    5. What is the EPBD?
      • Energy Performance of Buildings Directive
      • Designed to tackle climate change by reducing the amount of CO2 produced by buildings via improvements in energy efficiency
      • Meet climate targets agreed under Kyoto Protocol
      • Introduced in the UK in Jan 2006, with a 3 year implementation period ending in Jan 2009

    6. Requirements of the EPBD
      • Residential Property :
        • Homes with 4 or more bedrooms marketed for sale will require an Energy Performance Certificate
        • EPC-will contain info on the property’s energy efficiency and estimated running cost
        • Certification will give a property an energy efficiency rating & includes advice of further cost effective improvements that can be made
        • All properties will have an EPC when constructed, sold or let.
        • Requirement for an EPC will be phased in for smaller properties as the number of accredited assessors increases

      • Commercial Property:
        • 2 types of energy certificate required for new and existing buildings
        • EPC required on construction, sale and lease of buildings
        • DEC required for public buildings >1000m2
        • EPC
        • EPC-All newly constructed non-dwellings will require an EPC and existing buildings with a floor area >500m2 will require an EPC when sold or rented. Ratings on EPC will be from A-G. A=Best, G=Worst
        • Increased requirement for an EPC for all non-dwellings, not just those over 500m2 (implemented Oct 2008)

        • DEC
        • Display Energy Certificate (implemented April 2008)
        • DEC-actual energy usage, not theoretical energy rating. Produced from energy usage over a 3 year period.
        • Required for public buildings >1000m2 or part occupied by public authorities/institutions providing a service (thus frequently visited)
        • Must be publicly displayed (from Oct 2008)
        • In addition to the requirement for an EPC
        • Renewed every year

    7. What type of buildings need an EPC/DEC?
      • EPC- Required upon construction, sale or lease for all non-dwellings from small high-street retailers & offices to larger scale commercial premises such as airports, warehouse and office blocks
      • DEC - All public authority buildings & institutions providing a public service with a floor area >1000m2, currently including council offices, schools, colleges, universities and hospitals.
      • Exemptions:
        • Places of Worship
        • Temporary buildings in use <2yrs (E.g. Site offices)
        • Low energy demand buildings such as agricultural buildings (E.g. Barns)
        • Stand alone buildings <50m2 (E.g. sheds & summer houses)

    8. When are EPC / DEC required?
      • DEC
        • required annually for all public buildings > 1000m2
        • Valid for 1 year
        • Advisory report on cost effective improvements is valid for 7 yrs
      • EPC
        • Valid for 10 yrs
        • Sales of dwellings where a home information pack is required-EPC no older than 12 months
      • Air Con installations above 250kW inspected every 5 years (from 4 th Jan 2009). Extended to those >12kW (4 th Jan 2009)
      • Boilers to be inspected following the guidelines in the following table

    9. Penalties
      • EPC
        • Failure to provide an EPC results in a penalty equal to 12.5% of the property’s rateable value. Estimates of penalties between £500-5000. Default penalty when above scenario cannot be applied is £750
      • DEC
        • Failure to provide a DEC results in a penalty of £500
        • Lacking possession of a valid Advisory Report is a £1000 fine
      • But- no direct incentives for inhabitants to take up improvements proposed in EPC

    11. Recasting of the EPBD-Oct 2008
      • European Commission & Parliament considered recasting the EPBD to introduce a number of key changes:
        • DEC to be displayed in buildings >250m2 that are occupied by a public authority
        • EPC to be displayed in commercial buildings >250m2 that are frequently visited by the public & where the EPC has previously been produced on the sale, rent or construction of the building
        • Energy performance of existing buildings of any size that undergoes major renovations to be upgraded in order to meet minimum energy performance requirements
        • Minimum energy requirements to be set in respect to technical building systems e.g. boilers, air con etc
        • Commission to establish common principles for definition of low & zero carbon (LZC) buildings. Definition to be determined by member states. UK targets: from 2016 all homes to be ZC
      • Endorsed by European Parliament in April 2009

    12. UK’s Position to recasting elements of the EPBD
      • Strongly supports proposed amendments
      • Pleased that the proposals in the recast reflect existing policy
      • Consultancy period ends 2 nd Oct 2009
      • However European Parliament intends to have agreements reached between governments in September 2009
