SUMMARY Contracting Officer’s Technical Representative As the Contracting Officer’s Technical Representative (CORT) - Responsible for pre-award and post-award functions, including negotiation, price/cost analysis, and administrative oversight for services, materials, and equipment typically associated with military construction projects; involving specialized equipment, professional or technical services, and/or specialized construction; reviewing and analyzing requests for the procurement of complex equipment, utilities, services, and/or construction, sole source and other required clearances, and preparing documentation; preparing solicitation documents, incorporating specific provisions; analyzing proposals for conformance with the solicitation; conducting extensive negotiations before and/or after contract award; negotiating with potential contractors; administering complex contracts, including monitoring contractor's performance. Performing contract administrationfunctions for contracts typically extending over several years covering equipment, services, supplies, or other complex programs and contractor provided oversight services; Performing acquisition technical support, assistance, guidance, and policy interpretation involving annual, multiyear, and multi-functional contract management issues; Working with contracts of various types, study problems and propose solutions on complex matters such as: • establishment of billing rates and forward pricing rates as well as payment of cost vouchers and progress payments; • selection of subcontracting sources and issuance and definitization of contract change notices; • contract closure, issuance of consent to subcontract and obligations and removalof funds, allowability of costs; • Cost Accounting Standard (CAS)Changes and Noncompliance as well as negotiation of CAS cost impact statements; • contractor overtime, facility leases, government furnished property and pricing and financial analysis; • contract disputes as well as issuance and definitization of un-priced contractual actions; • accounting, estimating, compensation, purchasing, and insurance and pension system deficiencies. SCOPE OF RESPONSIBILITIES

Identifying potential contract cost overruns, and the need for future funding requirements; and advise the Contracting Officer (CO) of the need to initiate appropriate remedial action to avoid or minimize contractor delays. ROLES AND RESPONSIBILITIES Contracting Officer’s Technical Representative Planning for and assisting the CO and/or Regional staff in conducting post award conferences to ensure compliance with, and full understanding of, contractual requirements and to preclude unauthorized changes or alterations in contract provisions. Providing sound and well thought out contract advice and recommendations to regional personnel on a number of contract issues. Contracting Officer’s Technical Representative (COTR) U.S. Department of the Navy (DON) – Alameda Naval Aviation Depot Ensuring contractor’s compliance with CAS and other applicable laws and regulations which entails analysis and negotiation of noncompliance's with CAS requirements, or of accounting system changes and if no equitable agreement can be reached, advises the CO and prepares unilateral determinations (for CO signature) which, if appealed by the contractor are fully supported, justified, and defended before any tribunal.
    • 6. Evaluating the adequacy of contractor’s business management systems in terms of Government contracting requirements (may include insurance, estimating methods, pensions, employee compensation plans, purchasing and subcontracting procedures, and accounting methods, procedures, and practices). ROLES AND RESPONSIBILITIES Contracting Officer’s Technical Representative Analyzing and negotiating contractor overhead rates after developing the Government position on the reasonableness, allowability, and allowability of incurred costs. Reviewing and determining the allowability of costs claimed under cost contracts, including the evaluation of subcontractor claims. Preparing (for CO review and signature) official contract documents that incorporate “approved” contract modifications/requirements or settles issues that may develop after contract placement, e.g., equitable adjustments in price and/or delivery schedule for unilaterally directed changes in the work, for damages suffered by the Contractor due to late delivery or defective condition of Government property, for increases or decreases in taxes included within the contract price, or similar conditions. ROLES AND RESPONSIBILITIES Contracting Officer’s Technical Representative Contracting Officer’s Technical Representative (COTR) U.S. Department of the Navy (DON) – Alameda Naval Aviation Depot Reviewing the placement of subcontracts after considering elements such as the technical capability of prospective subcontracts, reasonableness of proposed costs, and profit or fee, type of contract, degree of competition, need for small and disadvantaged business involvement, disadvantaged business enterprises (DBEs), and compliance with applicable laws and contractual provisions. Developing and maintaining systems/processes necessary to evaluate and monitor contractual performance related to such areas as delivery, cost, amount of progress or advanced payments, incremental funding, and option exercises.
    • 8. ROLES AND RESPONSIBILITIES Contracting Officer’s Technical Representative Providing input to the Contracting Officer on the proper resolution and disposition of DCAA (and/or other cognizant auditor) audit reports. Contracting Officer’s Technical Representative (COTR) U.S. Department of the Navy (DON) – Alameda Naval Aviation Depot Consulting and coordinating with Agency specialists (such as the contracting officer, contract specialists, contracting officer technical representative (COTR), task order managers (TOM), engineers, realty specialists, quality assurance representatives, program offices, technical subject matter experts, general counsel, etc. and contractor personnel in order to obtain background information and develop sound conclusions and approaches.

ROLES AND RESPONSIBILITIES Contracting Officer’s Technical Representative Contracting Officer’s Technical Representative (COTR) U.S. Department of the Navy (DON) – Alameda Naval Aviation Depot Reviewing all Contractor submitted invoices (ARRA and Non- ARRA) for accuracy to: 1. Ensuring that the Contractor has included adequate supporting documentation for all cost/prices claimed in the performance of the specified contract. 2. Ensuring that Recovery Act funds have not been comingled by the Contractor with other agency funds, and verify that invoices clearly segregate and separately invoice for each project/task number/CLIN in accordance with FTA billing instructions
