    the defendants put on even one witness to dispute the unity of these companies as they relate to Alb. Manor.Its like robbing a bank somebody has to drive the care somebody is putting the gun up to the teller at the window somebody is holding the doorIt would be impossible for you to say which company was responsible for what because they were all controlled by Danny Prince. - they covered each others debts - swapped funds - Danny Prince signing the Management for two of the companies. - D&P Management – enabling the operation to reduce its obligation to the state for unemployment insurance premiums. - acted cooperatively to run this nursing home.They intended to operate together, they shared in the profits, and they are properly considered a joint venture – whether they like it or not.The fact that these companies are separately incorporated, has not bearing on whether they, in this case, are considered to be acting jointly.It would be a grave injustice to not require them to be jointly responsible for paying this verdict. And understand, that is the purpose of the joint venture finding. -That each company is individually responsible for this verdict. - does not mean triple payments, - but if one company chooses to hide, another must pay the debt. You have seen the shape shifting this corporation can take on. Finding a joint venture is a tool you are being handed to ensure accountability of these corporations.

    Very interesting.In this courtroom, challenged the numbers with an operating budget, which when you added the nurse and restorative aides together, actually showed the staffing situation to be even worse than the numbers we had found in the defendant’s yearly comparison, in the “trial budget” documents.

    As we also know, the evidence of understaffing and ultimately neglect is on Pete Silva’s body.What do we know?For six weeks prior he was on seroquel, and during that time - gained three pounds - was still using his walker - had some continence, some incontinence - had some confusion, had some hallucinations, had some good times - entered Alb. Manor with no history of UTIs - no history for skin problems – skin intactThen enters AM - except for first day, largely ignored, no nurses notes in his record for every shift first three days, as required - 12 days later, pressure sore id-ed – stage II - then on the 28th, they fit him with a foley catheter for wound healing - first time he’s described as combative - rough timing, because it was only at this point that they’d finally gotten him arranged for therapy, which was d-qed because of how he was reacting to the foley - start monitoring his fluid intake – only 36% of what he needed (when well) being documented – barely enough to stay alive - then five days later, has a UTI – - after UTI, things become critical on the 5th – should have been transferred then - on the 6th, 7th, 8th, 9th, could have been getting him on IV fluids - did not – had dark amber urine reported on the 9th - 10th – all day, do nothing, until call family late evening – if don’t remove him, he’ll die - family asks for ambulance, arrive, none has been called - demand ambulance, not transported until 1:30 a.m. - what happened when arrived at the VA? If no understaffing,No pressure ulcerNo catheterizationNo UTINo severe dehydrationNO severe malnutritionNo renal failure

    Dr. Upson told usHe was….She determined – she, not the nurse, although nurse also wrote it down, but Dr. Upson, determined as part of her treatment of Pete that his were NEGLECT injuries – not connected to his underlying conditions

    So when they tell you - oh, if we were so bad, how come the state didn’t stop us? - you’ll know, its because they aren’t playing straight with anyone - not the state regulators - not the Silva family - not being straight in this courtroom

    making a point from voluminous information - each of these incidents described in a lengthy chart, but here showing them all on one screen, showing volume of death, period of notice, and similarity of enclosures where deaths occurred.
