    Violations of Federal Fair Housing laws are investigated by HUD and/or the U.S. Attorney General.
    Penalties can range from $11,000 to $100,000, and are imposed by the Federal Courts.

    • Fair Housing Act of 1968 (Title VIII)
    • Housing and Community Development Act of 1974
    • Fair Housing Amendments Act of 1988
    • Equal Credit Opportunity Act of 1974 (Pertains to lending)
    The acts of 1968, 1974, and 1988 together are known as the Federal Fair Housing Law.

  • Exceptions to Federal Fair Housing Law
    • Owner-occupied buildings with no more than 4 units
    • Housing operated by organizations and private clubs that limit occupancy to members
    • Senior housing
    However, NO EXCEPTION is permitted to discriminate based on RACE or COLOR)
  • Prohibited Practices
    • Blockbusting – the act of encouraging people to sell or rent their homes by claiming that the entry of a protected class of people into the neighborhood will have some sort of a negative impact.
    Any message, however subtle, that the property should be sold or rented because the neighborhood is “changing” is considered blockbusting.

    Steering – the directing of home buyers to or away from particular neighborhoods.
    Don’t make assumptions!
    Let the buyer tell you where they want to live.
