  5. 5. 3) TO MITIGATE OBSOLESCENCE, WHAT SHOULD BE INTEGRATED INTO ALL FACILITY DESIGNS? -BUILDINGS OFTEN BECOME OUTDATED SOON AFTER THEY ARE CONSTRUCTED. -TO MITIGATE THIS REALITY, FUTURE EXPANSION & RENOVATION SHOULD BE INTEGRATED INTO ALL FACILITY DESIGNS. -IT IS DIFFICULT TO ENVISION A FACILITY’S MANY POTENTIAL USES.

  7. 7. 4) WHAT NHL TEAM RELOCATED TO PHOENIX, AZ IN 1996? -THE WINNIPEG JETS BECAME THE PHOENIX COYOTES. -THE NHL EXPANSION IN THE 1990’S TO PRIMARILY WARM WEATHER, NON-TRADITIONAL HOCKEY REGIONS WAS DUE IN LARGE PART TO WAYNE GRETZKY BEING TRADED TO THE LA KINGS.
  8. 8. 5) AS A HOCKEY VENUE, WHAT WAS THE PROBLEM WITH THE US AIRWAYS CENTER? -AS A BASKETBALL ARENA, IT HAD TERRIBLE SIGHTLINES FOR HOCKEY. -US AIRWAYS CENTER (ORIGINALLY NAMED AMERICA WEST ARENA) WAS BUILT IN 1992 FOR NBA’S PHOENIX SUNS.

  10. 10. 6) WHAT IS ONE PROBLEM WITH BUILDING FACILITIES IN METROPOLITAN AREAS? -LAND ACQUISITION. -IN METROPOLITAN AREAS MULTIPLE ACRES OF LAND MAY HAVE TO BE PURCHASED FROM VARIOUS OWNERS.
  11. 11. 7) WHAT IS AN OPTION? -”THE RIGHT TO PURCHASE A PIECE OF PROPERTY.” -AN OPTION WILL HAVE A SET TIME PERIOD IN WHICH THE POTENTIAL PURCHASER MAY EXERCISE THE OPTION TO PURCHASE THE LAND AT AN AGREED-UPON PRICE.
  12. 12. 8) WHAT IS EMINENT DOMAIN? -”THE POWER TO TAKE PRIVATE PROPERTY FOR PUBLIC USE BY A STATE, MUNICIPALITY, OR PRIVATE PERSON OR CORPORATION AUTHORIZED TO EXERCISE FUNCTIONS OF PUBLIC CHARACTER, FOLLOWING THE PAYMENT OF JUST COMPENSATION TO THE OWNER OF THAT PROPERTY.” -THE US CONSTITUTION PERMITS THE GOVERNMENT TO FORCIBLY TAKE LAND FROM PRIVATE CITIZENS, BUT IT MUST PROVIDE ADEQUATE COMPENSATION (5 TH AMENDMENT). -THE LAND SECURED FROM PRIVATE CITIZENS MUST BE USED FOR THE PUBLIC GOOD.

NEW LONDON? -IN 2005 SUSETTE KELO & 8 OTHER PRIVATE HOMEOWNERS SUED THE CITY OF NEW LONDON, CT FOR ENACTING EMINENT DOMAIN ON THEIR PROPERTY WITHOUT PROPER COMPENSATION. -THE LAND WAS TO BE TRANSFERRED TO ANOTHER PRIVATE OWNER AS PART OF A COMPREHENSIVE REDEVELOPMENT PLAN WHICH PROMISED 3,169 NEW JOBS & $1.2 MILLION/YEAR IN TAX REVENUES. -THE US SUPREME COURT RULED IN A 5-4 DECISION THAT THE GENERAL BENEFITS A COMMUNITY ENJOYED FROM ECONOMIC GROWTH QUALIFIED SUCH REDEVELOPMENT PLANS AS A PERMISSIBLE PUBLIC USE.
  14. 14. 10) WHAT FACILITY DID TEXAS EXEMPT FROM ITS RESTRICTIVE ANTI-EMINENT-DOMAIN-FOR-PRIVATE-USE LAW? COWBOYS STADIUM -WHEN THE COWBOYS CHOSE THE SITE OF THEIR NEW STADIUM IN ARLINGTON, THERE WERE 19 RESIDENTIAL & COMMERCIAL PROPERTIES IN THE AREA. -THE RULING IN THE KELO CASE ALLOWED THE CITY OF ARLINGTON TO ACQUIRE THE LAND & MOVE THE CURRENT OWNERS.
  15. 15. 11) WHAT MAIN FACTORS ARE PART OF PREPARING A BUILDING SITE? 1) SECURING PROPER ZONING. -A BUILDING CAN ONLY BE CONSTRUCTED IN AN AREA THAT CONFORMS TO ITS USE. 2) MEETING ENVIRONMENTAL CONCERNS. -THESE MAY INVOLVE ENSURING THE NEW CONSTRUCTION WILL NOT HAVE AN ADVERSE EFFECT ON THE SURROUNDING AIR, WATER, & SOIL. 3) CREATING THE PHYSICAL CHARACTERISTICS NECESSARY TO BUILD. -THIS MAY INCLUDE GRADING THE SOIL SO THAT IT IS STABLE, REMOVING TREES & OTHER IMPEDIMENTS, & ESTABLISHING THE INFRASTRUCTURE FOR UTILITIES.
