Templer et al., Alameda County Superior Court Case No. RG05241337 Dear Mr. Templer: Yesterday, I received, by fax, properly formatted discovery responses from you. I understand that this required a significant effort on your part. I no longer have any problems with the format of your responses. However, as I have written you on two prior occasions, the substance of your responses must conform with established law. Otherwise, they are improper because they are evasive. Under this standard, as I have told you, your responses to requests for admissions nos 9 through 11 are inadequate. Based on the following: federal law governing cybersquatting makes it illegal to sell a domain name in which you have no direct commercial association. Here is your last chance: if you can find any legal authority that permits you to engage in “self-help” with regard to a client’s domain name (i.e., selling a client’s domain name to obtain reimbursement for unpaid bills), please provide it. If you cannot provide me with such authority, then you must amend your responses so as to admit Requests Nos 9 through 11. (Unless, of course, you wish to assert your Fifth Amendment right against self-incrimination.) Please provide me with legal authority establishing that selling a client’s domain name to cover an unpaid bill does not constitute cybersquatting or else amend your responses. If I do not receive the required response by May 21, I will file the appropriate motion to compel which will likely result in a court finding that you have committed criminal acts.
