    • For capital gains from royalty from use of your innovation in products

    • Describes the first process in series of things to do before the patent is granted.
    • Describes the procedure to establish priori for your innovation
    • The actual part of filing claims, patent examination, patent grant is out of scope of this presentation.
    • Only for individuals filing priori art on India only.
    • For corporate and for filing international patents, the procedure is differnet

    • Download forms here http:// www.ircc.iitb.ac.in/patent_forms.html
    • Filled Form 1 in duplicate
    • Filled Form 2 in duplicate
    • DD or Check of Rs 1000 payable in Chennai.
      • In the name of “The Patent Controller”
    • A covering letter (optional)
    • Send it by registered post to
    • The Patent Office,
    • Intellectual Property Office Building,
    • G.S.T. Road, Guindy ,
    • Chennai -600032,
    • Phone: 044-22502031- 35
    • FAX: 044-22502066
  • 5. Process - continued
    • Then call the office to confirm receipt of letter and get the application number as reference (after one day)
    • Wait for the application receipt from patent office
    • Preserve this receipt for follow up and continuation of patent procedure.
    • Then you will have 1 year from date of this filing to file your claims.
    • For this you will need help of patent attorney and/or patent writers

    • Name
    • Address
    • Title of invention
    • Other declaration like nationality (long list)
    • 2 signatures with date
  • 7. Form 2
    • Name , address
    • Title of the invention.
    • Brief description of the innovation.
    • Abstract of the innovation.
  • 8. Description of the innovation
    • Describe the priori art (innovation known which are similar to yours)
    • Describe you innovation in 1-2 pages, not in very detail, not very brief.
    • Should contain important aspects of innovation, algorithm, drawings.
    Abstract of the Innovation
    • Describe the context and applications of the innovation
  • 9. Conclusion
    • Patents are very important for innovation and entrepreneurs.
    • For individuals filing Indian patents, establishing priori art is easy and straightforward.
    • However the complete process is lengthy and a bit costly too.
    • But its worth it, if your patent leads to a hot selling product.
