WHAT IS INTELLECTUAL PROPERTY(IP)? According to World Intellectual Property Organization (WIPO), IP refers to creations of the mind: inventions, literary and artistic works, and symbols, names, images, and designs used in commerce IP is divided into two categories: Industrial property and Copyright Example of Industrial Property: inventions, trademarks, industrial designs, etc… Examples of Copyright: literary and artistic works such as music, film, novel, etc…

CURRENT SITUATION WORLD WIDE Legal issues regarding intellectual property is happening all over the world Most of cases are happening in India and China Organizations such as WIPO, IPO (Intellectual Property Owners Association), OAPI (African Intellectual Property Organization), and AIPLA (American Intellectual Property Law Association) are established to reduce the number of lawsuits regarding IP problems

SITUATION IN CHINA The situation in China regarding the issue is very severe Although there are several IP laws present in China, they are not properly enforced by the government Examples of things that violates IP laws in China: DVD, CD, books, electronic devices including iPods, mp3s, TVs, etc…

IPAD TRADEMARK DISPUTE IN CHINA Apple’s long-running dispute over the iPad trademark in China Proview Technology, a struggling Taiwanese-owned electronics company, is asking the customs administration to seize iPads passing through Chinese ports for import or export, its lawyer said On 24th April 2012, Chinese high court announced that the trademark iPad registered by the Taiwanese company is legal and therefore acceptable
