  • 2. © Copyright 2014 The Detail Devils ® Brodie Panlock (1987 – 2006) Brodie committed suicide after enduring persistent, sustained, and vile bullying & harassment by fellow workers. She is one of many.
  • 3. © Copyright 2014 The Detail Devils ® Brodie Panlock (1987 – 2006) A coronial investigation into her death found the men spat at her, poured oil and beer on her and offered her rat poison. On 8 February 2010, four workers at Café Vamp, a small restaurant in Melbourne Victoria, were fined a total of $335,000 for repeatedly bullying, or allowing bullying to occur to Brodie. Victoria introduced “Brodie’s Law” which made bullying at work a criminal offence.
  • 4. © Copyright 2014 The Detail Devils ® 8 Years Later New Legislation We now have National Anti-bullying legislation which came into effect on 1 January this year through the Fair Work Act Amendment
  • 5. What is the definition of bullying at work? Bullying occurs when: • a person or a group of people repeatedly behaves unreasonably towards a worker or a group of workers at work. • the behaviour creates a risk to health and safety. Bullying does not include reasonable management action carried out in a reasonable manner. © Copyright 2014 The Detail Devils ®
  • 6. © Copyright 2014 The Detail Devils ® What you can do 1 2 3 4 5 Educate. Provide education for your workers, etc. Have a policy. Implement an anti-bullying policy. Mediate. Treat all complaints seriously and investigate. Keep records. Record details of incidents and their outcomes. Implement a solution and monitor. Do this is to create a harmonious workplace.
  • 7. This means making sure that ALL workers are able to recognise the signs of bullying and harassment. © Copyright 2014 The Detail Devils ® Educate - 1 Provide education to your workers, supervisors and managers. Make sure they are not “turning a blind eye” to what is happening. High Priority
  • 8. Put it in writing and display it on your WHS noticeboard. © Copyright 2014 The Detail Devils ® Have a policy - 2 Implement an anti-bullying policy. Make sure workers are aware of the consequences if they engage in bullying and harassment High Priority
  • 9. Make sure workers know that all complaints will be treated seriously and investigated immediately. © Copyright 2014 The Detail Devils ® Mediate or investigate3 Investigate if the worker wishes to make a formal complaint. OR
  • 10. Keep records - When a formal complaint is received, conduct an investigation with both parties and any witnesses. © Copyright 2014 The Detail Devils ® 4 Record details of incidents and their outcomes. Keep records of the incident(s) including any actions that are agreed between the parties. If the matter is resolved informally, there is no need to keep records.
