  • 1.  If you get pulled over by the police, you should remain as calm as possible.  Be respectful, but remember that you don’t have to answer any questions that might incriminate you.  Unless you are arrested, the officer will not Mirandize you, and anything you say can be used against you.
  • 2.  While you don’t want to incriminate yourself, there is some information you need to provide.  Give the officer your driver’s license, registration, and proof of insurance.  You are not required to state for the record if you have been drinking.
  • 3.  The arresting officer may choose to administer a field sobriety test. A breathalyzer test may be administered at the site. If it shows that you are intoxicated, a second breathalyzer will be conducted at the police department.  In Nevada, refusing a breathalyzer can lead to a license suspension.
  • 4.  Blood tests can be more accurate than breathalyzers.  You do have the right to request a blood test instead of a breathalyzer.  You will be charged for the test if there was a working breathalyzer unit at the scene.
  • 5.  When you are taken to the booking station, make sure to take mental notes of your surroundings.  Get the arresting officer’s name and try to keep track of the times that events occur after your arrest.  As soon as you are informed that you are under arrest, ask for your attorney.
  • 6.  As soon as you are able, call your DUI lawyer.  Your attorney can begin working immediately to launch a defense for you.  A good DUI attorney will review your case and look for any holes that could help with your defense.
  • 7.  When you are arrested after a breathalyzer test, you will be given a temporary license.  This license only allows you to drive legally for seven days.  Within that seven days, you must request a hearing from the DMV so that a judge can rule on your ability to drive in the future.
  • 8.  By following these steps, you can ensure that you will be able to defend yourself in court.  Your DUI lawyer can help you reach a successful conclusion for your arrest.  Remember, the best defense for a DUI is to not drink and drive.
