PURPOSE OF REQUEST FOR PROPOSALS The Houston-Galveston Area Council (H-GAC) has developed a Request For Proposals to select qualified Housing Construction Management Services contractor(s) to support housing rehabilitation, reconstruction, elevation, and demolition projects associated with the H-GAC Hurricane Ike Housing Program. Contractor(s) selected will be charged with providing Housing Construction Management Services for Housing Rehabilitation, Reconstruction, Elevation, Demolition, and/or Replacement of owner-occupied and rental housing units including the selection, procurement, and management of qualified general contractors. Additionally, the selected Housing Construction Management Services contractor(s) will be responsible for providing H-GAC with three (3) examples of house plans for review, all surveying of property sites, elevation certifications, permitting, and all documentation required in support of the Houston-Galveston Area Council Hurricane Ike Housing Program. The current budget for this program is approximately $11,000,000. 2. BACKGROUND The Houston-Galveston Area Council (H-GAC), through the Texas Department of Housing and Community Affairs (TDHCA), and the U.S. Department of Housing and Urban Development (HUD), is implementing a Housing Rehabilitation, Reconstruction, Elevation, Demolition, and/or Replacement of owner-occupied units program that will provide these services for approximately 100–200 homeowners whose homes received damage due to Hurricane Ike which made landfall on September 13, 2008. Homeowners do not directly receive funds under this program. H-GAC is responsible for the overall management of the selected Housing Construction Management Services contractor(s) under this Request for Proposals, and any future housing-related firms contracted for the Hurricane Ike Housing Program. Housing Construction Management Services under this contract will include Housing Rehabilitation, Reconstruction, Elevation, Demolition, and/or Replacement of single family dwellings including the selection, procurement, and management of qualified general contractors. Work will be conducted on wood frame or brick veneer (stick built) houses. Mobile homes are eligible for replacement only under this Request For Proposal. Examples of the types of repairs to be conducted include: roof replacement or repair, exterior siding, window replacement, minor rehabilitation, substantial rehabilitation, May 12, 2010 Page 1
  5. 5. Housing Construction Management Services – H-GAC Hurricane Ike Housing Program – RFP HGAC-CE-2010-5-0001 elevations, and in some cases demolition and reconstruction of the home. Repairs will be conducted on existing structures and home sites. Reconstruction will consist of the demolition of the existing structure or mobile home, and constructing a new home or the replacement of a mobile home on the existing home site. The majority of eligible homes within the H-GAC region are located in rural areas and small cities of the following: Austin County, Brazoria County, Matagorda County, Walker County, and Waller County. Construction activities currently have the following allowable cost limits (per residence project): • Minor Rehabilitation: $25,000; Substantial Rehabilitation: $85,000; Reconstruction/Replacement: $125,000; Elevation: $70,000. Minor and Substantial housing rehabilitation projects may also include (in addition to the $85,000), Elevation ($70,000) and any Additional Requirements where required under City Ordinance and/or the Americans with Disabilities Act (ADA) ($15,000); together with the total amount not to exceed $170,000. • Reconstruction assistance ($125,000) may also include Elevation ($70,000) and any Additional Requirements where required under City Ordinance and/or the Americans with Disabilities Act (ADA) ($15,000); together with the total amount not to exceed $210,000. H-GAC’s goal is to assist as many homeowners as possible through our program, and realize that many of the homes in our program will require Substantial Rehabilitation or Demolition and Reconstruction. H-GAC is continuing to identify eligible applicants, and do not currently have an approximate number count of homes, their geographic distribution, or the specific construction needs; therefore, can only estimate that between 100 and 200 households through this program. MANDATORY PRE-PROPOSAL MEETING H-GAC will be hosting a mandatory pre-proposal meeting. All Housing Construction Management Service contractors intending to submit a proposal must attend the meeting to receive detailed information about the H-GAC Hurricane Ike Housing Program, review of the Request For Proposal, discuss draw request procedures, and review home repair, reconstruction, elevation, and demolition issues. The meeting will be held at H-GAC, 3555 Timmons Lane, Houston, TX 77027. The meeting will be held on Wednesday, May 26, 2010 from 10:00 A.M. until Noon on the 2nd Floor in Conference Room “B”. Proposals submitted by vendors not attending the mandatory pre-proposal meeting will be considered non-compliant and will be rejected. 4. SCOPE OF WORK Housing Construction Management Services under this contract will include turn-key services to provide Minor and Substantial Housing Rehabilitation, Reconstruction, Elevation, Demolition, and/or Replacement of single family, rental, and mobile home dwellings including the selection, procurement, and management of qualified general contractors for approximately 100-200 homes. Repairs will be conducted on wood frame or brick veneer (stick built) houses and mobile homes. H-GAC will determine the type and size of housing to be provided. The H-GAC Hurricane Ike Housing Program requires that assisted housing units meet minimum federal property standards, referred to as Housing Quality Standards (HQS) and local health and safety codes at project completion. A copy of the HQS can be obtained on the RFP portion of the H-GAC website: www.h-gac.com . Based on the above, the selected Housing Construction Management Contractor(s) will be expected to: a. Advertise, solicit, procurement, and overall management of general contractors and subcontractors that will perform Minor and Substantial Housing Rehabilitations, Reconstructions, Elevations, Demolitions, and/or Replacement of May 12, 2010 Page 3

Develop single family house plans and specifications for general contractors to use for projects. H-GAC will approve at time of housing contract award. Review work write-ups, cost estimates, draw requests/approvals, and any other documentation related to each project. Management of required permitting, surveying, elevation certifications, demolitions, warranties, point of contact for homeowners, dispute resolution for homeowner and general contractor, and weekly reporting to H-GAC as required for TDHCA. c. When required, submit approved change orders and all supporting documentation to H-GAC prior to performing any specified work; d. Oversight management of construction and demolition debris disposal generated during the delivery of housing rehabilitation/reconstruction services; e. Ensure work performed satisfies all Housing Quality Standards (HQS), Southern Building Code (SBC) and the Construction Requirements for Single Family Affordable Housing for Minor and Substantial Housing Rehabilitations, Elevations, Reconstructions, and all other Federal, State, and Local construction, health and safety code requirements during and ending with project completion; f. Meet time requirements for the start and completion of the project as set forth in the contract; 5. PROJECT BUDGET The H-GAC budget for this program is approximately $9,000,000. As described above (Background, Page 2), the various construction services have the following budget caps (per project): Minor and Substantial Housing Rehabilitations: up to a maximum of $170,000; and Reconstructions and Replacements up to a maximum of $210,000. WARRANTY Proposals must include a narrative describing method to be used to obtain all warranty information, including items covered, items excluded, duration, and options for renewing from general contractors performing under the Housing Construction Management Services firm. 8. HOUSING CONSTRUCTION MANAGEMENT CONDITIONS The following Housing Construction Management Services conditions are required, but are not limited to: a. Maintain a solvent business that has the financial capacity to perform all functions described in this Request For Proposals; b. Maintain in force, insurance coverage at the level required by H-GAC, TDHCA and HUD (minimum of $1,000,000 liability insurance effective between the time of commencement of work under this program, and until such work is completed). Ensure that job sites, all materials, and equipment is secure; e. Comply with Conflict of Interest, Equal Opportunity, and Affirmative Action policies of H-GAC; f. Will not willfully misrepresent, defraud, or attempt to deceive homeowners, contractors, or H-GAC; g. Secure and provide evidence of a performance bond to cover services if contract exceeds $100,000; and h. Cooperate with homeowners, contractors, and H-GAC and maintain professional decorum at all times including job site visits. 9. PROPOSAL CONTENT H-GAC will not provide assistance to any prospective proposers in the preparation of this Request For Proposals. Proposals should include, but are not limited to, the following items: 9.1Statement Of Qualifications Provide a narrative summary of your firm’s qualifications as it relates to this RFP. To support the Statement of Qualifications, the following should be included in the response:  Company Overview – brief history of the company, service(s) provided, service areas, list of clients, size and contract dollar amounts of not less than two (2) projects.  Experience - how many years of experience you have, and the approximate number of similar projects/programs on which you have performed housing construction management services of this type; and specifically, if you have provided or participated in federally-funded projects/programs involving affordable housing activities. Housing Construction Management Services – H-GAC Hurricane Ike Housing Program – RFP HGAC-CE-2010-5-0001  Insurance - description of the types and coverage amounts of insurance you currently maintain.  Licenses and/or Registrations – description of any professional organization licenses and/or memberships which directly relate to this type of work.  Non-debarment - proof of non-debarment from federally-funded programs.  Describe any challenges anticipated to be encountered with housing rehabilitations/reconstructions in both rural areas and cities.  A general description on your readiness to proceed. 9.2 Capacity to Perform Provide examples of three (3); single-family house plans consisting of one house with two (2) bedrooms and two (2) bathrooms of approximately 1,000 SF; and, two houses with three (3) bedrooms and two (2) bathrooms of approximately 1,300-1,500 SF, display ability to produce work write-ups, project schedules, examples of general contractor management and associated issues regarding housing construction management, draw and change order request schedules, materials management forms, project photographs, timelines, construction inspection schedules, and any other details regarding your company’s capacity to perform the scope of work which will provide H-GAC with an overview of your management capacity. Also submit:  A sample work write-up for a single family home requiring minor to substantial rehabilitation.  A sample set of plans, specifications, cost estimates and draw schedule for reconstruction of a single-family, 2-bedroom, 2-bath home, and a sample set of plans, specifications, cost estimates and draw schedule for reconstruction of a single-family, 3-bedroom, 2-bath home. Housing Construction Management Services – H-GAC Hurricane Ike Housing Program – RFP HGAC-CE-2010-5-0001  Examples of your ability to simultaneously manage general contractors and their subcontractors performing housing rehabilitations and reconstruction activities on multiple sites and areas. 9.3 Affirmative Marketing Requirements H-GAC is an equal opportunity employer that encourages minority, women-owned businesses, and Historically Underutilized Businesses (HUBs) to submit bids for the participation in the services described above. All firms should describe their policies, procedures regarding outreach plans to minorities, women-owned businesses, and HUBs. Describe the actual hiring practices, including subcontracting processes as they relate to affirmative hiring and procurement. Describe outreach methods to be used for these organizations in the five (5) counties where housing rehabilitations and reconstructions are planned. 9.4 Proposed Cost of Services Interested parties should provide a proposed cost of services for qualification assessment that agrees with the proposed Scope of Work. Actual costs will be determined on a case- by-case basis. Project specific costs and rates will be submitted by the proposer for the following listed cost of services to allow proper evaluation of the response to this RFP. Examples of costs to be included with the response to this RFP include: • Turn-Key project-delivery costs including the administration of the Housing Construction Management Services contractor and its employees; • Cost examples for Minor housing rehabilitation of a typical 1,000-1,300 SF home including independent items such as: roofs, windows, and exterior siding (25%), interior walls/ceilings in 2-rooms; • Cost examples for Substantial housing rehabilitation of a typical 1,300-1,500 SF home including the above-bullet point items along with an additional bathroom May 12, 2010 Page 8

Housing Construction Management Services – H-GAC Hurricane Ike Housing Program – RFP HGAC-CE-2010-5-0001 repair/replacement; and another cost example including all above with flooring for two (2) rooms; • Cost examples to construct new single-family, 1,300-1,500 SF, 2 and 3-bedroom, homes with 2-bathrooms each including 1-car garages with a paved driveway (concrete foundations or pier and beam support where required); • Cost examples for new, 2 and 3-bedroom, single-family homes with 2-bathrooms each requiring elevation to six (6) feet; • Cost examples of the installation of a complete septic system; • Cost to connect an existing septic system, water lines, gas lines, and electrical distribution lines to existing infrastructure where existing. 9.5 Financial Condition Provide a copy of the firms most recently audited financial statement, a complete organizational chart, names of company ownership, board members, and the list of any current contracts awarded and contracts bid on but not awarded. Banking references may be provided for sole proprietorships, partnerships, or smaller firms if audited financial statements are not available. Housing Construction Management Service companies need to demonstrate the ability to secure and maintain a performance bond to cover contracted services if their contract exceeds $100,000. It is important to understand that payments for work will be made on a reimbursement basis, and that selected Housing Construction Management Service companies will need to have the fiscal capacity to conduct work on a reimbursement draw basis. General contractors contracted with the Housing Construction Management Service Company will receive their progress payments from the company. May 12, 2010 Page 9

Housing Construction Management Services – H-GAC Hurricane Ike Housing Program – RFP HGAC-CE-2010-5-0001 H-GAC will only reimburse the Housing Construction Management Service Company after all required documentation is submitted in a timely manner. 9.6 Delivery Schedule H-GAC anticipates simultaneous construction activities of up to twenty (20) homes at a time. Include an estimate of how quickly you can proceed with the advertisement and procurement of general contractors that will perform the housing rehabilitation and reconstruction services for clients once contracts are awarded. To demonstrate an understanding of the level of effort and time required to complete construction services, include a projected delivery schedule for the following construction service examples: • Contacting twenty (20) homeowners from lists provided by H-GAC; • Property site visits to discuss program specifics with homeowners; • Three (3) homes to receive minor rehabilitation; • Four (4) homes to receive substantial rehabilitation; • Thirteen (13) homes to be demolished and reconstructed; • Elevation of six (6) homes to ten (10) feet. • Time frame to begin rehabilitations and reconstructions; • Time frame to complete rehabilitations and reconstructions. Delivery schedule to be presented in days, weeks, or months (not man hours), and should be based on the Housing Construction Management Service company’s experience in completing minor and substantial housing rehabilitation and reconstruction projects. 9.7 References Submit at least three (3) references for whom you have provided housing construction management services involving housing rehabilitation and reconstruction activities during the past five (5) years. Submit at least three (3) references for institutional customers such as units of local government, state or federal agencies (i.e., TDHCA, HUD, Cities), or non-profit organizations, if available. References should include the following information: • name of company or government agency; • company contact information including name, title, telephone, and e-mail address; • brief description of the project; and, • completion dates of the projects. 9.8 Key Personnel One paragraph summaries of qualifications and experience should be submitted for all personnel assigned to the project. Detailed resumes should also be included in the Appendix. Qualification statements must be signed by a duly authorized official of the responding company, or organization. 9.9 Related Work Experience Provide detailed summaries for five (5) projects closely related to the Scope of Work. Include a summary of challenges you encountered, solutions, number of homes, budget, client and date of performance. 10. MODIFICATION OF PROPOSALS (Before Submission Deadline) Bidders may modify, withdraw, or resubmit proposals that have already been accepted by providing a written modification to H-GAC. However, no proposals may be modified, withdrawn, or resubmitted after the deadline for submission. H-GAC may amend this RFP before the submission deadline. Any amendments to this RFP, along with responses to contractor inquiries, will be posted on the H-GAC website by 5:00 P.M., Tuesday, June 1, 2010. 11. SELECTION PROCEDURE AND CONTRACT AWARD H-GAC anticipates no more than two (2) Housing Construction Management Services companies will be selected for the H-GAC Hurricane Ike Housing Program. The selection procedure is outlined below. • Compliant proposals will be reviewed and ranked accordingly by H-GAC and the Economic Development Program Manager will make a recommendation to the H-GAC Executive Director. • The Executive Director will make a final recommendation to the H-GAC Board of Directors. Upon approval by the Board of Directors, H-GAC will prepare contract documents for the Housing Construction Management Services Contractor(s). H-GAC will evaluate all proposals according to the criteria described in this document; and may, at its option, invite any respondents to make oral presentations, before a final ranking is completed. Top-ranked candidates may be requested to appear before the H-GAC Board of Directors, or Finance and Budget Committee. H-GAC may elect to issue an additional RFP for Housing Construction Management Services should the program and /or projects be expanded. 13. H-GAC will not pay for any expenses incurred prior to the execution date of a contract, and/or any expenses incurred after the termination date of the contract. All materials submitted to H-GAC, including any attachments, appendices, or other information submitted as a part of a proposal, are considered public information, unless otherwise noted in the proposal itself as a trade secret or proprietary information, and become the property of H-GAC upon submission and may be reprinted, published, or distributed in any manner by H-GAC according to open records laws, requirements of the U.S. Department of Labor and the State of Texas, and H-GAC policies and procedures. H-GAC is not responsible for the return of creative examples of work submitted. 14. INQUIRIES 14.1 Questions Concerning this RFP The Houston-Galveston Area Council will conduct a pre-proposal meeting on Wednesday, May 26, 2010. Potential vendor’s MUST attend this workshop to gain a deeper understanding about the H-GAC Hurricane Ike Housing Program, types of construction activities, documentation requirements, draw request and payment procedures, and other program specific items. Vendors may submit questions in writing via mail, facsimile or by e-mail. All questions must be received by H-GAC no later than 5:00 pm, Thursday, May 27, 2010. Proposals that are submitted electronically must be received by Tuesday, June 8, 2010, 5:00 P.M. Central Standard Time. H-GAC will not accept e-mailed proposals that arrive after the deadline. CONFLICT OF INTEREST / DEBARMENT Texas House Bill 914, codified as Chapter 176 of the Local Government Code, requires vendors and consultants contracting or seeking to do business with H-GAC to file a Conflict of Interest Questionnaire (CIQ). The required questionnaire is located at the Texas Ethics Commission’s website http://www.ethics.state.tx.us/forms/CIQ.pdf and a copy is attached to this bid/proposal. The CIQ must be completed and filed with the bid/proposal response. Vendors and consultants not including the form with the response, and failing to timely provide it, may be disqualified from consideration by H-GAC. May 12, 2010 Page 16
