Basic Facts of the case. <ul><li>Gideon was charged with a felony for breaking and entering. </li></ul><ul><li>Gideon could not afford a lawyer and asked the court to provide him with one. </li></ul><ul><li>The court denied Gideon’s request for a lawyer. </li></ul><ul><li>Gideon was sentenced to five years in a state prison. </li></ul>
  3. 3. Issues involving the Bill of Rights <ul><li>When the court refused to provide Gideon with a lawyer, this violated his right to a fair trial. </li></ul>
  4. 4. PLAINTIFF <ul><li>Gideon was arrested earlier in the year for a robbery. </li></ul><ul><li>He was sentenced 5 to 10 years in prison, without a lawyer. </li></ul><ul><li>Then, Gideon sued for not getting a lawyer from the court, because he did not have enough money. </li></ul><ul><li>In the end he won and did not have to serve his sentence. </li></ul>
  5. 5. Defendant’s argument <ul><li>The defendant argued that since the case had not been a capital offence a lawyer did not need to be provided </li></ul>
  6. 6. How the case was resolved <ul><li>The Gideon vs. Wainwright resolved in &quot;right to counsel&quot; where legal counsel needs to be provided in all cases because the 6th amendment doesn't specify capital and non capital cases. </li></ul>
  7. 7. Significance <ul><li>Gideon vs. Wainwright was significant in the fact that it showed how the constitution didn’t specify when a case is a capital offence and when it is not, meaning that a lawyer can be provided for any case. </li></ul>

Madi’s Thoughts <ul><li>Gideon should’ve gotten a lawyer. </li></ul><ul><li>The court cannot take away the right to be represented by a lawyer, no matter how much money you have. </li></ul><ul><li>Sending a person to jail for 5 to 10 years without a lawyer should be against the law. </li></ul>
  9. 9. Dani’s thoughts on the case <ul><li>I think that this is one of those things that should never have happened </li></ul><ul><li>Just because someone wants to take some shortcuts to get the case done with Gideon should not have had to go without a lawyer </li></ul>
  10. 10. Mayson’s thoughts <ul><li>I think that Gideon was right. He should have had a lawyer and that money shouldn’t be an issue in his right to a fair trial. </li></ul>
  11. 11. Haley’s thoughts on the case… <ul><li>I believe that the court should have provided Gideon with a lawyer. </li></ul><ul><li>Because Gideon was not provided with a lawyer, he didn't have a fair trial. </li></ul><ul><li>Everyone should have the opportunity to a fair trial. </li></ul>
