  • Interview with: Jason Baker, VicePresident, S-E-A“If you manufacture or sell a product, itis quite likely that you will get sued atsome point,” according to Jason Baker,Vice President, S-E-A. “That is why weencourage companies to engage us todetermine the underlying cause asquickly as possible after a claim or suithas been filed. Additionally, we urgecompanies to have their productsindependently tested by S-E-A priorto releasing them into the stream ofcommerce. Taking this precautionshould improve product safety, andmitigate litigation costs andcorresponding frustrations later on whileenhancing the brand,” he added.S-E-A is a forensic engineering andtesting firm at the marcus evans ChiefLitigation Officer Summit Fall 2013,in Amelia Island, Florida, September8-10. Ahead of the Summit, Bakerdiscusses how Chief LitigationOfficers (CLOs) can minimize the riskand cost of litigation by focusing onwhat the company can do on the frontend of manufacturing.What is challenging CLOs today?How could S-E-A assist?Most CLOs are concerned aboutprotecting their company’s brand orimage. If their company manufacturesproducts, they have the challenge ofkeeping manufacturing costs low whiledelivering safe products to consumers.If they are in the hospitality or retailbusiness, their premises must be safe tovisitors, in order to avoid injuries andsubsequent litigation.We assist CLOs by providingindependent expert opinions as to thecause of an alleged issue or byproactively identifying potentialconcerns. If it is post-event, we respondswiftly to ascertain what, if anything didactually happen, and if the injuries anddamages reported are consistent withthe event. CLOs need an independentinvestigator for these types of incidents.In the US, there is a growing lack ofaccountability. If an individual suffersinjury or property damage, it is quitelikely that blame will be placedelsewhere.Right or wrong, corporations, withperceived deep pockets, are often thefocus of lawsuits. It is important thatCLOs mitigate liabilities throughobjective scientific analysis.Could the required level of producttesting be done in-house?Employees whose livelihood is derivedthrough their job may be reticent, dueto pride of production or economicconcerns, to find issue with theircompany’s service or product. They mayoverlook warnings, labels or otheraspects of safety, as well as unintendeduses for the product. At the very least,there may be a perceived conflict ofinterest.For over 40 years, S-E-A has been anindependent finder of facts. The firm’shonest and objective evaluations andopinions are rooted in scientificmethodologies. This will help increaseproduct performance and safety whilesaving frustration and litigation costslater on. A recall of a product can be, byfar, incredibly more expensive than pre-market testing.It is also critical to maintain brandequity by not having a product performbelow standard or desires. Oftencompanies wait to contact S-E-A until aproblem has been identified by theconsumer causing reduced sales whileincurring litigation and/or investigationcosts.With enough time, a company, whetheri n t h e r e ta i l , m a n u f a c t u r i n g ,transportation, or hospitality industry,will experience a lawsuit. They will needS-E-A services either at the front end orthe back end.
