  • Roles of Department of Environment (DOE) To administer and enforce the Environmental Quality Act, 1974 : Prevention, abatement and control of pollution and enhancement of the environment There are 34 subsidiary legislations under the Act -3-
  • Lynas must comply to the following Act &Regulations Environmental Quality Act 1974 : Environmental Impact Assessment (EIA) report Quantitative Risk Assessment (QRA) report Guidelines for Prevention and Control of Soil Erosion and Siltation in Malaysia , October 1996. Environmental Quality (Sewage, and Industrial Effluents) Regulations, 1979 Environmental Quality (Clean Air) Regulations,1978 Environmental Quality (Scheduled Wastes) Regulations, 2005 Planning Guidelines for Environmental Noise Limit and Controls, 2004 -4-
  • Conditions of Approval for Lynas EIA and QRA prepared by registered environmental consultant Proper and designated drainage system for the Residue Storage Facilities (RSF) Safety and Emergency control AELB’s approval on monitoring, management and disposal of radioactive containing materials Chemical and scheduled waste management Solid waste management Environmental management plan (EMP) Control and monitoring of : Air quality - soil condition - Noise Water quality including underground water -5-
  • Requirements that Lynas must comply and monitoredby DOE Suspended solid less than 100 mg/l from the silt trap discharge during construction Water quality monitoring report on 30 parameters upstream and downstream of Sungai Balok 4 borewells for underground water quality monitoring Ambient Air Quality monitoring of parameters CO2, CO, NO2, NO, SO2, HF, H2SO4, PM10, and TSP Noise monitoring at four (4) stations Discharge effluent quality report from the final discharge point Stack emission sampling to comply Standard C, Clean Air Regulations, 1978 and AELB’s standards. Compliance report Environment audit report -6-
  • Lynas Project : AIRHow will Lynas ensure its Air Emissions meet DOE requirements? Lynas will install waste gas treatment systems for the removal of sulfuric acid and sulfur dioxide It is a five-stage waste gas scrubbing system Lynas also has an emergency scrubbing system to ensure air emission meet DOE requirements at all times Air Quality Modelling has been completed -7-
  • Lynas Project : WATERHow will Lynas ensure its Industrial Effluents meet DOE requirements? Lynas will install a 2-stage waste water treatment system High Density Sludge Neutralization to neutralize acids and remove metals Industrial effluent treatment system (IETS), an activated sludge bio-treatment To treat process water to reduce BOD and COD IE discharges to comply to Standard B of Regulation 8(1)(b), Environmental Quality (Sewage, and Industrial Effluents) Regulations, 1979 and AELB’s standards Lynas will install an independent storm water system To ensure Storm water will not be contaminated by process water Waste water from the Water Leached Process is recycled back to the process. -8-
  • Conclusion DOE approved the Lynas Project after a detailed review of the EIA and QRA submitted by Environ in Jan 2008. Approval was granted with conditions in Feb 2008. DOE separately approve the detailed design of key pollution control equipment prior to installation, and for the Lynas Project this includes the waste water treatment plant and the waste gas treatment plant. After EMP approval on Dec 2008, three site visits have been conducted by DOE; construction works complied to EIA conditions. DOE, as the regulator, will ensure that Lynas operates consistent with the act and regulations so that the impact to the environment is minimised. -9-
