  • 7. Getting in trouble… in FIVE easy steps
  • 8. They must receive your annual 990 form- regardless of income #1-the IRS
  • 9.
    • 990N
      • $50K<
    • 990 or 990 EZ
      • $50K-$200K, assets $500K<
    • Full 990
      • $200K+, assets $500K+
    $50,000? One of the Two things you can be 100% sure of…
  • 10. NO 990 for three years?
  • 11. They must receive an annual 199 or 199N form from you #2-the Franchise Tax Board
  • 12. If you think the IRS is bad
    • The FTB is worse
  • 13.
    • Their rules are different.
    • You must file a return if you make
      • > $37,000 in any given year or
      • $25,000 in any one year
    • Unless, you are a pension plan, IRA, political party or church
    • AND you must file a notice if you dissolve or shut down
    NOTE
  • 14. Even though your income is tax free, other expenses are not #3-the Board of Equalization
  • 15. Things to watch out for: Paying sales and use tax on items or personal property Be careful with donated or homemade goods or gifts Do you need a sellers permit??
  • 16. Do you have Employees or Independent Contractors? #4-the Economic Development Dept. (EDD)

      • Everything must be registered within 30 days of receipt
      • Do you make more than $2M? If so you need an Independent Audit and committee & review of executive comp
      • Do you use commercial fundraisers? They must be registered- and you must notify the AG
