  2. 2. <ul><li>Copyright is a law of the U.S. that protects any work or intellectual property from being used without consent or permission. There is an exception to this law called “ fair use ”. </li></ul>
  3. 3. FAIR USE refers to a set of guidelines that allows teachers and students to use pieces or parts of another person’s work with permission. <ul><li>Four factors determining fair use </li></ul><ul><li>Purpose and character </li></ul><ul><li>Nature of copyrighted Work </li></ul><ul><li>Amount used </li></ul><ul><li>Market effect </li></ul>
  4. 4. Works that are considered copyright protected are writings from books or magazines, poems, photos or drawings, videos, and music, just to name a few.
  5. 5. The GUIDELINES below are for using another person’s work in your classroom presentation, project, report, or movie: .
  6. 6. POEMS Up to 250 words (or the entire poem if it is less than 250 words <ul><li>Up to 1000 words, but not more than 10% of the book or article. </li></ul>SECTIONS FROM BOOKS OR MAGAZINES
  7. 7. POEMS ROSES ARE RED… <ul><li>Up to 250 words (or entire poem if it is less than 250 words) </li></ul><ul><li>No more than 3 poems by the same poet </li></ul><ul><li>No more than 5 poems from the collection of poetry </li></ul>
  8. 8. PHOTOGRAPHS OR DRAWINGS <ul><li>Up to 5 graphics or photos from the same person </li></ul><ul><li>No more than 15 images from the same collection </li></ul><ul><li>Images can not be changed </li></ul>
  9. 9. VIDEO <ul><li>Up to 3 minutes but no more than 10% of the entire video </li></ul><ul><li>The Video clip may not be changed in any way </li></ul>
  10. 10. MUSIC <ul><li>Up to 30 seconds but no more than 10% of sheet music </li></ul><ul><li>Up to 30 seconds but not more than 10% of recordings </li></ul><ul><li>The music can not be changed in any way </li></ul>
  11. 11. Fair Use is tricky, just remember: <ul><li>Use only small pieces of another person’s work and only use what is necessary. </li></ul><ul><li>Use the work only for personal and educational purposes. </li></ul><ul><li>Do not make a copy of the work and distribute to the masses. </li></ul><ul><li>Do not use the work if it adversely affects the commercial potential of the work. </li></ul><ul><li>Make sure the work is a legally-obtained version. </li></ul><ul><li>If your not sure if the work is legal, get permission from the owner. </li></ul>
  12. 12. REMEMBER, you do not need to get permission if you follow the fair use guidelines, but always give credit where credit is due, use a bibliography to cite your source(s).
