The marriage acts of different religions are framed in the Indian constitution in accordance with their social and religious set up. <br />The Muslim Marriage Act has been framed keeping in mind the social ,religious and cultural traditions of the Muslims <br />
  3. 3. DEFINITION OF MARRIAGE<br />EDVARD WESTERMARCK defined marriage as “a more or less durable connection between male and female lasting beyond the mere act of propagation till after the birth of the offspring”<br />

  5. 5. ESSENTIAL FEATURES OF MUSLIM NIKAH<br />Only if both the parties are Muslim can the marriage take place under the Muslim marriage Act.<br />A Muslim marriage requires proposal from one party and acceptance from the other as is required for a contract<br />
  6. 6. DIVORCE<br />1. Talaq: which is release from the marriage tie immediately or eventually<br />2. Ila: where a husband of sound mind takes a vow that he will abstain from all relationship from his wife<br />3. Zihar:where husband sane and adult compares his wife to his mother or any other female within the prohibited degrees.<br />
