  • 3. OPNAVINST 7220.11A 2 Apr 06officers and steady accessions of qualified junior officers intothe nuclear propulsion training program are required to supportthe Navy’s nuclear-powered ships. Because of the extensive andlengthy training program required for personnel to qualify forduties in connection with the supervision, operation, andmaintenance of naval nuclear propulsion plants, the necessarylevels of experienced officers can only be slowly acquired. Inorder to sustain retention of these highly trained officers andto attract officers into the nuclear propulsion training program,authority has been granted for the payment of a special nuclearofficer incentive pay. This authority is intended to encourageaccessions of high-quality unrestricted line officers, as well asthe voluntary retention in the naval service of a relativelylarge proportion of experienced nuclear-qualified officers.4. Special Incentive Pay. The special incentive pay foridentified officers who are in the Nuclear Propulsion Program isNuclear Officer Incentive Pay (NOIP). NOIP will be used asnecessary to attain and maintain approved endstrength and gradedistribution of the nuclear officer community. NOIP paymentlevels are specified in enclosure (1). NOIP is comprised of thefollowing four separate pays: a. Nuclear Officer Accession Bonus. An accession bonus ispaid to individuals who are selected for officer naval nuclearpropulsion training and execute a written agreement toparticipate in a program of training for duty in connection withthe supervision, operation, and maintenance of naval nuclearpropulsion plants. Payment is authorized upon acceptance of thewritten agreement. The Nuclear Officer Accession Bonus is theselected-for-training component of the nuclear career accessionbonus authorized by 37 U.S.C. 312b(b)(1). b. Nuclear Career Accession Bonus. An accession bonus ispaid to unrestricted line officers upon successful completion ofthe nuclear propulsion training program. The Nuclear CareerAccession Bonus is the training-successfully-completed componentof the nuclear career accession bonus authorized by 37 U.S.C.312b(b)(2). c. Nuclear Officer Continuation Pay. Continuation Pay(COPAY) is a sum of money paid in annual installments to nuclearqualified officers who agree to remain on active duty anadditional 3, 4, or 5 years beyond their existing serviceobligation, as defined in paragraph 7 and authorized by 37 U.S.C.312. d. Nuclear Career Annual Incentive Bonus. The annualincentive bonus (AIB) is a sum of money paid annually to nuclearqualified officers who have completed their initial service 2

OPNAVINST 7220.11A 2 Apr 06requirement, and to nuclear-trained and nuclear-qualified limitedduty and warrant officers who remain on active duty an additionalyear, as authorized by 37 U.S.C. 312c. Only officers in paygrades W2 through W5 and O1 through O6 are eligible for AIB.Officers serving in a period of obligated service associated withthe 3, 4, or 5 year COPAY authorized by reference (a) are noteligible for AIB during that period of their obligated service.5. Nuclear Officer Accession Bonus a. Eligibility. Unrestricted line officers or prospectiveunrestricted line officers, who have been accepted for trainingleading to qualification for duty in connection with thesupervision, operation, and maintenance of naval nuclearpropulsion plants, are eligible for the Nuclear Officer AccessionBonus. b. Application. Eligible individuals may apply for receiptof the Nuclear Officer Accession Bonus by submitting a writtenagreement using enclosure (2), which formally requestsdesignation as an officer in training for nuclear propulsionduty. c. Payment. An individual whose formal application,enclosure (2), is accepted by Commander, Navy Personnel Command(COMNAVPERSCOM) (PERS-42), acting for the CNO, will be entitledto the Nuclear Officer Accession Bonus at the rate specified inenclosure (1). Upon acceptance of the application, COMNAVPERSCOM(PERS-42) will provide the individual with official writtennotification of acceptance. A copy of this acceptance can bepresented to the individual’s disbursing unit as authorizationfor payment. d. Recoupment (1) In the event an individual who has received theNuclear Officer Accession Bonus fails to commence orsatisfactorily complete the nuclear propulsion training specifiedin the agreement, all funds received for the Nuclear OfficerAccession Bonus shall be recouped, except as listed below. (2) If, for any of the following reasons, the individualfails to maintain eligibility for the Nuclear Officer AccessionBonus as defined in paragraph 5a, recoupment of payments alreadymade will not be required. These reasons are: (a) Disability not the result of misconduct orwillful neglect, and not incurred during a period of unauthorizedabsence. The term “misconduct” as used here and throughout thisinstruction is defined as any conduct for which the member could 3

OPNAVINST 7220.11A 2 Apr 06be separated from the naval service with an Other Than Honorableor Bad Conduct Discharge per the Uniform Code of Military Justice(UCMJ) or references (b) through (h). This is independent ofwhether or not the member is actually separated from the navalservice as a result of such misconduct. (b) Death. (c) Separation from the naval service by operation oflaws independent of misconduct. (d) Physical disqualification occurring aftercommissioning and after satisfactory completion of physicalexaminations for nuclear field duty, ionizing radiation, andsubmarines (as applicable) per MANMED P-117. (e) Failure to complete nuclear propulsion trainingdue to lack of ability, as determined by COMNAVPERSCOM (PERS-42),upon formal recommendation of the members commanding officer. (f) In those special cases where COMNAVPERSCOM(PERS-42) determines that waiving the requirement to recouppayments is clearly in the best interests of the United States.6. Nuclear Career Accession Bonus a. Eligibility. Unrestricted line officers who meet thefollowing criteria are eligible for the Nuclear Career AccessionBonus: (1) On active duty, and thereby entitled to receive basicpay. (2) Successful completion of the nuclear propulsiontraining program leading to qualification for duty in connectionwith the supervision, operation, and maintenance of naval nuclearpropulsion plants. b. Payment (1) Officers who meet the criteria of subparagraph 6awill be entitled to the Nuclear Career Accession Bonus at therate specified in enclosure (1). Upon acceptance into thenuclear propulsion training program, the value of the nuclearcareer accession bonus authorized on the date of acceptance forthe individual officer becomes fixed. Upon completion of thistraining program, the Commanding Officer, Nuclear Power TrainingUnit (NPTU), shall certify the eligibility of each officer andshall direct the local disbursing officer to make payment of theNuclear Career Accession Bonus. Commanding officers (CO) must 4

OPNAVINST 7220.11A 2 Apr 06ensure that correct procedures for substantiation and recordentries are used, as described in reference (i), to document anofficer’s continued eligibility for the nuclear career accessionbonus. (2) Disbursing payment procedures are regulated byreference (j).7. Nuclear Officer Continuation Pay a. Eligibility. Officers who meet the following criteriaare eligible for receipt of the Nuclear Officer COPAY uponacceptance of their applications: (1) On active duty, and thereby entitled to receive basicpay. (2) Currently qualified for duty in connection withsupervision, operation, and maintenance of naval nuclearpropulsion plants, under the provisions of reference (i),specifically: (a) Nuclear-trained unrestricted line officers whoare assigned the Additional Qualification Designator (AQD) ofSN1, or KD2, or (b) Nuclear-trained unrestricted line aviators whoare assigned the AQD of KD1, or (c) Nuclear-trained unrestricted line surface warfareofficers who transfer to the restricted line, and are assignedthe AQD of KD2. (3) Officers may not be serving under any existingservice obligation. Officers within one year of completion of anexisting service obligation may apply for COPAY to begin at theend of their current obligation, as detailed in subparagraph 7bbelow. Officers currently serving under a COPAY contract mayrenegotiate a new COPAY contract per subparagraph 7c(5). (4) For officers who have not completed their MinimumService Requirement (MSR), qualification as engineer officer of anuclear-powered ship, per reference (i), is required. (5) Have not completed 23 years of commissioned serviceon application. A COPAY agreement may not extend beyond the endof the 26th year of commissioned service (commissioning date plus26 years). Therefore, officers can maximize their eligibilityfor COPAY by keeping their agreement anniversary date identical 5
  • 7. OPNAVINST 7220.11A 2 Apr 06to their commissioning date (month and day). (6) Serving in paygrade O6 or below. Officers selectedfor promotion to paygrade O7 are not eligible to initiate COPAYagreements; however, they may continue to be paid under anexisting agreement until promoted or frocked to O7. (7) Have not been selected for lateral transfer orparticipation in a program resulting in a change of designatorsuch as the Law Education Program (LEP) and Permanent MilitaryProfessor (PMP) Program (with the exception of those nucleartrained unrestricted line surface warfare officers who transferto restricted line, and are assigned the AQD of KD2). Officersselected for lateral transfer, or programs resulting in change ofdesignator, who are serving in nuclear billets, remain eligiblefor COPAY until 1 October following their selection. After 1October, these officers remain eligible only for AIB whileserving in a nuclear billet. (8) Have not been designated “Not Cleared” for departmenthead, principal assistant, executive officer, or commandingofficer with the exception of those nuclear trained surfacewarfare officers who are selected for Assistant Reactor Officer.“Not Cleared” officers serving in nuclear billets remain eligiblefor COPAY until 1 October following the screening boarddesignating them “Not Cleared.” After 1 October, these officersremain eligible only for AIB while serving in a nuclear billet. (9) For initial COPAY agreements, the commandingofficer’s forwarding endorsement must specifically state that theofficer has the potential to succeed as a department head if theofficer has not yet screened for that career milestone. b. Applications. Eligible officers may apply for COPAY whenthey are within one year of completion of their existing serviceobligation, or thereafter. The existing service obligation shallbe considered as the cumulative obligation incurred (prior to thedate of COPAY application) from initial accession source (minimumservice requirement), nuclear propulsion training (serviceobligation defined by reference (k)), postgraduate training, andany obligation incurred by a COPAY agreement currently in effect.The application shall be a written agreement, conditional uponacceptance by COMNAVPERSCOM (PERS-42), acting for the CNO, toremain on active duty as a nuclear trained officer for a periodof 3, 4, or 5 years beyond any existing service obligation, orfor a period of 3, 4, or 5 years beyond the date of acceptance ofthe application, whichever is later. Submission and acceptanceof a COPAY agreement shall be considered acceptance of a requestby a reserve officer to extend the officer’s period of activeservice through the period of the COPAY agreement. Enclosure (3)provides a sample application format for use by officers applying 6

Payment (1) Officers whose applications are accepted byCOMNAVPERSCOM (PERS-42) prior to completing their MSR incurredfrom initial source training, any additional obligation incurredunder reference (k), and any additional obligation resulting fromlateral transfer or graduate education following commissioning(as applicable) shall be paid at the rate specified in enclosure(1), as defined by (a) or (b) below: (a) A number of equal installments being equal to thenumber of years covered by the agreement plus one, the first uponacceptance of the application, the second upon expiration of theexisting obligated service, and the remaining payments annually(i.e., at 12-month intervals) thereafter. Payment undersubsequent agreements will follow subparagraph 7c(2). (b) Or at the option of the officer, a number ofequal annual installments equal to the number of years covered bythe agreement, the first upon expiration of existing obligatedservice, and the remaining payments annually thereafter. (2) Officers whose applications are accepted byCOMNAVPERSCOM (PERS-42) prior to the end of an obligationincurred by a COPAY agreement shall be paid at the rate specifiedin enclosure (1), in a number of equal annual installments equalto the number of years covered by the agreement, the first uponexpiration of existing obligated service, and the remainingpayments annually thereafter. (3) Officers whose applications are accepted byCOMNAVPERSCOM (PERS-42) after the expiration of any existingservice obligation will be paid at the rate specified inenclosure (1) in a number of equal annual installments equal tothe number of years covered by the agreement, the first uponacceptance of the agreement, and the remaining payments annuallythereafter. (4) No provision exists in the enabling legislation,reference (a), for lump sum or accelerated payments. (5) Upon acceptance of the agreement, the total amountauthorized for the individual officer becomes fixed. However,should the amount paid to officers who subsequently apply forCOPAY be increased for any one or all three agreement periods (3,4, or 5 years), officers with an existing agreement in effect mayrequest a new agreement. The period of this new agreement (3, 4,or 5 years) shall be equal to or exceed the remaining period ofthe officer’s existing agreement, so long as the period of 7

Upon execution of a new agreement, theprevious agreement shall be canceled, effective on the day beforethe anniversary date after the date on which COPAY is increased. (6) Disbursing payment procedures are regulated byreference (j). d. Obligation. The 3, 4, or 5 year service obligationincurred as a result of executing a COPAY agreement shall runfrom the date of acceptance of the agreement, or from the end ofany existing service obligation, whichever is later. e. Assignment. Officers who are receiving COPAY will beassigned afloat or ashore, according to the needs of the servicefor officers of their qualification and experience, in support ofthe Naval Nuclear Propulsion Program, without affecting theireligibility for receipt of this special pay. f. Recoupment (1) In the event an officer who has received COPAY failsto maintain eligibility for such special pay, as authorized byreference (a) and as set forth in subparagraph 7a, or fails tocomplete the full period of additional obligated service, nofurther annual payments shall be made, and recoupment of sumspaid shall be required on a pro rata basis, under the proceduresestablished in reference (j). Examples of situations requiringsuch recoupment are: (a) Approved request for voluntary release from thewritten agreement if, due to unusual circumstances, it isdetermined by COMNAVPERSCOM (PERS-42) that such release would beclearly in the best interests of both the United States and theofficer concerned. (b) Approved voluntary request for relief fromcurrent assignment. (c) Refusal to accept orders as commanding officer,assistant reactor officer, executive officer, principalassistant, department head, or any other assignment in connectionwith the supervision, operation, and maintenance of naval nuclearpropulsion plants. (d) Disability resulting from misconduct or willfulneglect, or incurred during a period of unauthorized absence. (e) Misconduct. 8
  • 10. OPNAVINST 7220.11A 2 Apr 06 (f) Approved Detachment for Cause per reference (l). (g) Selection for and assumption of paygrade O7(including frocking to O7). (h) Failure of final screening, or being placed “NotCleared” for commanding officer, executive officer, principalassistant or department head, with the exception of thoseselected for assistant reactor officer. (2) If, for any of the following reasons, the officerfails to maintain eligibility for COPAY, as authorized byreference (a) and as set forth in subparagraph 7a, or fails tocomplete the full period of additional obligated service, nofurther payments will be made, but recoupment of payments alreadymade will not be required: (a) Disability not the result of misconduct orwillful neglect, and not incurred during a period of unauthorizedabsence. (b) Death. (c) Separation from the naval service by operation oflaws independent of misconduct. (d) Loss of qualification for duty in connection withsupervision, operation, and maintenance of naval nuclearpropulsion plants, except for any of those reasons set forth insubparagraph 7f(1). (e) Where COMNAVPERSCOM (PERS-42) determines thatwaiving the requirement to recoup payments is clearly in the bestinterests of the United States. g. Rate Changes. Any change to the total amount payableupon acceptance of new agreements will be issued by an interimmessage change and a change transmittal to this instruction. h. Submission of Applications (1) Commanding Officers (COs) shall expeditiously forwardagreements submitted by officers desiring to extend their serviceobligation for receipt of COPAY to COMNAVPERSCOM (PERS-42),together with their recommendation. For initial COPAYagreements, the forwarding endorsement should specificallyaddress the officer’s potential to succeed as a department headif the officer has not yet screened for that career milestone. (2) COs must ensure that correct procedures forsubstantiation and record entries are used, as described in 9
  • 11. OPNAVINST 7220.11A 2 Apr 06reference (i), to document an officer’s continued eligibility forCOPAY. It is incumbent upon the CO to consider any pendingcircumstances that could result in ineligibility prior to actualpayment. For example, where there is a case of medical ornuclear disqualification being processed, eligibility for COPAYis suspended when the officer is removed from duties inconnection with the supervision, operation, and maintenance ofnaval nuclear propulsion plants. COs must obtain resolution ofthese cases from COMNAVPERSCOM (PERS-42) prior to approval offurther payments. (3) Eligible officers may submit the request for a COPAYagreement shown in enclosure (3) to COMNAVPERSCOM (PERS-42) viatheir commanding officers. For initial COPAY agreements, if theofficer is not department head screened, the forwardingendorsement letter from the Commanding Officer shouldspecifically address the officer’s potential to succeed as adepartment head afloat, as shown in enclosure (4).8. Nuclear Career Annual Incentive Bonus a. Eligibility. Officers who meet the following criteriaare eligible for receipt of AIB, subject to the restrictions ofsubparagraphs 8b and 8c: (1) On active duty, and thereby entitled to receive basicpay. (2) Serving in paygrade W2 through W5, or O1 through O6. (3) Currently qualified for duty in connection withsupervision, operation, and maintenance of naval nuclearpropulsion plants, under the provisions of reference (i),specifically: (a) Nuclear-trained unrestricted line officers whoare assigned the Additional Qualification Designator (AQD) ofSN1, or KD2, or (b) Nuclear-trained unrestricted line aviators whoare assigned the AQD of KD1, or (c) Nuclear-trained unrestricted line surface warfareofficers who transfer to the restricted line, and are assignedthe AQD of KD2, or (d) Nuclear-trained Chief Warrant Officers/LimitedDuty Officers (LDO/CWO) assigned the AQD of KD4. 10
  • 12. OPNAVINST 7220.11A 2 Apr 06 (4) Not serving in a period of obligated service incurredas a result of the acceptance of COPAY (this does not precludepro rata payment per subparagraph 8d(2)). (5) Not entitled to receive Aviation Career IncentivePay (ACIP), as authorized by BUPERSINST 7220.29A, except in thecase of officers serving in a billet that requires the officer: (a) To be technically qualified for duty inconnection with the supervision, operation, and maintenance ofnaval nuclear propulsion plants (e.g., commanding officer orexecutive officer of a nuclear powered aircraft carrier); and (b) To be qualified for the performance ofoperational flying duties. (6) URL officers who, as commissioned officers,successfully completed training for duty in connection with thesupervision, operation, and maintenance of naval nuclearpropulsion plants, in addition to the above eligibilityrequirements for AIB, must have completed initial obligatedactive service (MSR) as an officer. This initial serviceobligation shall be considered as that obligated service derivedfrom initial source training (e.g., USNA, NROTC, OCS, NUPOC,NECP, STA-21, STA-21(N), etc.), as extended for the Naval NuclearPropulsion Program by reference (k). b. LDO/CWO Restrictions. Officers who as enlisted membersreceived training for duty in connection with the supervision,operation, and maintenance of naval nuclear propulsion plants(hereafter referred to as LDOs and/or CWOs), and who are eligiblefor AIB under subparagraph 8a, must meet the additionaleligibility restriction of serving in an assignment with dutiesin connection with the direct supervision, operation, ormaintenance of naval nuclear propulsion plants. Qualifyingassignment guidelines for these officers are provided inenclosure (5). Requests for identifying additional assignmentsas qualifying for AIB should be submitted utilizing the formatcontained in enclosure (6). c. Payment. AIB was first paid on 30 September 1976, andwill be paid annually at the end of subsequent fiscal years toall eligible officers on active duty as of 30 September. Thefollowing special provisions, and those of subparagraph 8d, applyfor officers who meet the eligibility requirements ofsubparagraph 8a for only a portion of the preceding year: 11

OPNAVINST 7220.11A 2 Apr 06 (1) Officers on active duty on 30 September and otherwisequalified for AIB, but who were on active duty for only a portionof the preceding year, shall be paid AIB for that year on a prorata basis for the period they were on active duty. (2) Officers on active duty on 30 September and otherwisequalified for AIB, who commenced or completed the obligatedservice associated with COPAY within the preceding year, shall bepaid AIB for that year on a pro rata basis for the period of theyear they were not serving obligated service associated withCOPAY. (3) Unrestricted line officers and lateral transferofficers on active duty on 30 September and otherwise qualifiedfor AIB, who completed their initial obligated active service asan officer (as defined in subparagraph 8a(6)) during thepreceding year, shall be paid a bonus for that year on a pro ratabasis for the period of the year beyond completion of initialobligated active service as an officer. (4) Officers on active duty on 30 September and otherwisequalified for AIB, who were, within the preceding year,designated as an officer qualified for duty in connection withthe supervision, operation, and maintenance of naval nuclearpropulsion plants (assigned AQDs as specified in 8a(3)), shall bepaid AIB for that year on a pro rata basis for the period thatthey were so qualified. (5) LDOs/CWOs on active duty on 30 September andotherwise qualified for AIB who, during the preceding year, werein a qualifying assignment, as defined in paragraph 2 ofenclosure (5) to this instruction, shall be paid AIB on a prorata basis for the period of the year that they were serving insuch an assignment. d. Involuntary Separation/Loss of Qualification/Promotion toPaygrade O7. In order to be eligible for AIB (or pro rataportion thereof), an officer otherwise qualified must be onactive duty (except where exempted in subparagraph 8d(2)),serving in paygrade O6 or below, and qualified for duties inconnection with the supervision, operation, and maintenance ofnaval nuclear propulsion plants on 30 September. (1) In the event an officer is separated from the navalservice or loses the technical qualification for duty involvingthe supervision, operation, and maintenance of naval nuclearpropulsion plants prior to 30 September, then no payment of AIBwill be authorized for that year if this separation or loss ofqualification was the result of any of the following reasons: 12

Lateral transfer to a communitynot normally assigned nuclear duties is considered a voluntarysurrender of nuclear technical qualifications. (b) Approved voluntary request for relief fromcurrent assignment. (c) Refusal to accept orders as commanding officer,assistant reactor officer, executive officer, principalassistant, department head, or any other assignment in connectionwith supervision, operation, and maintenance of naval nuclearpropulsion plants. (d) Disability resulting from misconduct or willfulneglect, and incurred during a period of unauthorized absence. (e) Misconduct. (f) Approved Detachment for Cause per reference (l). (2) If, for any other reason, the officer is separatedfrom the naval service or loses the technical qualification forduty involving the supervision, operation, and maintenance ofnaval nuclear propulsion plants prior to 30 September, thenpayment of AIB is authorized on a pro rata basis for the periodof the year during which the officer was on active duty andnuclear-qualified. Examples of reasons within the meaning ofthis paragraph include: (a) Disability not the result of misconduct, willfulneglect, or not incurred during a period of unauthorized absence. (b) Death. (c) Separation from the naval service by operation oflaws independent of misconduct. (d) Loss of qualification for duty in connection withsupervision, operation, and maintenance of naval nuclearpropulsion plants, except for any of those reasons set forth insubparagraph 8d(1). (3) In the event an officer otherwise qualified ispromoted to paygrade O7, or has been selected for and has beenfrocked to O7 prior to 30 September, then the officer shall bepaid a pro rata share of AIB for the period of the year that the 13

Any change to the amount of the AIBpayment rate will be issued by an interim message change and achange transmittal to this instruction. The new AIB payment ratewill apply to AIB amounts accruing subsequent to 30 Septemberfollowing announcement of the new AIB payment rate. f. Administration (1) COs must ensure that correct procedures forsubstantiation and record entries are used, as described inreference (i), to document an officer’s continued eligibility forAIB. A letter of certification from the commanding officer isnot required prior to payment of AIB; however, it is incumbentupon the commanding officer to ensure that each officer to bepaid AIB meets all the eligibility criteria. In the event that amedical or nuclear disqualification is being processed, theneligibility for AIB is suspended when the officer is removed fromduty in connection with the supervision, operation, andmaintenance of naval nuclear propulsion plants. Commandingofficers must obtain a resolution of these cases fromCOMNAVPERSCOM (PERS-42) prior to approval of further AIBpayments. (2) COs must ensure accurate accounting of nucleartrained LDOs/CWOs serving in AIB qualifying assignments. In thisregard, COs shall submit to COMNAVPERSCOM (PERS-42) an annualreport on all qualifying assignments, listing the nuclear-trainedLDOs/CWOs who served in each assignment on a day-for-day basis,to be received not later than 15 July. This report, utilizingthe format contained in enclosure (7), should project theinclusive dates up through the end of the current fiscal year.Updates should be submitted as changes occur.9. Authorization. Nuclear Officer Incentive Pay is authorizedby reference (a). The entitlement portion of the instruction isestablished by DoD 7000.14-R, Department of Defense FinancialManagement Regulation Manual, Volume 7A, Chapter 12, Part A ofFebruary 2002. 14
