    12. Law matters
      • Franchise is not specifically regulated in Dutch Law.
      • The general laws of contract apply. Also Dutch Competition Law and the Commission Regulation 2790/1999 plus the EC Guidelines are applied.
      • Franchisors that are members of the NFV are bound by the rules in the European Code of Ethics for Franchising.
      • All contracts concluded under Dutch law are subject to the general requirements of reasonableness and fairness.
      • Disclosure:
      • Consistent case law indicates that franchisors must present a prognosis regarding the succes to be expected of a new franchise location, based on thorough and carefull assessment of the marker and the new location. Keep in mind the Code of Ethics.
    13. FRANCHISE FAIRS
      • Since 2004 a small, moderate fair is organised in Spring by two associated members in cooperation with the NFV.
      • In 2004 there were 50 exhibitors, in 2005 we counted 75 exhibitors, most of them franchiseformulas, in 2006 80 exhibitors and in 2007 84. The expectations for 2008 are moderate.
    14. Franchise Magazine
      • Franchise + is the only specialized franchise-magazine in Holland, and appears six times a year. It is edited by an associated member of the NFV.
      • Furthermore, the NFV distributes by e-mail to her members 6-8 times a year a so-called digital “Nieuwsbrief” (newsletter).
      • Finally the NFV publishes many articles in specific branche-magazines, newspapers et cetera and is also the editor of:
      • Praktijkgids Franchising, 2008, fourth edition, 236 pages
      • Franchise and Finance, 2007, first edition, 85 pages
      • Franchise and Marketing, 2008, first edition, 105 pages
    15. Future
      • Members: goal for 2008 is 25 new members
      • Statistics: since October 2007 we have professional help (EIM) in collecting and elaborating the figures/data concerning 2007, 2008 and 2009. Costs: €. 32.000
      • Books: every year we intend to edit one specialized book; 2007 Franchise and Finance, 2008 Franchise and Marketing, 2009 Franchise and HRM or Franchise and Legal Issues.
