Nature of Booking 1.1 This is a provisional booking and will be considered as provisional until and unless the required documents i.e. Builder Buyer Agreement /Sale Agreement/Allotment letter etc. are executed. 1.2 In the event of the Company agreeing to allot me/us an Apartment/Flat, I/we agree to pay future installments of Basic Sale Price and other charges as per terms & conditions of the company herein contained and as per payment plan opted by me/us. I/we have read and understood the terms and conditions of allotment as detailed in Builder Buyer Agreement, appended to with this application and agree to abide by the same. 2. Registration and other Govt. Taxes 2.1 Registration Charges, Stamp Duty, Statutory taxes etc. whatsoever as applicable at the time of possession and it shall be borne by the Buyer. 2.2 Service Tax / any other government duties / taxes shall be charged extra as applicable. 3. Mode of Payment 3.1 Cheque /Bank Draft/RTGS/NEFT etc. shall be in favor of M/s. Ekdant India Ltd. Payable at Noida/New Delhi. In case of cheque bounce , the bouncing charges shall be charged as actual from the Buyer. 3.2 Timely payment shall be appreciated. In case of Down Payment Plan, if the installments are not paid as per the Payment Plan, the Payment plan shall automatically be considered as the Construction Link Plan. The rebate / discounts given in Down Payment Plan will be deemed as CLP. 3.3 In case of delay payment an interest @1.5% per month shall be charged extra, if delayed more than three months, the interest @ 2% per month shall be charged. 4. Home Loans 4.1 The Buyer will be responsible for availing Home Loans in response to any extra cost, non sanction of the loan for whatsoever reasons, the Builder will not be responsible. 1. Cancellation Procedure 5.1 If in any case / circumstances, Buyer opts for cancellation of his/her booking after signing the Builder Buyer Agreement, the cancellation Charges @10% of the total sale price will be forfeited. 5.2 If the said unit has been booked through any registered Associates/dealers, a duly signed NOC must be required for cancellation from the Associate/dealer. 5.3 In case of refunds, the same shall be given within 90 days from the receipt of cancellation / NOC from Company's/ registered Associate/dealers. 5.4 The company shall offer Builder Buyer Agreement /Sale Agreement/Allotment letter etc. after payment of 20% of BSP. It is required to sign the BBA within 30 days after invitation from the Builder. In case of delay / failure either a penal interest @1% per month of the Basic Sale Price till signing the BBA shall be charged extra or Builder may cancel the above said booking. 6. Other Terms & Conditions 6.1 All the other terms and conditions duly described and mentioned in Builder Buyer Agreement /Sale Agreement shall apply & binding. 6.2 The possession of the particular unit /flat shall be given only after clearance of all dues to the Builder. 6.3 All the details shown in the brochure perspective are conceptual designs and do not constitute a legal offering. It may vary at the time of execution. The location of facilities like Gardens, clubhouse, Swimming Pool etc. are subject to change depending upon the architect's advice for better planning, the Builder shall have every right for the same. 6.4 The Other charges such as Development Charges, FFC, EEC, IFMS, Car Parking, Club House etc. in addition to BSP (Basic Sale Price) are applicable as per the rate mentioned in price list. One Car Parking is mandatory. 6.5 Prices are subject to the sole discretion of the Builder and the price of flat prevailing at the time of booking would be applicable for the booking of flat / unit. 6.6 The company reserves the rights to accept or reject any booking received at any time before registration. 6.7 I understand that only written and signed commitments given by the Builder will honor and not any verbal commitments, from whomsoever it may be in the Builder. 6.8 I/We confirm that all correspondence to me/us should be made in the name of the First Applicant at the address given above and any notices /letters sent by the Company to the above address shall be valid intimated to me/us regarding the contents therein. 6.9 In case the cheque comprising booking amount/registration amount is dishonored due to any reason, the Builder reserves the right to cancel the booking without giving any notice to the Applicant(s). 7. Builder does not issue any Credit Note to the Buyer's and nor allow any Employee's/Dealers/Associates to do the same, if issued, Builder will not be responsible. 7.1 In the event of any differences or disputes arising between the Applicant/s and M/s. EKDANT INDIA LTD., the same shall be referred to an arbitrator appointed by M/s. EKDANT INDIA LTD. in accordance with and subject to the provisions of the Arbitration & Conciliation Act 1996. The Applicant/s shall not be entitled to raise any objection to the appointment of any such Arbitrator. The Arbitration shall be conducted in English/Hindi Language and the place of Arbitration shall be in Gautam Buddh Nagar U.P. 7.2 All transactions with M/s. EKDANT INDIA LTD. are subject to Gautam Buddh Nagar jurisdiction, in accordance with the laws of the Republic of India and M/s. EKDANT INDIA LTD. will not be liable for any claims relating to any other law. The courts at Gautam Buddh Nagar only have the exclusive jurisdiction in all matters arising out of and/or touching or connecting this transaction. 7.3 The mailing address for all official correspondence / communication shall be on corporate office i.e. M/s. EKDANT INDIA LTD, C40, SECTOR-58, NOIDA (U.P.) – 201301. I/we hereby declare that I/we have read and understood all the above terms & conditions mentioned above and shall abide by same.
