An analysis of some of America's most significant Problems is given with an emphasis on the general, systemic issues. Systemic solutions are then proposed in the form of possible Constitutional Amendments which would have widespread applicability to many current (and future) problems. Please take a look. I'd be happy to learn of issues you may feel have been missed.

OUR IVORY-TOWER, BUT EVER-EXPANDING FEDERAL GOVERNMENT

  1. 1. OUR IVORY TOWER GOV’T ? GOVERNMENT - - GETTING TOO BIG AND REMOTE FROM THE CITIZENS ? SOME THOUGHTS TO REMEDY THE SITUATION
  2. 2. TOPICS COVERED OVERVIEW – SOME FUNDAMENTAL, BUT HIGHLY AMBITIOUS SOLUTIONS TO AMERICA’S PROBLEMS THE PROCESS WE HAVE FOLLOWED OUR SOLUTION IN ABBREVIATED FORM YOUR THOUGHTS - - NEXT STEPS ? l
  3. 3. SEVERE PROBLEMS - - IN THE NEWS . . . EVERY DAY THESE ARE SOME: • AMERICA’S BUDGETING & DEBT • • • • • • • • • • UNHELPFUL TAX STRUCTURE LAW-MAKING OBSCURITY TO THE CITIZEN UNACCOUNTABLE GOV’T REGULATION UNSUSTAINABLE GOV’T HANDOUTS GOV’T DISREGARD OF THE CONSTITUTION GROWING REMOTENESS OF GOV’T FROM THE CITIZENS CITIZEN ACCESS TO OBJECTIVE NEWS REGARDING OUR GOVERNANCE AN ENFEEBLED “CHECKS & BALANCES” SYSTEM OUR EDUCATION SYSTEM IS NO LONGER “BEST IN CLASS” GOV’T HAS CUT DEEPLY INTO CITIZEN CHOICE AND FREEDOMS BUT - - MOST CITIZENS ARE NOT AGGRESSIVELY RAISING THE ALARM !
  4. 4. COSTS OF THE NATIONAL DEBT IRRESPONSIBLE
  5. 5. HOWEVER, A SENSE OF CONCERN IS ARISING Ref 2,3 THE QUESTION IS: DO CITIZENS HAVE THE TOOLS TO FIX THINGS ?
  6. 6. OUR BROKEN PROCESSES NEED “REAL CHANGE” The issue is NOT just a poor Law or Program here or there. It’s more fundamental. The processes are broken - - so the solution must be pretty fundamental as well.
  7. 7. OUR APPROACH TO “REAL CHANGE” “REAL CHANGE” IS TAKEN TO MEAN: i. HAS SIGNIFICANT IMPACT; RELATIVELY TAMPER-PROOF ii. RESTORATIVE OF CITIZEN CONSTITUTIONAL POWER. IT IS DESIGNED TO COMPLEMENT THE ORIGINAL BILL OF RIGHTS, WHICH ADDED RIGHTS TO INDIVIDUAL CITIZENS. THE “SPRING” AMENDMENTS ARE DESIGNED TO RESTORE RIGHTS TO THE COLLECTIVE CITIZENRY.
  8. 8. TOPICS COVERED OVERVIEW – SOME FUNDAMENTAL, BUT HIGHLY AMBITIOUS SOLUTIONS TO AMERICA’S PROBLEMS THE PROCESS WE HAVE FOLLOWED OUR SOLUTION IN ABBREVIATED FORM YOUR THOUGHTS - - NEXT STEPS ? l
  9. 9. OUR ANALYSIS PROCESS
  10. 10. SIMULTANEOUSLY SIMPLIFYING PROCESS AND GOV’T WE’LL USE THE “FAIR TAX” AS AN EXAMPLE OF PROBLEM AND SOLUTION GENERALIZATION.
  11. 11. PROBLEM: AMERICA’S ULTRA-COMPLEX TAX SYSTEM OVERALL BACKGROUND The current federal tax system is so complex, most Americans (and most Elected officials) do not understand it. It has loopholes too often used to punish or reward politically selected population segments. Moreover, within this overly complex tax framework, Citizens can not perform well the role of overseeing government revenue raising . The Fair Tax (FT) is SIMPLER to understand and comply with. U.S. TAX CODE GROWTH – cchgroup.com A brief summary of FT features is this: • structured like a National sales tax, • inherently simple, and immune from political favoritism. • eradicates Income, Capital Gains, Gift and Estate taxes. Citizens will no longer have to fill out any yearly tax forms, since taxes are collected only from those businesses that sell new goods directly to the Citizen/Consumer. Re-sales of used goods are not taxed.
  12. 12. PROBLEM: AMERICA’S ULTRA-COMPLEX TAX SYSTEM AN EXAMPLE PROBLEM: The political abuse of IRS power harassing Conservatives has been much in the news . . It is troubling that so many government employees could participate in an unlawful attack on Conservative organizations and not realize that they were doing something wrong. Thus, the FAIR TAX equality and simplicity of enforcement should appeal to many Americans, independent of political persuasion. E.g., even if a Citizen were employed “off the books” and received all of their income in cash, they could not avoid paying the FairTax when they go shopping. More folks would have “skin in the game”.
  13. 13. TAX SYSTEM ROOT CAUSE ISSUES So, the following Root Causes characterize this issue: A. Tax complexity imposes significant waste of time for both Elected Officials and Citizenry. Both groups could be far more productive by spending their time on true problems. B.Government complexity due to size and mass of regulations is a recipe for Government abuse of power and fundamental Citizen Rights. The Tax System opaqueness has enabled favoritism, waivers and loopholes that undermine Citizen confidence in basic fairness. C.Additionally, transparency of the Fair Tax, would enable better accountability of Government to Citizens.
  14. 14. PROBLEM: AMERICA’S ULTRA-COMPLEX TAX SYSTEM GENERALIZED SOLUTION MANDATES A. IMPROVE BUDGETING AND DEBT PROCESS. MANDATE THE FAIR TAX FOR ENHANCED CITIZEN UNDERSTANDING AND OVERSIGHT OF BUDGETING AND DEBT ACCUMULATION. B. ENHANCE CONGRESSIONAL FOCUS. LIMIT THE # BILLS PER SESSION AND LIMITED WORDS PER BILL. MANDATE ADEQUATE TIME FOR: CAREFUL DELIBERATION, PUBLISHED EXPERT ANALYSIS & CITIZEN FEEDBACK. RESTRICT DELEGATION OF AUTHORITY TO REGULATORY AGENCIES TO ADMINISTRATION, BUT ZERO ADDITION TO, OR EXPANSION OF, DULY ENACTED CONGRESSIONAL LAW.. C. MANDATE FBI INVESTIGATION AND DOCUMENTATION OF ANY 1000CITIZEN ALLEGATION OF ANY FEDERAL ELECTED OFFICIAL FAILING TO LIVE UP TO HIS OATH OF OFFICE RE CONSTITUTIONALITY. D. KEEP THE SOLUTION SIMPLE, WITHIN CONSTITUTIONAL AUTHORITY, AND WITH THE OBJECTIVE OF SMALLER ROLE FOR THE FEDERAL GOV’T. 21. 21. A SLIGHTLY MORE DETAILED SUMMARY OF PROPOSED CONSTITUTIONAL CHANGES We’ve delineated multiple significant National Problems and some Generalized Solutions developed to help resolve them. Each solution is intended to augment the Citizens’ role in governance and to address several of our current systemic problems. The next sequence of 9 charts gives a flavor of some changes envisioned. Each begins with a Problem Statement and then a few phrases to summarize the intent of the proposed Amendments.

  23. 23. SPRING AMENDMENT #2 - - GOVERNANCE PROBLEM & SPRING PROPOSAL PROBLEM • CONGRESS IS PASSING MUCH LEGISLATION WHICH DELEGATES IMPORTANT MANDATES TO BE SUBSEQUENTLY EVOLVED AND CREATED BY GOVERNMENTAL AGENCIES, INCLUDING EXECUTIVE AGENCIES. • THESE MATTERS IMPOSE COSTS UPON TAXPAYERS AND OFTEN DEGRADE CITIZENS’ CHOICES AND BASIC FREEDOMS. MOREOVER, THE AGENCIES WHICH IMPOSE THESE RULES AND REGULATIONS ARE REMOTE FROM, AND NOT DIRECTLY ACCOUNTABLE TO , THE CITIZENS. SPRING PROPOSAL • UPON APPROVAL OF THIS AMENDMENT, ANY REGULATORY AGENCY RULES, WITH THE FORCE OF LAW ON CITIZEN COSTS OR ACTIONS RELATING TO LIFE, LIBERTY AND THE PURSUIT OF HAPPINESS, MUST BE SEPARATELY APPROVED BY CONGRESS , IN THE SAME MANNER AS ANY LEGISLATION, BEFORE BECOMING BINDING ON ANY CITIZEN. • ADDITIONALLY, ALL EXISTING SUCH REGULATIONS MUST BE REVIEWED BY CONGRESS OVER A PERIOD OF 4 YEARS FROM APPROVAL OF THIS AMENDMENT, AT WHICH TIME THEY WILL BE CONSIDERED NULL AND VOID, UNLESS RE-AUTHORIZED BY CONGRESSIONAL VOTE.
  24. 24. SPRING AMENDMENT #3 - - GOVERNANCE PROBLEM & SPRING PROPOSAL PROBLEM • OUR CURRENT FEDERAL TAX SYSTEM HAS BECOME MASSIVELY COMPLEX, REQUIRING INORDINATE LEVELS OF CITIZEN TIME AND COST. INNOVATIVE SIMPLIFICATION IS REQUIRED. • AMERICA’S FEDERAL DEBT IS AN IRRESPONSIBLE SHIRKING OF CURRENT CITIZEN OBLIGATION, WHICH DEVOLVES TO OUR CHILDREN AND LEAVES NATIONAL FINANCIAL STABILITY AND INFLUENCE IN THE HANDS OF OTHERS. • ENTITLEMENT PROGRAMS ARE ESTIMATED TO INVOLVE 10’s OF TRILLIONS OF DOLLARS OF UNFUNDED FUTURE LIABILITIES. CITIZENS HAVE WRONGLY BEEN LED TO BELIEVE THAT SUCH ENTITLEMENT MONIES HAVE BEEN COLLECTED AND HELD AVAILABLE FOR CITIZENS AS PROMISED. NOT SO! SPRING PROPOSAL MANDATE THE “FAIR TAX”; MANDATE FEDERAL BIENNIAL BUDGETING; IRS DOWNSCOPE TO 10% OF CURRENT MANPOWER; ALL MONIES RECV’D BY GOV’T MUST BE RECORDED AND TABULATED IN A SINGLE BIENNIAL FEDERAL BUDGET. MANDATE LIMITS ON: ANNUAL BUDGET (18%GDP ); TOTAL DEBT (30% GDP) EXCEPT IF ¾ CONG. MAJORITY VOTE; AND TOTAL FEDERAL GOV’T PAYROLL (XX % GDP). ENTITLEMENT & PENSION MONIES MUST BE FUNDED, INVESTED AND RETAINED IN ACCOUNTS DEDICATED SOLELY TO PURPOSE.
  25. 25. SPRING AMENDMENT #4- - GOVERNANCE PROBLEM & SPRING PROPOSAL PROBLEM AN ONGOING DIALOGUE HAS EVOLVED IN RECENT DECADES, CONCERNING WHETHER THE CITIZEN’S CONSTITUTION IS TO BE INTERPRETED AS “ORIGINALIST” OR “LIVING”, MEANING (1) STRICTLY AS INTENDED BY CREATORS OF THE CONSTITUTION OR (2) AS “BENT” TO CONFORM TO A NEW GOVERNMENT-AUTHORIZED VIEW. BUT THE CONSTITUTION IS THE CITIZEN’S REFUGE FROM ARBITRARY GOVERNMENT WHIM, AND MUST HAVE CITIZEN APPROVAL TO BE CHANGED. NEVERTHELESS, MUCH LEGISLATION IS DEEMED BY MANY LEGAL EXPERTS TO BE OF DOUBTFUL CONSTITUTIONALITY. REMEDY IS REQUIRED TO RE -ESTABLISH A PROCESS THAT PUTS THE CITIZEN IN THE RIGHTFUL POSITION OF APPROVING ALL AMENDMENTS AS CONSTITUTIONALLY PROVIDED. SPRING PROPOSAL • FEDERAL COURTS MUST ATTEST TO CONSTITUTIONALITY OF ANY LAW SO CHALLENGED. US SUPREME COURT SHALL BE LIMITED TO INTERPRETING CONSTITUTIONALITY IN ACCORD WITH FOUNDERS’, AND SUBSEQUENT AMENDERS’, ORIGINAL INTENT AT THE TIME OF APPROVAL. NO JUDICIAL INTERPRETATION SHALL BE OF AN EXTENT CONSIDERED TO INFRINGE ON CONGRESS’ SOLE AUTHORITY TO CREATE LEGISLATION. • NO CITIZEN SHALL BE REFUSED ANY FEDERAL COURT HEARING FOR “LACK OF STANDING”, IF THE MATTER BEFORE THE COURT SHALL BE RELATED SUBSTANTIVELY TO HIS DULY-AUTHORIZED CONSTITUTIONAL RIGHTS.
  26. 26. SPRING AMENDMENT #5 - GOVERNANCE PROBLEM & SPRING PROPOSAL PROBLEM RECENT YEARS HAVE SEEN INCREASING INTRUSION OF THE FEDERAL GOVERNMENT INTO SERVICES THAT CAN OFTEN BE PROVIDED TO THE CITIZEN MORE EFFECTIVELY BY PRIVATE ENTERPRISE. IN SOME CASES, GOVERNMENT MAY BE BEST SUITED TO A TASK. A METHOD IS REQUIRED WHEREIN GOV’T AND PRIVATE ENTERPRISE CAN GENERALLY COMPETE, ON A FAIR PLAYING FIELD, AND THE CITIZENS WILL BENEFIT FROM THE ABILITY TO CHOOSE WHICH BEST MEETS THEIR NEEDS. SPRING PROPOSAL • ALL CONGRESSIONAL LEGISLATION RELATING TO ALL GOV’T PROGRAMS , EXCEPT FOR MILITARY PROGRAMS, SHALL PROVIDE ALSO FOR CITIZEN CHOICE BY INCLUDING COMPETITIVE PRIVATE ENTERPRISE IMPLEMENTATION. • ALL GOVERNMENT MONIES INTENDED TO SUBSIDIZE OR DEFRAY TAXPAYER COSTS FOR SUCH PROGRAMS SHOULD GO DIRECTLY TO CITIZEN SPENDERS SO THAT COMPETITIVE CITIZEN CHOICES ARE ASSURED BY THE MECHANISM OF ALLOCATING THE MONIES AS LEGISLATED.
  27. 27. SPRING AMENDMENT #6- - GOVERNANCE PROBLEM & SPRING PROPOSAL PROBLEM CONGRESSIONAL ACTIONS AND MANDATES (BOTH DIRECTLY IMPOSED & INDIRECTLY IMPOSED ON CITIZENS) ARE OFTEN COSTLY TO CITIZENS IN BOTH FINANCIAL AND RESTRICTIONS -ON-ACTION TERMS. MORE CARE AND MORE ACCESS TO CONGRESSIONAL EXPLANATION ARE REQUIRED SO THAT CITIZENS RETAIN BETTER VISIBILTY OF, AND CONTROL OVER SUCH MANDATES. OFTEN, CITIZENS CAN WRITE TO THEIR CONGRESSIONAL REPRESENTATIVES, BUT RECEIVE SHORT AND STANDARD FORM REPLIES WITHOUT THE BENEFIT OF ANY SIGNIFICANT SUPPORTING DATA. SPRING PROPOSAL • CONGRESS WILL INCORPORATE A SUBSTANTIVE COST-BENEFIT ANALYSIS FOR EVERY BILL AS AN INTEGRAL PART OF THE LEGISLATIVE PROCESS. THE ANALYSIS SHALL BE DUE 45 DAYS PRIOR TO CONGRESSIONAL APPROVAL; SEPARATE ANALYSES BY 2 INDEPENDENT AGENCIES SHALL BE REQUIRED AND A 3 PAGE SUMMARY FOR EACH ANALYSES SHALL BE INCORPORATED IN EVERY BILL. • THE GOVERNMENT IS MANDATED TO INVESTIGATE AND PUBLISH A REPORT BACK TO CITIZENS WITHIN 4 MONTHS FOR ANY RELATED LEGISLATIVE MATTER THAT IS ARTICULATED TO THE LEADERSHIP OF EACH HOUSE OF CONGRESS BY A WRITTEN CITIZEN REQUEST SIGNED BY 1000 or MORE CITIZENS.
  28. 28. SPRING AMENDMENT #7- - GOVERNANCE PROBLEM & SPRING PROPOSAL PROBLEM AN INFORMED CITIZENRY IS A NECESSARY PREREQUISITE TO THE SUCCESSFUL FUNCTIONING OF OUR NATION AND AN OBJECTIVE NEWS REPORTING PROCESS IS A PREREQUISITE TO AN INFORMED CITIZENRY. YET, CRITICISM OF LARGE SEGMENTS OF THE NEWS MEDIA, AS “HOPELESSLY BIASED” , CAN BE HEARD BOTH FROM CITIZENS ON THE LEFT AND ON THE RIGHT. A WAY IS NEEDED TO ASSURE A FREE PRESS WHILE RETAINING AN OBJECTIVE NEWS OUTPUT THAT INFORMED CITIZENS CAN RELY UPON. SPRING PROPOSAL • ALL GOV’T NEWS RELEASES MUST INCLUDE VIEWS OF BOTH (1) THE PARTY IN POWER, AND (2) THE MAJOR OPPOSITION PARTY (TO 40% SIZE OF THE TOTAL RELEASE). NEWS MEDIA SHALL BE REQUIRED TO CONTAIN BOTH POLITICAL VIEWS. MEDIA PENALTIES FOR A RECORD OF NON-COMPLIANCE OF GREATER THAN 5%, SHALL INCLUDE REMOVAL FROM THE GOVERNMENT DISTRIBUTION LIST FOR A PERIOD OF 1 YEAR. • ALL MEDIA NEWS RELATED TO GOVERNANCE OR POLITICAL MATTERS SHALL BE DESIGNATED AS “NEWS” OR “NON-NEWS”. ANY MEDIA REPORTS DESIGNATED AS “NEWS” SHALL INCLUDE VIEWS REPORTED BY EACH OF THE 2 MAJOR POLITICAL PARTIES AND EACH COMPRISING ABOUT 25% OF THE TOTAL “NEWS” REPORT. THERE SHALL BE NO RESTRICTIONS WHATEVER ON REPORTS LABELED AS “NON-NEWS”.
  29. 29. SPRING AMENDMENT #8 - - GOVERNANCE PROBLEM & SPRING PROPOSAL PROBLEM HAND-IN-HAND WITH KEEPING TRACK OF AMERICA’S DEBT ACCUMULATION, IS THE NEED FOR CONGRESS TO TAKE RESPONSIBILITY TO OVERSEE AND MANAGE GOVERNMENT EXPENDITURES. CITIZENS MUST HAVE A BETTER VISIBILTY OF THE NATION’S SPENDING AND BUDGET PERFORMANCE AS THE YEAR EVOLVES, NOT JUST AFTER THE FACT. CITIZEN’S MUST ALSO HAVE THE TOOLS TO AUDIT THE SPENDING OF THE MANY GOV’T AGENCIES AND PROGRAMS WHICH IMPLEMENT AND OVERSEE MUCH OF THE NATION’S EXPENDITURES. SPRING PROPOSAL • CONGRESS SHALL PUBLISH A YEARLY BUDGET SUMMARY 120 DAYS BEFORE EACH VOTE AND CONTAINING BOTH 20 YEAR HISTORY AND 10 YEAR PROJECTIONS, NORMALIZED TO NATIONAL GDP. THE TOTAL LEGISLATIVE BUDGET IS TO BE LESS THAN 50 PAGES, AND SPLIT TO 535 APPROX EQUAL SEGMTS, EACH SEGMENT IS TO BE OVERSEEN BY 1 RESPONSIBLE CONGRESSMAN, EACH OF WHOM SHALL PUBLISH A QUARTERLY REPORT TO THE NATION ON THE STATUS OF BUDGET ACTUALS VS PROJECTED CUMULATIVE EXPEPENDITURES. • PUBLICATION OF MANDATED PERFORMANCE AUDITS FOR ALL MAJOR GOV’T AGENCIES SHALL BE ACCOMPLISHED BY THE CONGRESSIONAL BUDGET OFFICE. SUCH AUDITS MAY BE REQUESTED BY TWO GOV’T INVESTIGATIVE AGENCIES (GAO, CIGIE) OR A BY A SPECIALLY DESIGNATED CITIZEN PANEL.
  30. 30. SPRING AMENDMENT #9 - - GOVERNANCE PROBLEM & SPRING PROPOSAL PROBLEM THE CONSTITUTION ACKNOWLEDGES THE CITIZENS AS ULTIMATE OWNERS OF THE FEDERAL GOV’T. BUT CITIZEN ACCESS TO THE GOV’T IS ACTUALLY LIMITED BY THE COMPLEX AND INTRICATE PROCESS OF 300 MILLION CITIZENS INTERACTING WITH 535 CONGRESSMAN, THE PRESIDENT AND 9 JUSTICES OF THE U.S. SUPREME COURT. A MORE RELIABLE INTERACTION PROCESS IS NEEDED WHILE PRESERVING THE INTEGRITY OF THE RESPONSIBILITIES ALLOCATED TO THE 3 BRANCHES BY THE CONSTITUTION . SPRING PROPOSAL CONGRESS SHALL CREATE A MULTI-TASKED CITIZEN-POPULATED, OVERSIGHT PANEL (C.O.P.) COMPRISED OF 25 DULY-REGISTERED, SALARIED CITIZENS. THE PANEL, WITH A SUPPORT STAFF OF 100 PERSONS, SHALL ACT AS THE CITIZEN’S DIRECT ENVOY TO THE FEDERAL GOV’T AND SHALL HAVE AUTHORITY TO ACT AS THE CITIZEN’S OMBUDSMAN IN DIRECT INTERACTION WITH THE FEDERAL EXECUTIVE, LEGISLATIVE AND JUDICIAL BRANCHES. THE C.O.P. SHALL RESPOND TO ANY CITIZEN REQUEST FOR ACTION SIGNED BY 2500 DULY REGISTERED U.S. CITIZENS. CONGRESS SHALL CREATE UP TO 6 CITIZEN SPECIAL EXPERTISE PANELS CHARTERED TO INTERACT WITH ALL SEGMENTS OF THE FEDERAL GOV’T WITH THE OBJECTIVE OF PROVIDING ITS EXPERT VIEW ON THE SPECIAL KNOWLEDGE AREAS OF : CONSTITUTIONALITY; AMERICAN MANUFACTURING; COST-BENEFIT ANALYSIS; OTHERS, AS DESIGNATED BY THE C.O.P. THE SPECIAL PANELS SHALL HAVE THE POWER TO ACCESS ALL SUCH DATA AS MIGHT BE REQUESTED AND APPROVED UNDER THE F.O.I.A. ACT.
  31. 31. TO RECAPITULATE BRIEFLY We’ve shown the applicability of nearly 20 initial National Problems to the Generalized Solutions developed as explained in this discussion. These results offer hope that the SPRING Amendment proposal, has the potential to be an effective tool to solve critical Problems and ensure restoring Citizenry influence over our National governance. The next 10 charts summarize, in plain terms, some potential Constitutional changes that will help restore Citizen Control of Governance. Two recent ideas from others are then given and will add nicely to the mix: a) Mark Levin re: Constitutional Amendments b) Bob Schulz re: Citizens’ presence in every State Capitol
  32. 32. AN ALLY FOR THE CAUSE ? • MARK LEVIN’S NEW BOOK ALSO EXPLORES SIMILAR CONSTITUTIONAL AMENDMENT THOUGHTS TO OURS. THE APPROACH IS A LITTLE DIFFERENT - - HAVING FOCUSED HERE ON PROCESSES . BUT THE MOTIVATION IS THE SAME: THE PEOPLE’S GOVERNMENT NEEDS IMPROVEMENT.
  33. 33. Institutionalizing Citizen Vigilance Bob Schulz, Founder – We The People Foundation Bob Schulz holds this inspiring vision: “In every state capitol, there is a building with a dome on top. When people see those buildings, they instinctively know that’s where the government is doing it for, or to, The People.” … The vision: “one day soon, there will be another building in every state capital, in the likeness of Jefferson’s “Monticello”. … I see those buildings as permanent “citizen vigilance centers”, manned with paid constitutional attorneys and staff relying on hundreds of “constitutional monitors”. ... These Citizen Vigilance Centers will serve the People of the State intent on holding their elected officials accountable … in utmost respect and defense of the greatest governing documents ever given to mankind.”
