The last brief to reach the court before closing time yesterday was the one by the actual plaintiff in the case (aka the respondent in the appeal), which is by attorney Galen Robinson of Mid-Minnesota Legal Assistance on behalf of six low-income Minnesotans who receive state subsidies so they can afford special diets that their doctors say is necessary for their health. In the 2009 unallotments, Gov. Pawlenty scheduled that diet aid program for elimination. The plaintiffs succeeded at the district court in getting Judge Kathleen Gearin to issue a temporary restraining order (TRO) to keep the program going. The Supreme Court case that has generated all these briefs is an appeal by Pawlenty of that TRO. Thanks to Eric Black for Public Preview,Amicus.
