 Many unsuspecting homeowners have been the victims of unscrupulous contractors who have taken thousands
 of dollars from individuals in up-front payments and never completed the job.

 Many people are not aware that the Consumer Fraud Act has established a means to seek protection and
 damages from those who have abused the consumer’s rights through unconscionable commercial practices and
 unlawful acts which include deception, fraud, false pretenses, false promises, misrepresentation, or the
 knowing concealment, suppression or omission of any material fact with intent. It was designed to present
 deception, fraud or falsity whether by acts of commission or omission in the advertisement and sale of
 merchandise and real estate.

 The Consumer Fraud Act protects consumers even when contractors act in good faith.

 Consumer fraud may also result from technical violations such as the failure to obtain permits or from more
 obvious egregious acts by the vendor or contractor. Many times the consumer is unaware of any wrongdoing
 until he consults an attorney. The consumer’s best source for information when dealing with a potential
 circumstance involving consumer fraud is an attorney, not another contractor.

 Consumer Fraud in 2011
 Consumers in the State of New Jersey logged more complaints about faulty, poor or fraudulent home
 improvement work than anything else in 2011, according to the state Division of Consumer Affairs. The
 division reported receiving 937 complaints about home improvement work in 2011 alone. Among other
 complaints filed were 778 complaints about motor vehicles and 243 complaints related to credit card and debt
 collection.

 5 Signs of a Potential Home Improvement Scam
These are the 5 signs of a possible home improvement fraud:
1. Failure to provide proof of insurance.
2. Failure by home improvement contractor to display his registration number on all advertisements, business
documents and contracts.
3. Beginning work before obtaining permits from the municipality.
4. Deliver materials, begin work, or use any similar tactic to unduly pressure a buyer into a home improvement
contract.
5. Fail to state in the contract the dates or time period on or within which the work is to begin and be
completed by contractor.
