Housing, 42 U.S.C. § 3631. Section 3631 of Title
42 makes it unlawful for an individual to use force

negotiating for any of the rights enumerated

service, organizations, or facility relating to the
sale or rental of dwellings.

interfere with any person who is assisting an

their housing rights. The offense is punishable by
a range of imprisonment up to a life term,
depending upon the circumstances of the crime,
and the resulting injury, if any.
Damage to Religious Property, 18 U.S.C. §
247. Section 247 of Title 18 prohibits anyone from
intentionally defacing, damaging or destroying
religious real property because of the religious
nature of the property, so long as the crime is
committed in or affects interstate commerce. The
statute also prohibits anyone from intentionally
obstructing or attempting to obstruct, by force or
threat of force, a person in the enjoyment of that
person's religious beliefs, where the crime is
committed in or affects interstate commerce.
Finally, the statute prohibits anyone from
intentionally defacing, damaging or destroying
any religious real property because of the race,
color, or ethnic characteristics of any individual
associated with the property, regardless of any
connection to interstate or foreign commerce.
Section 247 also prohibits attempts to do any of
the above. See Reports of the National Church
Arson Task Force.
The offense is punishable by a range of
imprisonment up to a life term or the death
penalty, depending upon the circumstances of the
crime, and the resulting injury, if any.
Deprivation of Rights Under Color of Law, 18
U.S.C. § 242. This provision makes it a crime for
a person acting under color of any law to willfully
deprive a person of a right or privilege protected
by the Constitution or laws of the United States.
For the purpose of Section 242, acts under \"color
of law\" include acts not only done by federal,
state, or local officials within the their lawful
authority, but also acts done beyond the bounds
of that official's lawful authority, if the acts are
done while the official is purporting to or
pretending to act in the performance of his/her
official duties. Persons acting under color of law
within the meaning of this statute include police
officers, prisons guards and other law
enforcement officials, as well as judges, care
providers in public health facilities, and others
who are acting as public officials. It is not
necessary that the crime be motivated by animus
toward the race, color, religion, sex, handicap,

familial status or national origin of the victim.
The offense is punishable by a range of
imprisonment up to a life term, or the death
penalty, depending upon the circumstances of the

Federally Protected Activities, 18 U.S.C. § 245.
The portion of Section 245 of Title 18 which is
primarily enforced by the Criminal Section makes
it unlawful to willfully injure, intimidate or interfere
with any person, or to attempt to do so, by force
or threat of force, because of that other person's
race, color, religion or national origin and
because of his/her activity as one of the following:
A student at or applicant for
admission to a public school or
public college;
A participant in a benefit, service,
privilege, program, facility or activity
provided or administered by a state
or local government;
An applicant for private or state
employment; a private or state
employee; a member or applicant for
membership in a labor organization
or hiring hall; or an applicant for
employment through an employment
agency, labor organization or hiring
hall;
A juror or prospective juror in state
court;
A traveler or user of a facility of
interstate commerce or common
carrier;
A patron of a public accommodation
or place of exhibition or
entertainment, including hotels,
motels, restaurants, lunchrooms,
bars, gas stations, theaters, concert
halls, sports arenas or stadiums.
This statute also prohibits wilful interference, by
force or threat of force, with a person because
he/she is or was participating in, or aiding or
encouraging other persons to participate in any of
the benefits or activities listed above without
discrimination as to race, color, religion, or

national origin.
The offense is punishable by a range of
imprisonment up to a life term, or the death
penalty, depending upon the circumstances of the
crime, and the resulting injury, if any.
Freedom of Access to Clinics, 18 U.S.C. § 248.
Section 248 of Title 18 protects the exercise of
free choice in obtaining reproductive health
services, and the exercise of First Amendment
religious freedoms. Section 248 makes it unlawful
for a person to use force, threat of force, or
physical obstruction to intentionally injure or
intimidate a person because he/she is or has
been obtaining or providing reproductive health
services. Section 248 also makes it unlawful for a
person to use force, threat of force, or physical
obstruction to intentionally injure or intimidate a
person because he/she is lawfully exercising the
right of religious freedom at a place of worship.
Finally, Section 248 makes it unlawful for a
person to intentionally damage or destroy the
property of a facility because it provides
reproductive health services, or because it is a
place of worship. Section 248 also prohibits
anyone from attempting to commit any of the

An offense under this statute is punishable by a
range of imprisonment up to a life term,
depending upon the nature of the offense and
whether or not it is a repeat conviction under this
statute.
Peonage, 18 U.S.C. § 1581. Section 1581 of Title
18 makes it unlawful to hold a person in \"debt
servitude,\" or peonage, which is closely related to
involuntary servitude. Section 1581 prohibits
using force, the threat of force, or the threat of
legal coercion to compel a person to work against
his/her will. In addition, the victim's involuntary
servitude must be tied to the payment of a debt.
Involuntary Servitude, 18 U.S.C. § 1584.
Section 1584 of Title 18 makes it unlawful to hold
a person in a condition of slavery, that is, a
condition of compulsory service or labor against
his/her will. A Section 1584 conviction requires
that the victim be held against his/her will by
actual force, threats of force, or threats of legal
coercion. Section 1584 also prohibits compelling
a person to work against his/her will by creating a

\"climate of fear\" through the use of force, the
threat of force, or the threat of legal coercion [i.e.,

which is sufficient to compel service against a
person's will.
Forced Labor, 18 U.S.C. § 1589. Section 1589
of Title 18, which was passed as part of the
TVPA, makes it unlawful to provide or obtain the
labor or services of a person through one of three
prohibited means. Congress enacted § 1589 in
response to the Supreme Court’s decision in
United States v. Kozminski, 487 U.S. 931 (1988),
which interpreted § 1584 to require the use or
threatened use of physical or legal coercion.
Section 1589 broadens the definition of the kinds
of coercion that might result in forced labor.
Trafficking with Respect to Peonage, Slavery,
Involuntary Servitude, or Forced Labor, 18
U.S.C. § 1590. Section 1590 makes it unlawful to
recruit, harbor, transport, or broker persons for
labor or services under conditions which violate
any of the offenses contained in Chapter 77 of
Title 18.
Sex Trafficking of Children or by Force, Fraud,
or Coercion, 18 U.S.C. § 1591. Section 1591
criminalizes sex trafficking, which is defined as
causing a person to engage in a commercial sex
act under certain statutorily enumerated
conditions. A commercial sex act means any sex
act, on account of which anything of value is
given to or received by any person. The specific
conditions are the use of force, fraud, or coercion,
or conduct involving persons under the age of 18.
The punishment for conduct that either involves a
victim who is under the age of 14 or involves
force, fraud, or coercion is any term of years or
life. The punishment for conduct that involves a
victim between the ages of 14 and 18 is 40 years.
Unlawful Conduct with Respect to Documents
in Furtherance of Trafficking, Peonage,
Slavery, Involuntary Servitude, or Forced
Labor, 18 U.S.C. § 1592. Section 1592 makes it
illegal to seize documents in order to force others
to work. By expanding its coverage to false
documents as well as official documents, § 1592
recognizes that victims are often immobilized by
the withholding of whatever documents they
possess, even if the documents are forged or
fraudulent. Section 1592 expands the scope of
federal trafficking statutes to reach those who
prey on the vulnerabilities of immigrant victims by

Homestead Act of 1862
Summary
The Homestead Act of 1862 was passed by the U.S. Congress. It provided for the transfer of 160
acres (65 hectares) of unoccupied public land to each homesteader on payment of a nominal fee
after five years of residence; land could also be acquired after six months of residence at $1.25 an
acre. The government had previously sold land to settlers in the West for revenue purposes. As
the West became politically stronger, however, pressure was increased upon Congress to
guarantee free land to settlers. Several bills providing for free distribution of land were defeated in
Congress; in 1860 a bill was passed in Congress but was vetoed by President Buchanan. With the
ascendancy of the Republican party (which had committed itself to homestead legislation) and
with the secession of the South (which had opposed free distribution of land), the Homestead Act,
sponsored by Galusha A. Grow, became law. In 1976 it expired in all the states but Alaska, where
it ended in 1986.

REGARDING: SAINT PAUL HEROS FIRST-TIME HOMEBUYERS LOAN PROGRAM,
CITYWIDE
Requested Board Action
Staff is requesting the HRA Board of Commissioners to approve a first-time homebuyer loan
assistance program for heros as defined herein, purchasing homes in Saint Paul.
Background
The HRA Board of Commissioners adopted Resolution 09-01/28-06 approving the Take Credit!
mortgage credit certificate program which will provide up to $8,094,750 of federal tax credits to
qualified first-time homebuyers purchasing homes in Saint Paul. Pursuant to the guidelines of
Take Credit! , a homeowner may take 20% of their mortgage interest paid per year, for the life of
the mortgage loan, as a tax credit rather than as a exemption , thus receiving a dollar-for-dollar
reduction in taxes owed for the year. Program funding will be able to assist up to 130 first-time
homebuyers.
The government, health care and education sectors of our economy are experiencing challenges
never before confronted, both financial and otherwise. Yet these sectors continue to provide
quality services and safety for the citizenry due in large part to the dedicated commitment and
sacrifice of the workers providing service. In recognition of their efforts, Mayor Coleman and
Commissioner Helgen are proposing a loan program for first-time homebuyers in who work in
these sectors to make purchasing a home in Saint Paul more affordable to them. Specifically, the
loan program would be eligible to first-time homebuyers who are veterans or in the U.S. Armed
Forces, firefighters, emergency medical/technicians, paramedics, health care workers, police
officers, teachers and public employees. Up to $15,000 can be used for down payment
assistance, cover closing costs ,or buy down the principal on the mortgage. The interest rate on
loans will be 0% interest. No payments will be required. Repayment will be required when one
of the following occurs: primary mortgage is paid off, the homeowner no longer uses the home

as his/her primary residence, or when the home is sold, unless the borrower resides in the home
as their primary residence longer than 10 years. In this case, the loan will be forgiven. Details
regarding eligibility, specific loan terms, purchase price, and income limits are specified in
Attachment B of this report. The loan is a supplement and can only be used with the Take
Credit! MMC program as an added incentive to those who to choose to live in Saint Paul. The
program will be implemented by over 30 participating private mortgage lenders and will
officially go into effect April 21, 2009.
Budget Action
No budget action is necessary. The program will be funded by dollars previously earmark
though the Minneapolis-Saint Paul Finance Board for special assistance for first-time
homebuyers as part of the CityLiving single family mortgage program.
Future Action
None.
Financing Structure
The Saint Paul Heros First-time Homebuyer Loan Program must be used in combination with the
Take Credit! Program and any fixed-rate FHA, VA, RHS, Fannie Mae or Freddie Mac insured
loan product that is generally considered to be an “A” or “prime lending product” originated
through participating lenders.
Saint Paul Heros First-time Homebuyer Loan Program loans are not eligible for use with
subprime, interest-only, or balloon loans, or adjustable rate mortgages (ARMS).

REGARDING: ENDORSEMENT OF PROPOSED CHANGES TO THE MINNEAPOLIS/SAINT
PAUL HOUSING FINANCE BOARD’S LOW INCOME HOUSING TAX CREDIT
QUALIFIED ALLOCATION PLAN FOR 2010 – CITYWIDE
Requested Board Action
The purpose of this report is to request the Housing and Redevelopment Authority (HRA) Board
of Commissioners to endorse proposed changes to the Minneapolis/Saint Paul Housing Finance
Board’s Low Income Housing Tax Credit Procedural Manual and Qualified Allocation Plan for
2010.
The proposed changes are specifically identified in Article VII and Article VII of the Procedural
Manual which is referenced in Attachment B and Article IX of the Qualified Plan- Saint Paul
Selection Priorities which is referenced in Attachment C.
Background
The Federal Tax Reform Act of 1986 created the Low Income Housing Tax Credit (“LIHTC”)
for qualified residential properties to encourage the production of affordable, low-income rental
housing. The LIHTC provides a reduction in federal tax liability to owners and investors in
qualified low-income housing developments. The LIHTC is taken annually for ten years. In
order to take the LIHTC, the applicable building must comply with federally-imposed rent and
tenant income restrictions for 15 years with an extended use period of an additional 15 years. At
a minimum, at least 40% of the units must be affordable to and rented as such to households at or
below 60% of the area median income (AMI) or at least 20% of the units must be affordable to
and rented as such to households at or below 50% of AMI for the duration of the restricted
period.
The Minneapolis/Saint Paul Housing Finance Board (“Housing Finance Board”) is the sub-
allocator of the LIHTC offered to qualified housing developments located in Saint Paul through
the HRA Board and in Minneapolis through the Minneapolis City Council. As a sub-allocator,

the Housing Finance Board must annually publish a Tax Credit Procedural Manual (Manual) and
Qualified Allocation Plan (Plan). The Manual and Plan set the time line, process, and criteria by
which the Housing Finance Board chooses projects to receive the LIHTC.
In 2009, federal legislation authorized an enhanced higher credit amount. However, the federal
legislation had a sunset clause that was applicable only for 2008 and 2009. Consequently, the
2010 LIHTC allocation is reduced to reflect changes in federal legislation. Saint Paul’s LIHTC
allocation amount is now estimated to be $925,157 for 2010 compared to $969,212 for 2009.
Staff is proposing, based upon previous HRA Board action and discussions with HRA
Commissioners, certain amendments to the Plan which give selection preference to LIHTC
projects that support city initiatives.
Summary of Changes to the 2010 Low Income Housing Tax Credit Procedural Manual
As referenced in the Attachments, HRA staff recommends changes to the Low Income Housing
Tax Credit Procedural Manual as follows:
1. Add language in Submission Requirements for Carryover Agreements, Article VII (C) of
the Procedural Manual to require developers to submit a Tax Identification Number as
part of the LIHTC Carryover application.
2. Revise Article VIII (B) and Article VIII (D) to increase the special counsel fee from
$2,500 to $3,000. The special counsel fee is paid by the developer so that HRA can
determine whether the LIHTC applications comply with federal legislation.
3. Revise Article VIII (C) to make the LIHTC reservation deposit non-refundable in 2010.
Currently, the HRA receives a refundable reservation deposit of 1.5% of the tax credit
allocation amount for projects in Saint Paul prior to issuance of a reservation letter. This
proposed change can generate approximately $15,000 annually for HRA to cover HRA
operations related to affordable housing development.
4. Revise Article VIII (D) to make the Carryover Reservation Fee non-refundable in 2010.
Currently, HRA receives a refundable carryover reservation deposit equal to 1.5% of the
tax credit allocation amount when HRA issues a carryover allocation for projects in Saint
Paul. This proposed change may also generate approximately $15,000 annually for HRA
to cover HRA operations related to affordable housing development.

5. Revise Article VIII (F) to increase the physical inspection fee of LIHTC rental units
from $30 to $35. To comply with LIHTC regulations, physical inspections occur every
three years.
Summary of Changes to the Qualified Allocation Plan
HRA staff recommends changes to the Qualified Allocation Plan in order to reflect the priorities
of the HRA Board. In summary, the proposed changes include the following:
1. Under Saint Paul’s Selection Priorities, Article IX of the Plan will give increased priority
points to projects that preserve below market rate, subsidized, low-income housing. This
proposed change supports the city’s existing affordable housing stock.
2. Article IX will give priority points to projects that are located within 0.25 miles of a mass
transit stop adjacent to the Preferred Transit Network of the Transportation Plan of the
Saint Paul Comprehensive Plan or within 0.5 miles of the Phalen Corridor. This
proposed change supports redevelopment along the City’s major transit corridors.
3. Article IX will give priority points to projects with higher density housing built within the
Neighborhood Centers or Corridors as identified in the Land Use Plan of the Saint Paul
Comprehensive Plan. The proposed change supports new development in neighborhood
centers or corridors where housing, employment, shopping, and community amenities,
supported by transit, work together to meet the needs of the residents.
4. Article IX will give increased priority points to projects that received a tax credit
allocation in the prior year, but due to a shortage of credits in the prior year allocation,
these projects require an allocation of Credits to be financially feasible. This proposed
change reflects HRA Board priorities.
Future Action
Upon HRA Board endorsement of the proposed amendments to the Plan, the Housing Finance
Board will hold a public hearing on May 6, 2009 to consider formal adoption of the proposed
amendments. Applications for LIHTC will be due to the HRA on June 23, 2009. HRA staff will
request HRA Board action to allocate the 2010 LIHTC in August or September 2009.

All new construction projects must comply with the sustainable development standards known as
the Minnesota Overlay developed in coordination with Green Communities. All rehabilitation
projects must comply with the sustainable development standards known as the Interim Saint
Paul PED/HRA Sustainability Initiative.
Public Purpose
Annual approval of low-income housing tax credits promotes rental housing that is affordable to
Saint Paul residents with incomes at or below 60% of area median income.
Recommendation
Staff recommends that the HRA Board endorse the proposed amendments to the Low Income
Housing Tax Credit Qualified Allocation Plan for 2010 pursuant to the attached resolution.
