" ___. .. :1 IN THE NAME AND BY THE AUTHORITY OF THE STATE OF TEXAS: Before me, The undersigned authority, on this day personally appeared Sgt. Michael Barry who after being by me duly swom, on oath deposes and says: That heretofore, to wit, on or about the 24th Day of July, A. D., 2007, and before the making and filing of this complainant, in the County of Galveston and The State of Texas, Kimberly Dawn Trenor, did then and there unlawfully, intentionally or knowingly cause serious bodily injury to Riley Ann Sawyers, a child 14 years of age or younger, by hitting, holding her head under water, slamming her body to the floor, Section 22.04(A)(a) of the Texas Penal Code, First degree Felony. AF FIANT BASES THIS BELIEF UPON THE FOLLOWING: Affiant, Sgt. Michael Barry is employed by the Galveston County Sheriffs Office, presently assigned to the Criminal Investigation Division as a Major Crimes Investigator. Affiant has been so employed for the past twelve years and has a total of thirty-two years of law enforcement experience in criminal investigations of crimes against persons and property and undercover operations. Affiant is a licensed Peace Officer for the State of Texas, licensed by the Texas Commission on Law Enforcement Officers Standards and Education with a Masters Certificate. On October 29th, 2007 at 10:38 PM. the Galveston County Sheriffs Office received a call from a local fisherman, Robert Wayne Spinn, who discovered on an island in West Galveston Bay at the point of the Intercoastal Waterway, a container which contained several black plastic trash bags. Affiant was contacted by dispatch and dispatch relayed the above information. Affiant responded to the area and saw the container had plastic trash bags which contained the rerriains of an unidentified child. On October 30th, 2007, Affiant personally observed at the Galveston County Medical Examiners Office a blue colored Sterilite plastic container with two hinges, a black handle, and two wheels on one end with three black in color plastic trash bags that contained the human remains of a child. On October 30th, 2007, Affiant learned from Dr. Stephen Pustilnik that the unidentified child suffered three skull fractures to the back of the head, which were fatal injuries. On October 31st, 2007, the unidentified remains of this child for the purpose of this investigation were referred to as “Baby Grace. ” Affiant spoke with Investigator Ken Jones of the Galveston County Sheriffs Office who relayed the following information: On November 7th, 2007 Sheryl Sawyers called the Galveston County Sheriffs Office with a tip and information that the unidentified child could be her granddaughter, Riley Ann Sawyers. Ken Jones followed—up on the lead and spoke with Mrs. Sawyer who identified the parents of Riley Sawyer as Kimberly Dawn Trenor and Robert Sawyer. Mrs. Sawyer further stated that Kimberly Dawn Trenor and Riley Ann Sawyer were residing a Spring, Harris County, Texas. Investigator Jones further learned after speaking with Robert Sawyer that Kimberly Dawn Trenor was living with a Royce Zeigler.

Affiant further learned from speaking with Investigator Ken Jones that he confirmed by Texas Drivers License check that Kimberly Dawn Trenor and Royce Clyde Zeigler, ll do reside at-Spring, Harris County, Texas. Affiant reviewed a document alleged to be from the Ohio Department of Children’s Services which stated Riley Ann Sawyers was removed from the custody of Kimberly Dawn Trenor for allegations of sexual abuse by Royce Clyde Zeigler, II. This document was provided to the Galveston County Sheriffs Office by Jean Meeks, a Civil Attorney representing Kimberly Dawn Trenor. On November 23rd, 2007 Affiant met with Kimberly Dawn Trenor and her attorney, Tom Stickler. During this meeting, a buccal swab for a DNA sample from Kimberly Dawn Trenor was taken. Trenor also gave a voluntary statement on video with her attorney present where she described her involvement with Royce Clyde Zeigler, II in the physical abuse, death, and disposal of the remains of her daughter, Riley Ann Sawyers. During this interview, Kimberly Dawn Trenor described that on July 24, 2007 in the morning hours, Royce Clyde Zeigler, II and Kimberly Dawn Trenor stayed home at‘pring, Harris County, Texas and beat Riley Ann Sawyers with two separate leather belts and held her head under water in the bathtub. She fiirther stated that Royce Clyde Zeigler, II picked Riley Ann Sawyers up by her hair and he also threw Riley Ann Sawyers across the room which caused her head to slam into the tile floor. Ms. Trenor stated that Riley Ann Sawyers was put face first into a pillow in her room as well as face first into the couch in the family room. Ms. Trenor stated that during the abuse of Riley Ann Sawyers, Royce Clyde Zeigler, II stopped and gave Riley chi1dren’s pain medication. Ms. Trenor also stated that after Riley Ann Sawyers was dead, Royce Clyde Zeigler, [I covered her with a purple towel. She further stated on the same date, that evening, Royce Clyde Zeigler, II and Kimberly Dawn Trenor traveled to Wal—Mart located on FM 249 and Spring—Cypress Road in Harris County, Texas where they purchased a blue colored Sterilite plastic container with hinges and wheels on one end. She further stated they purchased black trash bags, a red handled shovel, bleach, plastic/ latex gloves, concrete mix, a metal chain, and a “push type" clip to lock the chain. Kimberly Dawn Trenor admits to Affiant that “Baby Grace” is in fact her daughter, Riley Ann Sawyers who is two years and eight months of age. Trenor also describes that Royce Cl de Zei ler' II concealed the blue plastic Sterilite container inside a storage shed that contained the body of Riley Ann Sawyers athspring, Harris County, Texas for a period of one to two months. Trenor further describes that they carried the remains of Riley Ann Sawyers inside the blue Sterilite container to the area of the Galveston Causeway and tossed the blue container into the water near the Galveston Causeway. Trenor further describes that she personally observed the blue Sterilite container drifting to the west. Trenor further stated that after the discovery of the unidentified child remains, Royce Clyde Zeigler, II told Kimberly Dawn Trenor to prepare a letter from the Ohio Department of Children’s Services stating that Riley Ann Sawyer was to be removed from her custody based on allegations of sexual abuse. Kimberly Dawn Trenor admitted that this document is a falsified document and was prepared on Royce Clyde Zeigler’s Dell laptop computer. Trenor also states that she wrote on a spiral notebook the contents of this falsified document. Trenor also told Affiant, this past weekend, Royce Clyde Zeigler, II attempted suicide by taking a large amount of blood pressure medication and anti-depressants. Royce Clyde Zeigler, II also wrote on a separate spiral notebook pad a note stating, “My wife is innocent of the sins that I committed. ” Ms. Trenor stated that she personall read the note written by Royce Clyde Zeigler, II.
