WHO CAN FILE A PATENT APPLICATION
By any person claiming to be the true and first inventor
By any person being the Assignee of the person claiming to be the true and first inventor
By the Legal Representative of any deceased person who immediately before his death was entitled to make such an application
WHERE TO FILE A PATENT APPLICATION
The appropriate office of the Patent office is decided among the below:
a. The applicant or first mentioned applicant in case of joint applicants for a patent, normally resides or has his domicile or has a place of business or the place from where the invention actually originated; or
b. The applicant for a Patent or party in a proceeding if he has no place of business or domicile in India, the address for service in India given by such application or party in situated.
