has conditions and also it has impediments.And it cannot be applied, these conditions, for a certainperson or the individual. And when we say generaltakfir, it does not mean we call an individual a kaafir,

The action is without any doubt kufr.2. The person has their sanity and is well within hissenses.3. He knows the action he did and is completely awareof it.4. He does the action purposefully, not on accident.5. The person is awake and not sleeping.6. The person does so, not under any coercionwhatsoever.7. BE AWARE OF TAKFIR!In recent times, believers have become even moreconfused, as some groups of scholars and some regimeshave declared democracy and Islam to be synonymous.The believers have hesitantly obeyed those in authorityand have casted their votes at the ballot box, with evensome of them entering into the parliaments, believingthat they are enjoining the right and forbidding thewrong.Those among the Murji’a (extremely dangerous peoplewho tamper with the laws of Islam and try to erase themor explain them away) have rejoiced at this opportunityand have come with their mouths open to drink from thecurdled milk of shirk that is being fed to them by the wetnurses of democracy. Those from among theTakfiriyyah (takfiri groups) have thrown a party,declaring the voters as well as those entering theparliament to be kuffar. This has resulted in takfir on theIndonesian people, as well as just about any otherconfused Muslim who may have cast his ballot for anMP or any other governmental representative. Whatneeds to be put in perspective is the balance betweenthese two incorrect groups based on the understandingof Ahl us-Sunna walJama`ah. This is necessary due tothe fact the voter does not receive the exact samejudgement as a ruler in certain regards, so this needsprecision and elaboration. We will then split this intotwo matters,a. What is the judgement on the one who enters theparliament?BE AWARE OF TAKFIR!b. What is the judgement on the one who is a voter orwho is thinking of voting?THE RULING REGARDING THE ONE WHOENTERS THE PARLIAMENTThe issues regarding those who enter the parliament areone of the biggest controversies of our time and it isbecoming a more heated debate with each passing day.This matter comes to us in light of the fact that in thistime period there is no khilaafa and that the Muslims areno longer ruling the world with dominance. What hashappened is that democracy and the kufr that surroundsit have become as inconspicuous as a black ant crawlingon a black rock in the blackness of night.When the Muslim lands were set upon in earnest in thetime of Al `Allamah Muhammad ibn Ibrahim and Al
  23. 23. BE AWARE OF TAKFIR!`Allamah Ahmad Shaakir ‫ﺍﷲ‬ ‫,ﺭﺣﻤﻬﻤ“ﺎ‬ the legislation ofother systems and parliaments were set up andestablished it over the heads of the Muslims. These twoscholars responded harshly to this and fought againstthese systems with all of the might that they had. Thosein the execution of kufr and those hindering the way ofAllah Ι were ***labelled to be a group of kufr.However, not every single one of them is doing the kufrthat removes one from the religion. They hold the samejudgement as a group of kufr and they are called Mala’(chiefs of the people). This is mentioned in the Qur’anand we have made ample reference to it previously. Thisis what they are called whether they like it or not.When Allah Ι mentions the Pharaoh and the Mala’, itwas the ministers, senators and the people of parliamenthe was making reference to ***these ayaat. Evenshaikhs and knowledgeable people, when they go to theparliament, they are part of the scenario. They are eithertraitors, or their knowledge is not that sound when itcomes to tawhid. As we see in many countries, peoplewho have immense knowledge about hadith, fiqh, thepeople that narrate, when it comes to the `aqidah, theyare Ash`ari46, extreme Sufiyyah (Sufis)47or kuffar. This46This group denies the names and attributes of Allah Ι, in addition to thecorruption of other aspects of the religion.47This group innovates things into Islam such as claiming knowledge ofthe unseen, practices of prayer not practiced by the Prophet ρ, in additionto claims that some of them (the sufi shaikhs) are divine or have divineBE AWARE OF TAKFIR!just proves being a genius in one part of knowledge doesnot cause you to earn another type of knowledge.It is shocking enough to learn that even in alAzhar, theyteach the Ash`ari madhhab, which is deviant in beliefwith regards to the names and attributes of Allah Ι. Thisgroup has also gone astray in many other ways ofteaching, and they have presented deviant knowledge asthe knowledge of Ahl us-Sunna, which is a clearfalsehood. Adding to that, most of these establishments(i.e. Umm ulQurraa’, Muhammad ibn Sa`ud University,Madinah University, al Azhar, etc), if not all, are just thePharoah’s establishment, which most often just give thedegrees to those loyal to the Pharaoh, as is happening inSaudi, Egypt, Morocco and so on.Thus the whole of the parliament is a group of kufr, butnot everyone in the parliament is a kaafir. Thus,1. There are those who believe in democracy as asource of legislation or an allowable legislation or theymight not believe in it, but they legislate with it. Thesepeople are kuffar, no matter what other things they do. Itdoes not matter how much worship they do or howmany times they go on hajj, they cannot come an inchcloser to Islam because of this action. Allah Ι hasdenounced their belief just by their existence in theattributes. This group, as well as the previously mentioned one, is havinga resurgence now. This does not mean that each and every or all Sufis aredeviants, but the reference made is to those who have deviated from thestraight path.

BE AWARE OF TAKFIR!parliament, by them defending democracy and theirpropagating democracy.ً‫ﺎ‬‫ﺩﻳﻨ‬ ‫ﺍﻹﺳﻼﻡ‬ ‫ﻟﻜﻢ‬ ‫ﺭﺿﻴﺖ‬ ‫ﻭ‬ ‫ﻧﻌﻤﺘﻲ‬ ‫ﻋﻠﻴﻜﻢ‬ ‫ﺃﺗﻤﻤﺖ‬ ‫ﻭ‬ ‫ﺩﻳﻨﻜﻢ‬ ‫ﻟﻜﻢ‬ ‫ﺃﻛﻤﻠﺖ‬ ‫ﺍﻟﻴﻮﻡ‬“Today I have perfected your religion for you andcompleted on you My favour and I am pleased withIslam as your religion.”48And Allah Ι has also said,‫ﻳﻘ‬ ‫ﻓﻠﻦ‬ ً‫ﺎ‬‫ﺩﻳﻨ‬ ‫ﺍﻹﺳﻼﻡ‬ ‫ﻏﻴﺮ‬ ‫ﻳﺒﺘﻎ‬ ‫ﻣﻦ‬ ‫ﻭ‬‫ﺍﻟﺨﺎﺳﺮﻳﻦ‬ ‫ﻣﻦ‬ ‫ﺍﻵﺧﺮﺓ‬ ‫ﻓﻲ‬ ‫ﻫﻮ‬ ‫ﻭ‬ ‫ﻣﻨﻪ‬ ‫ﺒﻞ‬“And whoever chooses other than Islam as a religion,it will never be accepted from him and he will be fromamong the losers in the Hereafter.” 49We emphasise again that these people are kuffar andnot to be followed or accepted in any way, shape orform.2. The second are those who are tricked or had badinterpretation given to them or introduced bythemselves. They know democracy is kufr and notallowed in Islam, but they see it as a dangerous and ahazardous way to remove the Shari`a little by little,through legislation. These people then decide theywant to join the legislating panel without legislating so48Surat alMa’ida, ayah 349Surah Aali `Imraan, ayah 85BE AWARE OF TAKFIR!that they may stop any legislation that opposes theShari`a.What has happened is that these people were also givenor took on a certain type of ta’wil (interpretation). Theinterpretation that they understood is based on twoevidences. The first of those is the man who said to thePharaoh,‫ﺭﺟﻞ‬ ‫ﻗﺎﻝ‬ ‫ﻭ‬ ‫ﻳﻬﺪﻱ‬ ‫ﻻ‬ ‫ﺍﷲ‬ ‫ﺇﻥ‬ ‫ﻳﻌﺪﻛﻢ‬ ‫ﺍﻟﺬﻱ‬ ‫ﺑﻌﺾ‬ ‫ﻳﺼﺒﻜﻢ‬ ً‫ﺎ‬‫ﺻﺎﺩﻗ‬ ‫ﻳﻚ‬ ‫ﺃﻥ‬ ‫ﻭ‬‫ﻣﺆﻣﻦ‬‫ﺟﺎء‬ ‫ﻗﺪ‬ ‫ﻭ‬ ‫ﺍﷲ‬ ‫ﺭﺑﻲ‬ ‫ﻳﻘﻮﻝ‬ ‫ﺃﻥ‬ ً‫ﻼ‬‫ﺭﺟ‬ ‫ﺗﻘﺘﻠﻮﻥ‬ ‫ﺃ‬ ‫ﺇﻳﻤﺎﻧﻪ‬ ‫ﻳﻜﺘﻢ‬ ‫ﻓﺮﻋﻮﻥ‬ ‫ﺍﻝ‬ ‫ﻣﻦ‬‫ﻛﺬﺍﺏ‬ ‫ﻣﺴﺮﻑ‬ ‫ﻫﻮ‬ ‫ﻣﻦ‬ ‫ﻛﺬﺑﻪ‬ ‫ﻓﻌﻠﻴﻪ‬ ً‫ﺎ‬‫ﻛﺬﺍﺑ‬ ‫ﻳﻚ‬ ‫ﺇﻥ‬ ‫ﻭ‬ ‫ﺭﺑﻜﻢ‬ ‫ﻣﻦ‬ ‫ﺑﺎﻟﺒﻴﻨﺎﺕ‬ ‫ﻛﻢ‬“And a believing man from the family of the Pharaohwho hid his faith said, ‘Would you kill a man becausehe says, My Lord is Allah, and he has come to you withclear signs from your Lord? And if he is a liar, thenhis lie is upon him, and if he is truthful, then some ofthe disaster that he threatens you with will come toyou. Truly, Allah does not guide the one who is amusrif (transgressing pagan) and a liar.” 50Now let us try to understand this ayah. Here we have aman from the family of the Pharaoh enjoining the rightand forbidding the wrong, and he is sitting on the panelof the Pharaoh. On this panel were the Pharaoh, Hamaanand Qarun (Korah). The Pharaoh was obviously theruler and legislator, with Hamaan and Qarun beingministers in the government, thus being co-legislators.Even in spite of this fact, Allah Ι still called that50Surah Ghaafir, ayah 28
  25. 25. BE AWARE OF TAKFIR!believing man a believer, because the man was trying toenjoin the right and forbid the wrong and he wasn’tlegislating. But before he revealed his belief, he was in agroup a kufr on the outside. Then when the revelationcame, we knew that he was a believer. We use this ayahnot to say that those in the group of kufr are perfectbelievers, but we use this ayah to show that we cannotcall each and every individual in the parliament a kaafir,as the individual must be examined long before such acharge.The man was trying to block their legislation, which wasto kill Musa υ, as you can read in ayaat 24-26 in thesame Surah mentioned in the footnote. This believer wasdoing this while on the panel with the interpretation thathe could change things. This likeness would seem thesame for the one that enters the parliament and hedoesn’t legislate. He seems to be doing the exact samething as the believing man, although the believing manwas the cousin of the Pharaoh. The one in the parliamentis sitting on a panel of legislators and he is trying toblock the haraam legislation.This is why as believers, we try to use the benefit of thedoubt before we jump and give a judgement. Let us notforget that Allah Ι called this person, one who hides hisbelief, a believer. What of those who announce that theyare believers and democracy is kufr, and are trying toblock the kufr in legislation? Shouldn’t they receivemore of a benefit of the doubt, although we disagreewith the method and we also don’t believe jihaad shouldBE AWARE OF TAKFIR!be delayed for one second because of the benefit of thedoubt that we are giving them. This is precisely due tothe fact that we know that their methodology is a deadend and orders for the Mujaahidin to stop the fitnah as inthe methodology of jihaad is decisive, clear and provento be authentic.The next issue that they quote is an incident where whenbefore he was commissioned with prophethood,Muhammad ρ concluded a treaty with all of the kuffarwhere there would be no aggression or wrong doingagainst anyone. This was shortly after the Prophet ρ hadhelped them put the Black Stone back in the Ka`aba.This treaty was called Half ulFudul (The alliance ofProsperity).51After he was commissioned by Allah Ι tobe a prophet, Muhammad ρ continued on with the51But these people should not be in charge of any fighting force, whilethey are in the parliament. This is because the blood of the Mujaahidinand the principle of jihaad should not be in the hands of traitors or fools.If we give them the benefit of the doubt, that does not mean that weaccept them as leaders of the believers. We will tell them that the rightplace for them is to join the Mujaahidin. What happened in Algeria whenthe army leaders of the FIS who were negotiating with government is avery good example to show us that when you have lost the war, you havelost whatever gains you were going to make, and not one single kaafirlaw was taken back. The so-called Islamic army of the FIS handed itselfover to be sorted by the government of that land for no Islamic reasonwhatsoever. It is a major sin for any fighter to take notice of thosenegotiating in the parliament. It is a different war altogether.

BE AWARE OF TAKFIR!treaty, saying, “I was a part of an alliance, which Iwould not like to exchange for anything now.”52Although this alliance was with no one but kuffar,because the outcome of it and the reason for thegathering was not contradictory to Islam, this is why theMessenger ρ endorsed it even after he was givenprophethood. However, that is another interpretation,which is used by those who enter the parliament anddisbelieve in democracy trying to match some outcomesthat came from the treaty of the Prophet ρ. If thisalliance was an act of kufr, or sitting with kuffar tojudge on anything is an act of kufr, then the Messengerρ would not have sat with them ρ. This is because allprophets are infallible from all forms of kufr and shirk,ever since they were born. So from this, we can gatherthat sitting with the kuffar to decide on a matter is not inand of itself kufr unless it collides with the Shari`a.Some of those who are trying to come to a decision arejoining to divert the discussion towards the Shari`a. Werepeat that we do not agree with this, but it is a validinterpretation to stop the foolish and crude verdictagainst them that they are kuffar through and throughwithout exception.Another way for the benefit of doubt in the matter ofthose interpreting is that they will argue that they arejoining the parliament to tell the government that they52Check the books of Sirah by Ibn Hishaam, Ibn Kathir, Ibn Ishaaq andothers.BE AWARE OF TAKFIR!represent the majority of people. And since thegovernment is saying that the people, living in ademocracy, should be able to determine things forthemselves, they (the people entering the parliament)will only say to the government only what the peoplewant and the people want nothing but the Shari`a. Thosewho enter the parliament are people who want the ruleto be just for Allah Ι. These people are attempting toembarras kufr by using their own medicine againstthem.This was the case in Algeria, when the people weregiven a vote. And when they voted to bring in theShari`a and demolish democracy, the false legislatorswere incensed. However, the election didn’t work, eventhough 98% of the people asked for Shari`a. Allah Ι hastold us that the only way He (Allah Ι) wants us tochange the fitnah is by fighting, not compromising.To emphasis the point, these people truly figure thatthey will enter, not make any laws, but whenever anynew kufr legislation comes, they oppose it and veto itdown. Although the aim is praiseworthy, it is a bigharaam and major sin that they are doing.And sometimes that haraam could also be kufr, althoughit starts with good intention. This is the case especiallywhen the people who enter the parliament enjoy anyprivilege from joining these institutions, like receivingwages, or being given political immunity. The positionthey earn through this political immunity/protection in
  27. 27. BE AWARE OF TAKFIR!the parliament could be major haraam or major kufr.The reason is that it could be seen as a way of allyingyourselves to the kuffar. Allah Ι said,‫ﺑﻬﺎ‬ ‫ﻳﺴﺘﻬﺰﺃ‬ ‫ﻭ‬ ‫ﺑﻬﺎ‬ ‫ﻳﻜﻔﺮ‬ ‫ﺍﷲ‬ ‫ﺁﻳﺎﺕ‬ ‫ﺳﻤﻌﺘﻢ‬ ‫ﺇﺫﺍ‬ ‫ﺃﻥ‬ ‫ﺍﻟﻜﺘﺎﺏ‬ ‫ﻓﻲ‬ ‫ﻋﻠﻴﻜﻢ‬ ‫ﻧﺰﻝ‬ ‫ﻗﺪ‬ ‫ﻭ‬‫ﺟﺎﻣﻊ‬ ‫ﺍﷲ‬ ‫ﺇﻥ‬ ‫ﻣﺜﻠﻬﻢ‬ ‫ﺇﺫﺍ‬ ‫ﺇﻧﻜﻢ‬ ‫ﻏﻴﺮﻩ‬ ‫ﺣﺪﻳﺚ‬ ‫ﻓﻲ‬ ‫ﻳﺨﻮﺿﻮﺍ‬ ‫ﺣﺘﻰ‬ ‫ﻣﻌﻬﻢ‬ ‫ﻧﻘﻌﺪﻭﺍ‬ ‫ﻓﻼ‬ً‫ﺎ‬‫ﺟﻤﻴﻌ‬ ‫ﺟﻬﻨﻢ‬ ‫ﻓﻲ‬ ‫ﻭﺍﻟﻜﺎﻓﺮﻳﻦ‬ ‫ﺍﻟﻤﻨﺎﻓﻘﻴﻦ‬“And it was already revealed to you in the Book thatwhen you hear the signs of Allah being disbelieved inor mocked at, then you are not to sit with them untilthey change the subject to other than that. Otherwise,you are like them. Truly, Allah will gather thehypocrites and the kuffar (unbelievers) in the firetogether.”53Allah Ι in this ayah has called them kuffar andhypocrites, even though some among them are believers.They are still in the group of kufr. Those among themthat are hypocrites but are judged as Muslims in this lifewill be with their kuffar counterparts on the Day ofJudgement 54, for Allah Ι knew that they were53Surat un-Nisaa’, ayah 14054Thus the judgement in this ayah cannot be used to call all of the peoplethat enter the parlaiament as kuffar. Allah Ι referred to them as kuffar andhypocrites, thus there was a division made between them. Thus in thislife, we see them showing Islam, but internalising nifaaq (hypocrisy), wecannot call them kuffar until the impediments of takfir are examined forsuch an individual. Although the judgement for this person in this lifefrom the apparent is a Muslim, Allah Ι knows that this person is ahypocrite. Again, that does not stop us from classing them as a group ofkufr, as legislation is kufr.BE AWARE OF TAKFIR!internalising major nifaaq and their Islam was a mereshow. Due to the fact that this action is actually rotatingin between kufr and hypocrisy, it is better not to callevery one in the parliament a kaafir. This way you givethe benefit of the doubt for those who are notpropagating democracy and are trying to use it to stopthe propagation of kufr in legislation. Now it isimportant to note that it doesn’t mean we agree with thismethod or we say it’s right, for the only right method is:‫ﷲ‬ ‫ﻛﻠﻪ‬ ‫ﺍﻟﺪﻳﻦ‬ ‫ﻭﻳﻜﻮﻥ‬ ‫ﻓﺘﻨﺔ‬ ‫ﺗﻜﻮﻥ‬ ‫ﻻ‬ ‫ﺣﺘﻰ‬ ‫ﻗﺎﺗﻠﻮﻫﻢ‬“And fight them till there is no more fitnah (shirk) andthe religion is completely for Allah in totality.”55We do not suggest that we violate their blood by callingeach one of them a kaafir, but they are a group of kufr.All of them, the tricked, the kuffar, the apostates, thebuilding and otherwise are all a target that can betargeted by the believers and everyone housed under theroof of this building can be sent to Allah Ι (in otherwords killed) to be checked according to their intention.We have to be disciplined and not use the pyramidscheme of takfir.56It is incumbent to draw the line of55Surat ulAnfaal, ayah 39 and Surat ulBaqara, ayah 19356The pyramid scheme way of making takfir is to make takfir oneveryone associated with an act, which causes the domino effect. Thisdomino effect leads to everyone being labelled a kaafir when noteveryone is deserving of such a title. The model of such a takfir pyramidis as follows. The first one at the top are the rulers, in the middle are the
  28. 28. BE AWARE OF TAKFIR!certainty between kuffar and Muslims, althoughMuslims could have munaafiqun (hypocrites), ignorantpeople and fools among them. It does less harm forone’s Islam to include a kaafir amongst Muslimsbecause of his hypocrisy and doubts than to call aMuslim a kaafir when he does not deserve the title andwhen there is not enough evidence provided 57. This inturn does not mean that we neglect our duties to removeoppression and haraam, as the ayah quoted previously inregards to fitnah is the recipe for removing thisoppression. 58In conclusion, there is a lot of evidence that benefit ofthe doubt should be given to sincere Muslims using thisincorrect method. And may Allah Ι forgive them andshow them the guidance on the right path. Those whoare declaring everyone kuffar with regard to this issue,scholars and the army and at the bottom are the common folk, whichmake up the base of the pyramid. By indiscriminately making takfir oneveryone in the army and anyone in a position of authority, then thebottom, who are the common folk, suffer under the blow of ‘guilt byassociation takfir’ as well, either due to inaction or appearing to supportthe other parts of the pyramid. This will be tackled in the section onvoting.57This example could be found when the Messenger ρ knew thehypocrites by their names, but he still did not ask them to divorce theirwives, even though they were known to be hypocrites by the Messenger ρand some of the Sahaaba τ. This is due to the fact that they were withinthe community and the impediments of takfir could not be removed withregard to them.TheThis matter is explained in much more detail in the work58.Khawaarij and JihaadBE AWARE OF TAKFIR!may Allah Ι guide them to focus on matters morematurely.
  29. 29. BE AWARE OF TAKFIR!THE ONE THAT IS INVOLVED IN THE ACT OFVOTINGThe second category that must be made mention of arethose who vote. This category again is one that has ledto a lot of disputation among some of Muslims of ourtime and has led the takfiri minded people to go on atakfir rampage in regards to voting. This has happeneddue to the misunderstanding of the impediments andconditions of takfir as well as the judgement on theapostate or one who disbelieves after his Islam. The onewho wants to use the principles of takfir properly shouldfirst digest the chapter on what causes one to disbelieveafter his imaan. Only then will the proper understandingof the religion be made known to him. Before then, theonly thing the individual can do is make takfir withoutreason or without sufficient evidence. 59With regard to those that are voting, they are three maincategories,1. Those who believe in democracy and they vote andthey don’t mind being elected or to make laws whenthey have a chance. These people are apostates. But wecan only know them if they speak of their belief.2. Those who vote due to the fact that they have beengiven a bribe, promises due to worldly gains and soforth. These people are most likely to be fussaaqThe KhawaarijWe strongly recommend that people refer to our work,59.so that they may gain more discipline in the issue of takfirand Jihaad,BE AWARE OF TAKFIR!(rebellious sinners) due to their position hunting,who are not only selling the religion for a miserableprice, but also themselves.3. These are the Muslims who are tricked by the evilscholars; jaahil (extremely ignorant) andunknowledgeable people or spokesmen for wrongwho make evil look beautiful. These people havethree groups among them.a. Those who blind follow their scholars. They knowthe prohibition from Allah Ι and we mentioned itbefore, ‘Don’t sit with people who are mockingthe signs of Allah.’ These people are Mushrikun(pagans) because they have done shirk of obedienceby blind following their scholars and have advancedthe words of their scholars over the Book and theyallow people to legislate next to the Shari`a and areassisting in shirk.b. These are the people who have been threatened bythe scholars that if they don’t vote, it means that theydid not enjoin the right and forbid the wrong by theirtongues. They have been tricked and their voice isnot being used to aid the religion of Allah Ι. Theyhave been threatened that if they do not vote andselect religious people to represent them inparliament, then the Shari`a will be even worse thanit is now. These types of people are in error, but theyare certainly not kuffar or hypocrites, due to theinterpretation that they were given. May Allah Ι

These are the people forced to vote as sometimeshappens in tyrannical regimes, in particular theMiddle East, as the government will stop basic needsfor any citizen if he does not vote. An example willbe that he will not receive any medical or otherassistance if he does not produce his voting card.Some may be deprived of licenses for theirbusinesses or travel documents for them to gooutside of the country. These kinds of people areforced and Allah Ι will deal with them according totheir intention, just how much force was applied tothem and whether it was avoidable or not.But for us to judge these people, and to judge themwhether or not they had the ability to avoid this issue ornot, is not fair or just in the way of Islam. However, dueto all of the above, it is very inaccurate to label all votersto be kuffar, such as the Takfiriyyah or the Khawaarij,without understanding the reality of people in theabsence of the Shari`a and any other alternative forthose that are oppressed. Really, each case must bestudied individually, if one wants to give a verdict abouta certain type of people. That does not mean to delay orslow down the struggle of the Mujaahidin because someof the people have been forced or they are astray. Thisshould not hinder the fighters of Allah Ι from attackingplaces of voting or to destroy the meetinghouses of thatnew bid`a known as democracy, and whoeverBE AWARE OF TAKFIR!propagates it. But the brothers are not to target peoplewithout cause. If mistakes happen, the benefits of doubtshould be given to the Mujaahidin and people should notaccept any propaganda from the false legislators againstthose who fight in the cause of Allah Ι.The Messenger ρ said,“The best person in fitnah is a person who is riding hishorse, terrorising the enemies of Allah and they areterrorising him. Second best after that is a person wholives in the mountains, worshipping Allah, and givingzakah and is waiting to die.”60There is no third category, therefore, those suffering, ifthey cannot fight, they should emigrate. We shouldunderstand that those who are fighting in the cause ofAllah Ι, they are the fortunate and successful ones, andthose who have emigrated and cleared the areas offitnah, shirk and oppression, they are the saved ones.Those who could not do any of these two, they will beresurrected according to their intention and action butthey should not be in the way or try to slow down orcancel the main struggle of Allah’s Governance onEarth.60Related by Sahih Muslim.
