A number ofthose laws, clearly --- and often deceptively --- designed to carve out blatant partisan advantage for theGOP next year, were examined during a recent hearing by the U.S. Senate Judiciary Subcommittee onthe Constitution, Civil Rights and Human Rights. The video of the hearing on "New State Voting Laws:Barriers to the Ballot" can be viewed here.This is the second of our two-part analysis of the hearing.In Part 1, we covered the subcommittees examination of new polling place photo ID restrictionsdesigned to make it more difficult for lawfully registered (and disproportionately Democratic-leaning)voters to cast their ballots at the precincts on Election Day. That issue --- which included somedevastating cross-examination of long-time GOP "voter fraud" front-man Hans Von Spakovsky by Sen.Al Franken (D-MN) --- was the first of three categories, as defined by committee chair Sen. DickDurbin (D-IL) of new state voting laws covered in the hearings. All of the new voter suppression lawshave been recently rammed through Republican-majority statehouses across the country.In this concluding piece, we will cover the two additional categories examined: laws erecting barriersto the ability of individuals and non-partisan, non-governmental organizations to offer convenientregistration for new voters and laws imposing significant reductions on early voting periods. Todd Rokita(R-IN) proved specious, at least one can say there was an attempt made to defend them.But not one word was offered either by these witnesses or by the Republicans on the Subcommittee ---Lindsay Graham (R-SC) and John Cornyn (R-TX) --- in defense of either the new laws restricting the
    • ability of individuals or non-governmental groups to register new voters, or for the new laws designedto reduce the window of opportunity to vote during the early voting period prior to Election Day.On the other hand, there was a great deal of information offered during the hearing on how these newlaws would present obstacles to increased democracy.On the matter of voter registration, Loyola Professor Paul Levitt offered this in his written testimony[PDF], as quoted from the case League of Women Voters of Florida v. Cobb:"[V]oter registration drives entail core political speech, protected by the First Amendment andinextricably intertwined with efforts to persuade others to vote, educate potential voters aboutupcoming political issues, communicate their political support for particular issues, and otherwise enlistlike-minded citizens in promoting shared political, economic, and social positions."In Cobb, a federal court struck down draconian restrictions and penalties in a 2005 FL law that were sosevere that they caused the non-partisan League of Women Voters of FL, for the first time in its 67 yearFL history, to shut down voter registration. The court ruled that the 2005 FL statute imposedimpermissible restrictions on political speech and association.Undaunted, this year the GOP-controlled FL legislature enacted HB 1355, whose restrictions on voterregistration and penalties are so severe that both the League of Women Voters of FL and DemocraciaUSA have been forced to cease all voter registrations in the Sunshine state.Levitt notes that, under HB 1355, a group or individual lacks the free speech right to engage in voterregistration until they "have been issued a number by the state," adding [emphasis added]:Before offering to touch a voter registration form from anyone other than a family member, citizensvolunteering their time must wait for permission from the government. In addition to tracking each andevery registration form, blank or complete, a volunteer collecting a registration form must ensure that itis delivered to county officials within 48 hours, or face substantial fines.So much for the purported Tea Party concerns about "Big Government."Levitt goes on to report that the new law affects not only new voters but those who move and need tore-register. Per the "U.S. Census Bureaus Current Population Survey," Levitt adds, "minority citizensdisproportionately register...through voter registration drives."While FL has enacted the most severe restrictions on voter registration in the nation, it is not alone.Levitt notes that TX has enacted similar restrictions, and the GOP in Maine passed a law ending their34 year tradition of Election Day registration. Disproportionate numbers of African-
    • Americans and Hispanics voted on the final Sunday in previous elections.Georgias new law is more restrictive still, in closing on the Friday before Election Day, while Ohiosnew law shortens early voting by two weeks and eliminates voting during the last three days prior tothe election.If opponents of the new Ohio law gather 231,300 signatures by Sept. 29, Ohios new restrictions onearly voting will be suspended through the 2012 election.Levitt, among others, testified that early voting offers local election officials the flexibility to reduceovertime, long lines and chaos on Election Day. It has been wildly popular in many jurisdictions,particularly for Democratic-leaning voters.Pre-clearance under the Voting Rights ActWhen Congress initially passed, and President Lyndon Johnson signed the Voting Rights Act of 1965, itincluded a provision (Section 5) which, as described by the Department of Justice (DoJ), "freezeselection practices or procedures in certain states until the new procedures have been subjected toreview, either after an administrative review by the United States Attorney General, or after a lawsuitbefore the United States District Court for the District of Columbia."Congress determined that case-by-case adjudication was not enough to protect voting rights under the15th Amendment, so certain jurisdictions with a past history of discrimination must demonstrate thatnewly enacted voting laws are neither intended to discriminate on the basis of race nor have the effectof denying or abridging the right to vote on the basis of race.As the U.S. Supreme Court explained in South Carolina vs. Kazenbach, case-by-case adjudication wasnot only expensive, but Southern election officials would evade the impact of court orders by closing"their registration offices to freeze the voting rolls" or simply "switch to discriminatory devices notcovered by the federal decrees."Viewed in that light, the new spate of voter suppression laws might reasonably be seen as an effort toerect new "discriminatory devices."On Friday, for example, as The BRAD BLOG detailed, the DoJ declined pre-clearance for newredistricting signed off on by GOP Presidential front-runner Governor Rick Perry in the state of Texas,charging the new maps intentionally discriminated against Latino and African-American voters. Theyfound the new redistricting maps were "adopted, at least in part, for the purpose of diminishing theability of citizens of the United States, on account of race, color, or membership in a language minoritygroup, to elect their preferred candidates of choice to Congress."(The DoJs Voting Unit also had additional questions about the discriminatory effect of the Lone StarStates new polling place Photo ID restrictions as well, suggesting that pre-clearance may be denied forthat law too.)Although periodic challenges to the constitutionality of Section 5 have failed, new challenges havearisen in the wake of a statement made by the U.S. Supreme Court in Nw. Austin Mun. Util. Dist. No.One v. Holder (2009) that Section 5s "preclearance requirements and its coverage formula raise seriousconstitutional questions."
    • On Sept. 21, in Shelby County vs. Holder [PDF] U.S. District Court Judge John Bate issued a 151-pageopinion that squarely addressed the issue of Section 5s continued validity.Shelby County contended that, in re-authorizing the Voting Rights Act in 2006 with an overwhelmingbi-partisan majority, Congress failed to take into account the substantial improvements that haveoccurred in the "covered" jurisdictions over the past 45 years. Judge Bates disagreed. The D.C. DistrictCourt upheld the constitutionality of Section 5 on the basis of a Congressional finding in its 2006extension of the VRA that discrimination has continued into the 21st Century --- a finding that wassupported by a Congressional record that was more than 15,000 pages in length and included "statistics,findings by courts and the Justice Department, and first-hand accounts of discrimination.""Congress acts at the pinnacle of its enforcement authority," the court stated, "when it legislates toprotect a fundamental right, or when it legislates to prohibit discrimination against a suspect class.Congress did both."Shelby County vowed an appeal. Edward Blum of the Orwellian-named Project for Fair Representation(PFR), which has helped fund the constitutional challenge to Section 5, said:To require today that only southern states should be burdened with a federal statue concerning electionsis wrong.Blum is wrong for a number of reasons, among them, jurisdictions that are "covered" by Section 5 arenot limited to "southern states." They include AZ, as well as several counties in SD, NY & CA and anumber of townships in MI & NH.But facts may not be quite as important as the political objectives of PFR. According to tax disclosureforms examined by Karoli at Crooks & Liars, PFR is funded and controlled by Donors Trust, LLC, "atax-deductible slush fund" whose key players include Koch Industries. They contend that PFR is a"union-busting, voter ID, minimum wage, public school attacking project."Arizona has filed a separate lawsuit challenging the constitutionality of Section 5. That legal challengeis pending before Judge Bates, the same judge who proffered the Shelby County decision.In his 151-page ruling, Judge Bates cited "a 2004" study which revealed "a significant disparitybetween voter turnout of Hispanics and Anglos." Bates also "cited evidence presented to Congress in2006 when it renewed the Voting Rights Act, of men (in Arizona) wearing military or tool belts andblack T-shirts reading U.S. Constitutional Enforcement approaching Latinos waiting in line to vote,demanding proof of citizenship."13 hours ago · Like SUBMIT•Andrew Williams JrThe ACLU, which intervened in Shelby County, argues that the recent spate of voter suppression lawssuggests "the need for Section 5 is perhaps greater now than it has been in decades."While they did not specifically address the issue at their 09/08/11 hearing, perhaps the Senate Judiciarysubcommittee should consider whether expansion of Section 5 to all jurisdictions which have adopted
    • photo ID restrictions, or other forms of voter suppression, should be the subject of future hearings.In an exchange of emails with The BRAD BLOG, Prof. Levitt explained that jurisdictions subject topre-clearance can seek it either from the DoJ or file directly with a three judge panel in the U.S. DistrictCourt in DC. A three-judge panel decision is subject to a direct appeal to the U.S. Supreme Court.FL has sought to by-pass the DoJ by seeking pre-clearance for their new laws restricting voterregistration and early voting directly from a U.S. District Court panel. The League of Women Voters ofFlorida and Democracia USA have now filed a motion to intervene in the federal lawsuit in order tochallenge the controversial provisions of the Sunshine States new restrictions on the right to registerand vote.Harder to register, harder to cast a ballot, harder to have it countedDuring her testimony, witness Judith Browne Dianis, civil rights litigator & co-director of TheAdvancement Project, noted one additional category which might have been examined by theSubcommittee: Election Day barriers by Republican-supported and Republican-sympathetic"reactionaries".As she explained...Reactionaries have announced plans to place millions of challengers at the polls in 2012 to challengevoter eligibility in ways that may intimidate voters and disrupt polling place operations.Dianis further charged during her testimony that, "collectively," the new assault on voting rightsreflects a coordinated effort at "voter suppression, making it harder to register to vote, harder to cast aballot and harder to have a vote counted."These new laws, she said, are "the largest legislative effort to roll back voting rights since the post-Reconstruction era."Neither is it by accident or coincidence.The fact that Paul Weyrich was a co-founder of ALEC, the billionaire-funded organization that hasdrafted the models for these voter suppressing laws is significant."I don’t want everybody to vote," Weyrich admitted while addressing a right-wing Christian audiencein 1980 (see haunting video at right). "[O]ur leverage in the elections goes up as the voting populacegoes down," he added after denigrating those who seek "good government" through maximum,informed voter participation as people who suffer from the "goo goo syndrome.""Americans should be outraged that across the country efforts are being undertaken to make votingharder and to silence them," Dianis said. Listen here.]Michael Slater of Project Vote alleged that, in 2004, he and other groups approached von Spakovsky atthe DoJ with physical evidence that public-assisted agencies were failing to offer voter registration totheir mostly poor and minority clients in violation of the National Voting Registration Act of 1993.Spakovsky said "thats interesting," before proceeding to take no action.In the midst of the U.S. Attorney firing scandal, Joseph Rich, who served 35 years in the U.S. JusticeDepartment "enforcing civil rights laws," penned an Los Angeles Times editorial in which he accusedBush appointees to the DoJ of having "ignored the advice of its staff and skewed aspects of lawenforcement in ways that clearly were intended to influence the outcome of elections."As Rich observed at the time:From 2001 to 2006, no voting discrimination cases were brought on behalf of African-American orNative American voters. U.S. attorneys were told instead to give priority to voter fraud cases, which,when coupled with the strong support for voter ID laws, indicated an intent to depress voter turnout inminority and poor communities.As The BRAD BLOG later reported, Rich charged, "Mr. von Spakovsky was central to theadministrations pursuit of strategies that had the effect of suppressing the minority vote." That effortincluded a role in the political decision to override career DoJ lawyers who believed Voting Rights Actpre-clearance for Georgias photo ID law should be denied because of the potential retrogressive impacton African-American voters --- an issue that von Spakovsky sought to deceptively evade during thequestion-and-answer portion of the 09/08/11 hearing.Most significantly, emails revealed that von Spakovsky, who temporarily served at the U.S. ElectionAssistance Commission (EAC) as a Bush recess appointee, attempted to influence the content of EACreports, expressing a desire that "proper balance" needed to be applied to comprehensive bi-partisanreports on "voter fraud" and photo ID, which showed that claims by GOP front groups (such as the"American Center for Voting Rights" or ACVR, as outed by this blog as such a front group) were

That, the study argues, is for an obvious reason. That type of fraudis incredibly difficult, fraught with risk, and all for the possible gain of one single vote:To steal even one vote by impersonation requires the impersonator to go to a precinct where he will notbe recognized and the registered voter he intends to impersonate will not be recognized. Theimpersonator has to know that the registered voter has not already voted either in person or byabsentee...Testifying at the 09/08/11 hearing, Rep. Todd Rokita (R-IN), who had served as the Hoosier States Sec.of State at the time it passed its photo ID restriction law, made the bald assertion that there is "a lot ofevidence" of voter fraud; that hed passed on several cases, but prosecutors declined to pursue them.As Levitt noted, photo ID supporters failed to offer a single case of voter impersonation fraudoccurring in IN when they presented their case to the U.S. Supreme Court in Crawford vs. MarionCounty Board of Elections. Moreover, it is not just the absence of prosecution but the absence oflegitimate allegations which can withstand even minimal scrutiny.In his written testimony, Levitt revealed that, since 2000, there were "nine allegations of votes [ingeneral elections] that might have involved votes cast by individuals impersonating others," but thosenine may be the result of "poll worker error or voter confusion...During the same period, 400 millionvotes were cast...Even assuming that each of the nine votes were fraudulent, that amounts to a relevantfraud rate of 0.000002 percent.     • SUBMIT•Andrew Williams Jr Deliberate deception: Franken vs. von SpakovskyIn his sworn Congressional testimony, von Spakovsky, citing a study by the Universities of Delawareand Nebraska, made the bald assertion that photo ID laws do not affect voter turnout in elections. Hejoined Rep. Rokita in pointing to an increase in African-American turnout in the state of Indianabetween the 2004 and 2008 general elections. He also pointed to a similar increase in GA in 2008where a similarly restrictive law had been implemented. He later added that GA, which enacted photoID restrictions following the Supreme Courts approval of the Indiana law, had a larger increase inAfrican-American voter turnout in 2008 than did Mississippi, a state which had no such law at the time.But there are just a few problems with the numbers from both von Spakovsky and Rokita.Prof. Levitt chided von Spakovsky for using numbers that would cause him to "fail statistics 101 at justabout any college in the country." (In his written testimony, Levitt also slammed the "tea leaf reading"analysis provided in the cited "study" --- "The Empirical Effects of Voter-ID Laws" (2009) [PDF],which relies upon data from elections that predate INs photo ID law, offers no objective facts about thenumbers and demographic make-up of registered voters who lack photo ID or difficulties in obtaininggovernment issued photo ID in a given state, and which, on the basis of perceived "socio-demographicand political motivational factors," merely projects the belief of three political science professors thatphoto ID "laws should have little or no effect on aggregate or individual-level turnout.")Spakovskys case relies on a basic misconception, known as "the correlation/causation fallacy," whichleads him to erroneously associate increased turnout with the addition of photo ID restrictions.As Levitt explained:Mr. von Spakowsky supports photo ID restrictions. I oppose them. Mr. von Spakowsky has no facialhair. I have them. But certainly, opposition to photo ID does not cause facial hair.Levitt said the 2008 election was "a bad example." For the first time in decades, both GA and IN werebattleground states. For the first time in history, an African-American was a Democratic candidate forPresident. The fact that a given state had an 18% increase in African-American turnout in suchcircumstances does not, of itself, preclude the possibility that the turnout may have resulted in a 35%increase but for the polling place photo ID restrictions.Turnout numbers, of themselves, do not permit any conclusions to be drawn about the impact of photoID, as Sen. Al Franken (D-MI) deftly highlighted.Franken found von Spakowskys comparison between GA and MS especially troubling. The Senatorexpressed his belief that, by citing the increase in African-American turnout in GA relative to MSwithout considering that "the Black population in Georgia grew at three times the rate in Mississippi"during the relevant period, von Spakovsky had not merely used shoddy statistical analysis, but hadattempted to create "an inference that wasnt true."Observe this embarrassing, and crushing exchange between the two, as highlighted by Talking PointsMemo (see a video excerpt at right).:"For example, Mississippi, a state with a large African-American population just like Georgia, there

"Do you know how much Mississippi grew in termsof black population during those years versus Georgia?""I dont," said von Spakovsky."Wouldnt that have to factor into the significance of that?" Franken said. "Heres my question: you dida study and you put in your testimony that it was significant that the percentage of black voters grewmore in Georgia than Mississippi and you just cited it again. I would think that, as someone who writesstudies, it would be significant to know that the black population grew at more than four times the ratethan the black population in Mississippi, and Im wondering how you didnt factor that in," he said.(Franken later corrected himself to say that the black population in Georgia grew at more than threetimes the rate.)Franken said that von Spakovsky left out a crucial piece of data."I think thats creating an inference, and either you knew it or you didnt know it, but I think you shouldhave checked it out," Franken said. He also suggested that false voter fraud allegations erodeconfidence in the voting system.And then there was this colloquy, when von Spakovsky simply tried to evade Frankens direct questionas to whether GA photo ID law has a disproportionate impact on African-Americans...SEN. FRANKEN: In 1982 Congress amended the Voting Rights Act to prohibit not just votingpractices with a discriminatory intent, but also those practices that disproportionately hurt minorityvoters, regardless of intent...Weve heard some very persuasive evidence from your fellow witnessesthat these laws, from photo ID laws, to restrictive registration laws disproportionately hurt minorityvoters. Do you think that they comply with the letter and the spirit of the Voting Rights Act…?MR. VON SPAKOWSKY: I would agree with Judge Harold Murphy who was a federal judge in GAwho found that in fact Georgias voter ID law was not discriminatory...PROF. LEVITT: The court did find that there was no violation of Section 2 of the Act...The court didnot have a chance to address [Section 5 of the Voting Rights Act] because the Department of Justice isthe only entity that has a chance to address it if it signs off …That was a very controversial pre-clearance exercise. I believe that there was a [70-page] staff memo...recommending that the law not bepre-cleared, and then, the very next day, the law was pre-cleared without objection.Von Spakowsky was well aware of the vital distinction between Section 2 "discriminatory intent" andSection 5 "retrogressive effect." After all, he was one of the Bush appointees who ignored therecommendations of the career DoJ staff contained in that 70-page memo which had recommended thatthe DoJ deny pre-clearance for GAs polling place photo ID restrictions. He knew that the DoJ pre-approval cannot be challenged in court and, therefore, was not an issue that had been placed beforeJudge Murphy.In short, von Spakovsky tried to deceive the U.S. Senate. Graham predicted pollingplace photo ID restrictions were "the future of this country."Both Rokita and von Spakovsky claimed that no legitimate voters had been prevented from voting byIndianas photo ID law, with von Spakovsky noting that no one had filed an "as applied" lawsuitchallenging the IN law.Both Sen. Durbin and Prof. Levitt noted that there had been no evidence of lawfully registered votersbeing prevented from voting by photo ID in Crawford because the challenge to the law was madebefore the statute went into effect (commonly referred to in law as a "facial" challenge).Levitt testified, "All states have some process to make sure that people are who they say they are beforethey vote." Those requiring government-issued photo ID, however, were a distinct minority becausemost states "know there are real live, eligible American citizens out there who simply do not have theID required in the most restrictive states."Where, Rokita and von Spakovsky made blanket statements about no one being denied the right tovote, Levitt provided specifics, including at least ten retired nuns in South Bend who were turned awayfrom the polls because they lacked the requisite government ID (we covered that issue at the time ithappened right here), and "many others among the 137 retired sisters...[who] were dissuaded fromvoting upon learning that several had been turned away.""Chris Conley, a 50-year-old veteran of the Navy and Marines, tried to vote in Indianas 2008 primary,but his Veterans Administration photo ID card did not have an expiration date," Levitt also noted,adding, "I think its shameful to conceive of even one veteran who has served our country and watchedbrothers and sisters die to preserve others right to vote...turned away for no good reason."Messing with TexasFinally, for now, as explained by Rep. Charles Gonzales (D-TX), who had served as a state court judgefor more than a decade:TX holds bi-annual legislative sessions, which means few surprises. Yet, Gov. Perry declared voter ID alegislative emergency, calling it necessary to combat rampant voter fraud.Gonzales noted that this "emergency" was declared even though "the TX Attorney General in 2006 inhis press release which was entitled, Lets Stamp Out Vote Fraud in TX, couldnt name a single case offraud that would have been stopped by voter ID."Would it be too cynical to suggest that Perrys "emergency" was his need to help sew up his home statefor the 2012 Presidential election?[Once again, you can listen to Brad Friedman go head-to-head with von Spakovsky on the Tavis SmileyShow in 2008, discussing many of these exact same issues even back then, right here.]
