  • 3. PURPOSE OF THIS MEETING Why are we here? Share DGS recommendations for disposing Parcel 238/40 (800 Barnaby Road, SE). Explain District’s next steps with respect to surplus/disposition process. Provide insight from the Local Developer. Solicit comments from community and neighbors.
  • 4. FACTS ABOUT PARCEL 238/40  800 Barnaby Road between Bonini Road and Chesapeake Street, SE  Unimproved, irregular shaped land parcel  1.089 acres or 47,476 sq-ft  Adjacent to Temple of Praise Church and public Right-of -Way

SURPLUS AND DISPOSITION Surplus  Surplus Analysis*: determines whether the District has a use for property; determines highest and best use with respect to District interests; summarizes public comments.  Surplus Resolution: Legal document to City Council that verifies and states property not needed for public use Disposition (DC Code 10—801)  Meet District requirements*: District may dispose property for use with a direct public benefit  Term Sheet*  Market Based Appraisal*  Economic Analysis  Sales Agreement  Disposition Resolution  City Council Approval Process * Items completed by DGS.

SURPLUS AND DISPOSITION Surplus Statutory Requirements  According to the DC Code there are legal requirements associated with surplus properties, including the following: • Requirement of a public hearing prior to submission to Council for approval of the surplus designation. • A surplus resolution must be submitted to Council for 90 day review (excluding weekends, federal holidays and days of Council recess). • In general, applies to long-term leases (greater than 20-years) or the sale of public property.  For your reference, the following statute of the DC code explains these requirements: • § 10-801. Authorization; description of property; submission and approval of resolution; reacquisition rights; notice.
