AN ORDINANCE OF THE CITY COUNCIL OF THE1
CITY OF ORLANDO, FLORIDA, RELATING TO2
CANNABIS DISPENSING FACILITIES;3
ADOPTING FINDINGS OF FACT; PROVIDING4
DEFINITIONS; IMPOSING A TEMPORARY5
MORATORIUM ON THE OPENING OF ANY NEW6
CANNABIS DISPENSING FACILITY AND ON THE7
EXPANSION OR RELOCATION OF ANY8
EXISTING CANNABIS DISPENSING FACILITY;9
DIRECTING THE PLANNING OFFICIAL TO10
RECOMMEND LAND DEVELOPMENT11
REGULATIONS FOR CANNABIS DISPENSING12
FACILITIES BY A DATE CERTAIN; PROVIDING13
FOR PENALTIES, SEVERABILITY, REPEAL OF14

WHEREAS, as provided in section 2(b), Article VIII of the Constitution of the19
State of Florida, and section 166.021(1), Florida Statutes, the City of Orlando, Florida20
(the “city”), a municipal corporation, enjoys all governmental, corporate, and proprietary21
powers necessary to conduct municipal government, perform municipal functions, and22
render municipal services, and may exercise any power for municipal purposes, except23
as expressly prohibited by law; and24

WHEREAS, as provided in section 166.021(3), Florida Statutes, the governing26
body of each municipality in the state has the power to enact legislation concerning any27
subject matter upon which the state legislature may act, except when expressly28
prohibited by law; and29

WHEREAS, on June 16, 2014, Governor Rick Scott approved CS/CS/SB 103031
creating the Compassionate Medical Cannabis Act of 2014 (Chapter 2014-157, Laws of32
Florida; codified at section 381.986, Florida Statutes; hereinafter referred to as the33
“Compassionate Use Act”); and34

WHEREAS, the Compassionate Use Act legalized the cultivation, production,36
and dispensing of a low-THC derivative product of marijuana for “qualified patients”; and37
38
WHEREAS, under the Compassionate Use Act, “qualified patients” are patients39
suffering from cancer or a physical medical condition that chronically produces40
symptoms of seizures or severe and persistent muscle spasms (e.g., epilepsy or41
amyotrophic lateral sclerosis (“ALS”)); and42

WHEREAS, the low-THC derivative product of marijuana legalized by the44
Compassionate Use Act is administered to patients as an oil or in capsule form, and is45
not smoked like traditional marijuana. The low-THC strain of cannabis and the oil46

product are commonly referred to as “Charlotte’s Web” (but is hereinafter referred to as47
“low-THC product”); and48

WHEREAS, the Compassionate Use Act provides that physicians may only order50
low-THC product for qualified patients if he or she finds that “no other satisfactory51
alternative treatment option” is available; and52

WHEREAS, the Compassionate Use Act is implemented by rule of the Florida54
Department of Health (the “department”) under Chapter 64-4, Florida Administrative55
Code (the “compassionate use rules”); and56

WHEREAS, the compassionate use rules went into effect on June 17, 2015, and58
among other things regulate the selection, licensing, and oversight of “dispensing59
organizations.” A dispensing organization is “a nursery that meets the requirements of60
section 381.986(5)(b)1., Florida Statutes, including its contractual agents, which has61
been authorized by the department to cultivate, process and dispense low-THC62
cannabis” (Rule 64-4.001(10), Florida Administrative Code); and63

WHEREAS, to date, the department has authorized 6 dispensing organizations65
throughout the state of Florida; and66

WHEREAS, applications for dispensing organization approval were evaluated in68
part by the “accessibility of [their proposed] dispensing facilities, e.g., centrally located to69
several populated areas, located on a main roadway…,” (Rule 64-4.002(2)(c)11.a.,70
Florida Administrative Code). The state regulation also requires that applicants71
demonstrate “the ability to obtain zoning approval” (Rule 64-4.002(2)(c)3., Florida72
Administrative Code); and73

WHEREAS, this requirement that applicants demonstrate ability to obtain zoning75
approval has resulted in a number of requests for a determination of how a dispensing76
organization’s “dispensing facility” is categorized for purposes of the city’s table of77
allowable [zoning] uses at Part1B, Chapter 58, Code of the City of Orlando, Florida (the78
“Orlando City Code”); and79

WHEREAS, section 58.200, Orlando City Code, provides, in part, that “[i]n the81
event of uncertainty or where there is not a particular land use category listed anywhere82
in [Chapter 58] that corresponds with a use in question, then the use in the Chapter83
having the most similar characteristics, as determined by the zoning official, to the use in84
question shall apply”; and85

WHEREAS, on June 18, 2015, the zoning official issued official determination87
LDC2015-00245 concluding that “’dispensing facilit[ies]’ under the Compassionate Use88
Act [are] most similar to a ‘Drug Store,’ being defined by Chapter 66, Orlando City Code,89
as ‘[a] Light Retailing Use where the primary business is the filling of medical90

prescriptions and the sale of drugs, medical devices, medical supplies and91
nonprescription medicines, but where non-medical convenience items may be sold as92
well’”; and93

WHEREAS, since this determination was issued, the Compassionate Use Act95
has been amended to legalize the cultivation, production, and dispensing of medical96
cannabis to eligible patients as defined by section 499.0295, Florida Statutes; and97

WHEREAS, in November of this year, Florida voters will decide whether to99
amend the Florida Constitution to legalize the cultivation, production, and dispensing of100
medical cannabis for a broader population of eligible patients; and101

WHEREAS, Florida laws relating to the cultivation, production, and dispensing of103
cannabis products are rapidly changing – raising substantial questions about whether104
cannabis-related land uses, as a category of commercial use, may have deleterious and105
negative secondary effects on surrounding land uses and communities; and106

WHEREAS, the purpose of this ordinance is to place a temporary moratorium on108
the opening of certain new cannabis dispensing facilities, and on the expansion or109
relocation of certain existing cannabis dispensing facilities; and110

WHEREAS, the Orlando City Council hereby finds that the temporary moratorium112
imposed by this ordinance is being imposed for a reasonable duration intended to give113
the city the time reasonably necessary to investigate the impacts of cannabis dispensing114
facilities, and if necessary, to promulgate reasonable regulations relating to such115
establishments; and116

WHEREAS, the Orlando City Council hereby finds that this ordinance advances118
an important government purpose by reducing the likelihood of the unregulated negative119
secondary effects of cannabis dispensing facilities; and120

WHEREAS, the Orlando City Council hereby finds that this ordinance is in the122
best interest of the public health, safety, and welfare; and123

NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY125
OF ORLANDO, FLORIDA:126

SECTION 1. FINDINGS OF FACT. The foregoing recitals are hereby ratified128
and confirmed as being true and correct and are hereby made a part of this ordinance.129

SECTION 2. DEFINITIONS. For the purposes of this ordinance, the following131
words, terms, and phrases, including their respective derivatives, have the following132
meanings:133

a. Cannabis means all parts of any plant of the genus Cannabis, whether135
growing or not; the seeds thereof; the resin extracted from any part of136
the plant; and every compound, manufacture, salt, derivative, mixture,137
or preparation of the plant or its seeds or resin.138

b. Cannabis dispensary means an establishment where derivative140
product of the cannabis plant, except for low-THC cannabis, is141
dispensed at retail.142

c. Derivative product means any form of cannabis suitable for routes of144
administration.145

d. Low-THC cannabis means a plant of the genus Cannabis, the dried147
flowers of which contain 0.8 percent or less of tetrahydrocannabinol148
and more than 10 percent of cannabidiol weight for weight; the seeds149
thereof; the resin extracted from any part of such plant; or any150
compound, manufacture, salt, derivative, mixture, or preparation of151
such plant or its seed or resin that is dispensed only from a dispensing152
organization approved by the Florida Department of Health pursuant to153
section 381.986, Florida Statutes.154

e. Low-THC cannabis dispensary means an establishment where low-156
THC cannabis is dispensed at retail.157

SECTION 3. TEMPORARY MORATORIUM. Beginning on the effective date of159
this ordinance and continuing through December 31, 2016, or sooner if provided160
pursuant to section 4 of this ordinance, a moratorium is hereby imposed on the opening161
of new cannabis dispensaries and low-THC cannabis dispensaries and on the expansion162
or relocation of existing cannabis dispensaries and low-THC cannabis dispensaries.163

a. During the moratorium, it is unlawful and a violation of this ordinance165
for any person, firm, or corporation to open or cause to be opened any166
cannabis dispensary or low-THC cannabis dispensary within the City of167
Orlando, except that low-THC cannabis dispensaries already approved168
by official determination of the city zoning official may open and169
conduct business in accordance with the official determination.170

b. During the moratorium, it is unlawful and a violation of this ordinance172
for any person, firm, or corporation to relocate or cause to be relocated173
any cannabis dispensary or low-THC cannabis dispensary within the174
City of Orlando.175

c. During the moratorium, it is unlawful and a violation of this ordinance177
for any person, firm, or corporation to expand or cause to be expanded178

any cannabis dispensary or low-THC cannabis dispensary within the179
City of Orlando. For purposes of this subsection, the term “expand”180
means to “enlarge the physical size of.”181

SECTION 4. EXPIRATION OF THE TEMPORARY MORATORIUM. The183
temporary moratorium imposed by section 3 of this ordinance expires as of the earliest184
of the following occurrences:185

a. January 1, 2017; or187

b. A date before January 1, 2017, if provided by ordinance of the Orlando189
City Council.190

SECTION 5. RECOMMENDATIONS FOR LAND DEVELOPMENT192
REGULATIONS. The planning official is hereby directed to study, develop, and193
recommend land development regulations for cannabis dispensaries and low-THC194
cannabis dispensaries in the City of Orlando, with such recommendations being195
delivered to the Orlando City Council by no later than December 1, 2016.196

SECTION 6. PENALTIES. Violations of this ordinance are punishable as198
provided by section 1.08, Code of the City of Orlando, Florida.199

SECTION 7. SEVERABILITY. If any provision of this ordinance or its201
application to any person or circumstance is held invalid, the invalidity does not affect202
other provisions or applications of this ordinance which can be given effect without the203
invalid provision or application, and to this end the provisions of this ordinance are204
severable.205

SECTION 8. REPEAL. All ordinances, resolutions, official determinations or207
parts thereof previously adopted or entered by the city or any of its officials and in208
conflict with this ordinance are hereby repealed to the extent inconsistent herewith.209

SECTION 9. SCRIVENER’S ERROR. The city attorney may correct scrivener’s211
errors found in this ordinance by filing a corrected copy of this ordinance with the city212
clerk.213

SECTION 10. EFFECTIVE DATE. This ordinance takes effect immediately215
upon adoption.216

AN ORDINANCE OF THE CITY COUNCIL OF THE1 CITY OF ORLANDO, FLORIDA, RELATING TO2 CANNABIS DISPENSING FACILITIES;3 ADOPTING FINDINGS OF FACT; PROVIDING4 DEFINITIONS; IMPOSING A TEMPORARY5 MORATORIUM ON THE OPENING OF ANY NEW6 CANNABIS DISPENSING FACILITY AND ON THE7 EXPANSION OR RELOCATION OF ANY8 EXISTING CANNABIS DISPENSING FACILITY;9 DIRECTING THE PLANNING OFFICIAL TO10 RECOMMEND LAND DEVELOPMENT11 REGULATIONS FOR CANNABIS DISPENSING12 FACILITIES BY A DATE CERTAIN; PROVIDING13 FOR PENALTIES, SEVERABILITY, REPEAL OF14 CONFLICTING ORDINANCES, CORRECTION OF15 SCRIVENER’S ERRORS, AND AN EFFECTIVE16 DATE.17 18 WHEREAS, as provided in section 2(b), Article VIII of the Constitution of the19 State of Florida, and section 166.021(1), Florida Statutes, the City of Orlando, Florida20 (the “city”), a municipal corporation, enjoys all governmental, corporate, and proprietary21 powers necessary to conduct municipal government, perform municipal functions, and22 render municipal services, and may exercise any power for municipal purposes, except23 as expressly prohibited by law; and24 25 WHEREAS, as provided in section 166.021(3), Florida Statutes, the governing26 body of each municipality in the state has the power to enact legislation concerning any27 subject matter upon which the state legislature may act, except when expressly28 prohibited by law; and29 30 WHEREAS, on June 16, 2014, Governor Rick Scott approved CS/CS/SB 103031 creating the Compassionate Medical Cannabis Act of 2014 (Chapter 2014-157, Laws of32 Florida; codified at section 381.986, Florida Statutes; hereinafter referred to as the33 “Compassionate Use Act”); and34 35 WHEREAS, the Compassionate Use Act legalized the cultivation, production,36 and dispensing of a low-THC derivative product of marijuana for “qualified patients”; and37 38 WHEREAS, under the Compassionate Use Act, “qualified patients” are patients39 suffering from cancer or a physical medical condition that chronically produces40 symptoms of seizures or severe and persistent muscle spasms (e.g., epilepsy or41 amyotrophic lateral sclerosis (“ALS”)); and42 43 WHEREAS, the low-THC derivative product of marijuana legalized by the44 Compassionate Use Act is administered to patients as an oil or in capsule form, and is45 not smoked like traditional marijuana. ORDINANCE NO. 2016-58 Page 2 of 6 Marijuana land use moratorium 2016 2.docx CODING: Words stricken are deletions; words underlined are additions; **** denote omitted text. product are commonly referred to as “Charlotte’s Web” (but is hereinafter referred to as47 “low-THC product”); and48 49 WHEREAS, the Compassionate Use Act provides that physicians may only order50 low-THC product for qualified patients if he or she finds that “no other satisfactory51 alternative treatment option” is available; and52 53 WHEREAS, the Compassionate Use Act is implemented by rule of the Florida54 Department of Health (the “department”) under Chapter 64-4, Florida Administrative55 Code (the “compassionate use rules”); and56 57 WHEREAS, the compassionate use rules went into effect on June 17, 2015, and58 among other things regulate the selection, licensing, and oversight of “dispensing59 organizations.” A dispensing organization is “a nursery that meets the requirements of60 section 381.986(5)(b)1., Florida Statutes, including its contractual agents, which has61 been authorized by the department to cultivate, process and dispense low-THC62 cannabis” (Rule 64-4.001(10), Florida Administrative Code); and63 64 WHEREAS, to date, the department has authorized 6 dispensing organizations65 throughout the state of Florida; and66 67 WHEREAS, applications for dispensing organization approval were evaluated in68 part by the “accessibility of [their proposed] dispensing facilities, e.g., centrally located to69 several populated areas, located on a main roadway…,” (Rule 64-4.002(2)(c)11.a.,70 Florida Administrative Code). The state regulation also requires that applicants71 demonstrate “the ability to obtain zoning approval” (Rule 64-4.002(2)(c)3., Florida72 Administrative Code); and73 74 WHEREAS, this requirement that applicants demonstrate ability to obtain zoning75 approval has resulted in a number of requests for a determination of how a dispensing76 organization’s “dispensing facility” is categorized for purposes of the city’s table of77 allowable [zoning] uses at Part1B, Chapter 58, Code of the City of Orlando, Florida (the78 “Orlando City Code”); and79 80 WHEREAS, section 58.200, Orlando City Code, provides, in part, that “[i]n the81 event of uncertainty or where there is not a particular land use category listed anywhere82 in [Chapter 58] that corresponds with a use in question, then the use in the Chapter83 having the most similar characteristics, as determined by the zoning official, to the use in84 question shall apply”; and85 86 WHEREAS, on June 18, 2015, the zoning official issued official determination87 LDC2015-00245 concluding that “’dispensing facilit[ies]’ under the Compassionate Use88 Act [are] most similar to a ‘Drug Store,’ being defined by Chapter 66, Orlando City Code,89 as ‘[a] Light Retailing Use where the primary business is the filling of medical90

ORDINANCE NO. 2016-58 Page 3 of 6 Marijuana land use moratorium 2016 2.docx CODING: Words stricken are deletions; words underlined are additions; **** denote omitted text. prescriptions and the sale of drugs, medical devices, medical supplies and91 nonprescription medicines, but where non-medical convenience items may be sold as92 well’”; and93 94 WHEREAS, since this determination was issued, the Compassionate Use Act95 has been amended to legalize the cultivation, production, and dispensing of medical96 cannabis to eligible patients as defined by section 499.0295, Florida Statutes; and97 98 WHEREAS, in November of this year, Florida voters will decide whether to99 amend the Florida Constitution to legalize the cultivation, production, and dispensing of100 medical cannabis for a broader population of eligible patients; and101 102 WHEREAS, Florida laws relating to the cultivation, production, and dispensing of103 cannabis products are rapidly changing – raising substantial questions about whether104 cannabis-related land uses, as a category of commercial use, may have deleterious and105 negative secondary effects on surrounding land uses and communities; and106 107 WHEREAS, the purpose of this ordinance is to place a temporary moratorium on108 the opening of certain new cannabis dispensing facilities, and on the expansion or109 relocation of certain existing cannabis dispensing facilities; and110 111 WHEREAS, the Orlando City Council hereby finds that the temporary moratorium112 imposed by this ordinance is being imposed for a reasonable duration intended to give113 the city the time reasonably necessary to investigate the impacts of cannabis dispensing114 facilities, and if necessary, to promulgate reasonable regulations relating to such115 establishments; and116 117 WHEREAS, the Orlando City Council hereby finds that this ordinance advances118 an important government purpose by reducing the likelihood of the unregulated negative119 secondary effects of cannabis dispensing facilities; and120 121 WHEREAS, the Orlando City Council hereby finds that this ordinance is in the122 best interest of the public health, safety, and welfare; and123 124 NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY125 OF ORLANDO, FLORIDA:126 127 SECTION 1. FINDINGS OF FACT. The foregoing recitals are hereby ratified128 and confirmed as being true and correct and are hereby made a part of this ordinance.129 130 SECTION 2. DEFINITIONS. For the purposes of this ordinance, the following131 words, terms, and phrases, including their respective derivatives, have the following132 meanings:133 134

Cannabis means all parts of any plant of the genus Cannabis, whether135 growing or not; the seeds thereof; the resin extracted from any part of136 the plant; and every compound, manufacture, salt, derivative, mixture,137 or preparation of the plant or its seeds or resin.138 139 b. Cannabis dispensary means an establishment where derivative140 product of the cannabis plant, except for low-THC cannabis, is141 dispensed at retail.142 143 c. Derivative product means any form of cannabis suitable for routes of144 administration.145 146 d. Low-THC cannabis means a plant of the genus Cannabis, the dried147 flowers of which contain 0.8 percent or less of tetrahydrocannabinol148 and more than 10 percent of cannabidiol weight for weight; the seeds149 thereof; the resin extracted from any part of such plant; or any150 compound, manufacture, salt, derivative, mixture, or preparation of151 such plant or its seed or resin that is dispensed only from a dispensing152 organization approved by the Florida Department of Health pursuant to153 section 381.986, Florida Statutes.154 155 e. Low-THC cannabis dispensary means an establishment where low-156 THC cannabis is dispensed at retail.157 158 SECTION 3. TEMPORARY MORATORIUM. Beginning on the effective date of159 this ordinance and continuing through December 31, 2016, or sooner if provided160 pursuant to section 4 of this ordinance, a moratorium is hereby imposed on the opening161 of new cannabis dispensaries and low-THC cannabis dispensaries and on the expansion162 or relocation of existing cannabis dispensaries and low-THC cannabis dispensaries.163 164 a. During the moratorium, it is unlawful and a violation of this ordinance165 for any person, firm, or corporation to open or cause to be opened any166 cannabis dispensary or low-THC cannabis dispensary within the City of167 Orlando, except that low-THC cannabis dispensaries already approved168 by official determination of the city zoning official may open and169 conduct business in accordance with the official determination.170 171 b. During the moratorium, it is unlawful and a violation of this ordinance172 for any person, firm, or corporation to relocate or cause to be relocated173 any cannabis dispensary or low-THC cannabis dispensary within the174 City of Orlando.175 176 c. During the moratorium, it is unlawful and a violation of this ordinance177 for any person, firm, or corporation to expand or cause to be expanded178

For purposes of this subsection, the term “expand”180 means to “enlarge the physical size of.”181 182 SECTION 4. EXPIRATION OF THE TEMPORARY MORATORIUM. The183 temporary moratorium imposed by section 3 of this ordinance expires as of the earliest184 of the following occurrences:185 186 a. January 1, 2017; or187 188 b. A date before January 1, 2017, if provided by ordinance of the Orlando189 City Council.190 191 SECTION 5. RECOMMENDATIONS FOR LAND DEVELOPMENT192 REGULATIONS. The planning official is hereby directed to study, develop, and193 recommend land development regulations for cannabis dispensaries and low-THC194 cannabis dispensaries in the City of Orlando, with such recommendations being195 delivered to the Orlando City Council by no later than December 1, 2016.196 197 SECTION 6. PENALTIES. Violations of this ordinance are punishable as198 provided by section 1.08, Code of the City of Orlando, Florida.199 200 SECTION 7. SEVERABILITY. If any provision of this ordinance or its201 application to any person or circumstance is held invalid, the invalidity does not affect202 other provisions or applications of this ordinance which can be given effect without the203 invalid provision or application, and to this end the provisions of this ordinance are204 severable.205 206 SECTION 8. REPEAL. All ordinances, resolutions, official determinations or207 parts thereof previously adopted or entered by the city or any of its officials and in208 conflict with this ordinance are hereby repealed to the extent inconsistent herewith.209 210 SECTION 9. SCRIVENER’S ERROR. The city attorney may correct scrivener’s211 errors found in this ordinance by filing a corrected copy of this ordinance with the city212 clerk.213 214 SECTION 10. EFFECTIVE DATE.
