Democracy may have changed things, law and legislative changes mayhave been for the better, and even the introduction of the 3 Kings legislation may do a little toimprove things for investors, but because white collar crime and monetary abuse is rife and personalgreed is still the main driving force for almost untouchable whites, corruption and white collar crimeremain a hand me down from the apartheid legacy , to those who still rule the roost in thissupposedly democratic country.The Government and legal system of South Africa in conjunction with commerce and industry arelocked in an epic battle of morals, principles and truth against a collective adversary of evil, crimeand dishonesty, which can only be termed a battle of super structures. On the one side genuinehonest law abiding peace loving, hard-working people, dedicated Ministers, lawyers, judges, officialsand a structure kept aloft only by good men and women employing the law as a shield and truth as asword. On the other side a free for all by a dishonest collective of people which includes highlyintelligent and well educated lawyers, doctors, accountants and an army of economicallydisadvantaged individuals. The list is endless, including even ministers and professionals of standing,liquidators, misguided bureaucrats and civil servants all using economics as an excuse, deception asa marketing tool and chaos as their smokescreen. They contribute little to society and try and tear away at the integrity of the very fabric of society as a whole failing to recognise the long term consequences, the effect on those around them or the destructive legacy they are generating and producing for generations to come. This is demonstrated clearly in the recent events in South Africa surrounding The Grieve Group of Companies, DS Grieve Incorporated, Dr DS Grieve Bridging Solutions, Grieve Earthmoving, DS Grieve Investments, SAFRIFIN, Mercatura, NANINI CC and a catalogue of others, proudly and aggressively marketedlocally and even internationally by it’s owners Dr David Stephen Grieve (MBChB, MBA – Universityof Pretoria) and his wife Sanet Grieve nee Botha, a former waitress at his restaurant Cynthia’s in

Maroelana, Pretoria, who took The Grieve Group over a short period through all the phases of“deceivership” necessary to “absorb” all the liquidity, assets and investments of its local andinternational shareholders, supporters and investors. The process applied by Dr DS Grieve and hiswife was simple, they enticed and lured unsuspecting local and international investors, “family,friends and fools” (as well as a number of former medical patients) into a carefully crafted web ofdeceit, smoke and mirrors and intricately woven lies, shady accounting, auditing and deception, onlyto close the trapdoor on them at the last minute in an optimum cloaked situation to the Grieves ownpersonal financial benefit. Grieve used his position, status and title of Doctor DS Grieve at everyopportunity and his MBA from GIBS as a skilfully wielded and handcrafted torch of deception, toconvince his “friends, fools and family” into parting with their money.The methodology employed by Dr DS Grieve and his wife was, as could be anticipated, not uniqueand had been employed in concert by the other professional “players” involved many times before.The controlling participants involved had carried out the same act with the practised ease of atroupe of circus trapeze artists many times before, the lateral lack of information available to pastcreditors and others involved causing no reasons for suspicion. They “team” they used this time, alocally based Pretoria attorney reputed to have a history in “asset hiding” and back door liquidations, in concert with a firm of liquidators from Pretoria notorious for their involvement in a number of deceptive liquidations which included the Mr D Dlamini of Swaziland liquidations. A nightmare Pandora’s box of deceit, collusion and connivance, the ramifications of which are still reverberating around the continent and striking fear into the hearts of all those involved, especially the individuals and firms who can now be seen to have conspired to defraud him and pervert the course of justice throughout. In the lead up to and just prior to Christmas 2009, Dr DS Grieve, his wife, Sanet Grieve,a co-Director in the Grieve stratagem and shroud of businesses, and members of their family set inmotion the wheels of their cunning plan. The doors closed to investors, all the investors andcreditors were kept comforted over time on the telephone by Ina Papenfus, and Andre Botha whilstthe Grieve’s were, actively in concert with a few close allies in alternative but similar businesses, thelawyer and liquidators, working closely together, conspiring to close the now hollow shroud ofcompanies after first engaging in an on-going spending spree using lines of credit built up withinvestors money. This was a simple exercise to them and they used various tactics to maximise their“withdrawal” from the companies and the business “umbrella” they had erected purposefully tocollapse like a deck of cards down the track. One of the tactics was to elevate all their company loansand mortgages held over various assets to the ABSA and Standard Banks of South Africa to themaximum over time, another was to gradually increase and then drive the spending on their vastarray of credit cards to the maximum limits prior to shut down in a focussed premeditated spree toensure impact on creditors was maximised, another to divert all the furniture, fittings, vehicles, plantand machinery assets and equipment to alternative locations bases created specifically for this.Family members flocked to the fore to assist, all benefitting from a distributed share of the new andillicitly gained wealth, for instance, an entire R3 million rand plus worth of stock, fixtures and fittings

of a beading business belonging to Sanet Grieve, was given to a sister the VAT on which went whoknows where and subsequent taxable benefits simply discarded along with the responsibilities andrecords of the business. Another few million Rands of assets given to parents in law Andre andSusanna Botha of Thatchfield Pretoria along with a house, gifted virtually free (more investorsmoney). Cars, trucks, earthmoving equipment, computers, printers, office furniture and moreprovided to brother and co-conspirator Andre Botha jnr of Thatchfield and his fiancé Ina Papenfus,more distributed to relative Sakkie (Isak) Botha in the form of large cash payments, transferableassets and building equipment. Dr DS Grieve’s aged mother, herself the recipient of millions of Randsof investors funds, paid to her as a gratuity with no tax implications over time. The incrediblemonthly withdrawals and payments of hundreds of thousands of Rands of investors money tothemselves and family members continued over a lengthy period unabated and unnoticed – allcreditors pacified by monthly returns and simple eloquently laid out calming “Diazepam” regularreports, in the very footsteps of Bernie Madoff. Overall it seems the Bothas and Grieves wererunning a free market cash enterprise with little or no accountability to their shareholders, investorsor anyone else and total disregard for any regulatory requirements in connivance with their auditorsand accountants. The obvious train of thought in the absence of formal records is that this wassimply a mammoth PONZI scheme …..re-emphasised by the facts at hand and the absence of recordsand investors money….only the Grieves know, but there are a lot of questions they will have to answer or face the consequences. =In essence the Grieve’s had carried out their plan arrogantly and clumsily, with limited legal supportand advice and in concert with a “friendly” liquidator known to the Pretoria lawyer, one with whomthis had been done before and who could and would ensure the possible second phase legalrepercussions never materialised. However one small flaw in their plan led to their demise and theywere caught early, hands in the till just as they were about to cross the legal Rubicon and the pointof no accountability in their escape. This subsequently thwarted their initial withdrawal plan andresulted in their initial application for liquidation to the High Court being declined. It becamenecessary for them to alter their stance and make an urgent application for voluntary liquidation tothe South African Companies House CIPRO, to allow them to close their shrouded and cloakedcorporate structure. Naturally one would ask just how it is possible to close almost 30 businessentities through the backdoor in South Africa without raising suspicion, especially in the face of a

declined High Court Liquidation application and a series of notices to CIPRO to be on the alert forthis. Rumours abound however The South African Companies House, CIPRO has declined to providea formal answer yet but the suggestion of on-going corruption and collusion within CIPRO byattorneys and liquidators is becoming ominously conclusive. The question begs an answer, but noneis forthcoming…..the very silence being symptomatic of the cancer spread throughout the body ofCIPRO in South Africa. There are rumours of a high level internal anti-corruption investigation at thistime….Fortunately this corruption and collusion does not seem to extend fully into the legal systemand The High Courts yet…..Subsequent to the liquidation of The Grieve Group empire by Dr DS Grieve and his wife Sanet GrieveBotha (now living in luxury in Centurion, Pretoria) in 2009 the facts reveal that he had a largedebtors book, the primary asset of all businesses which mysteriously disappeared along with all thebusiness assets, plant machinery, furniture, fixtures and fittings - and the investors money. It hassurfaced that a large portion of the debtors book was sold off just prior to the liquidation and at ahugely discounted value to the detriment of all creditors, to Cape Town based Praesidium Finance asubsidiary of The Huge Group, who apparently demanded repayment of their own investmentforthwith after discovering Dr DS Grieve’s Rubic’s cube of fraud and money kiting during an internalaudit. They knew they were “sucking the marrow from the bone” contentiously, however and instead of reporting the matter to the authorities and without caution for any compliance with The Companies Act, The Laws of the land or even insolvency law simply cut off their pound of Grieve’s flesh. This is an historical landmark in this business demise as prior to that Dr DS Grieve had also been acting in concert with Blue Finance Directors who are also aware of every dirty finance trick available to close a business in the book….. It is apparent that Grieve may have had more than just a fewcollaborators in this majestic illusion …including a few close friends masquerading as investors,however, it seems that having sold off a large portion of his debtors book to Praesidium with noquestions raised, it suddenly dawned on him, he could “vanish” the rest as well. The financing loanagreements and contracts he held had already all been converted into “bearer bonds” by a wellthought out ceding clause in all the documentation and yanked from the transparency andaccountability of the business into the shadows by the creative and inventive hand of Dr DS Grieveand his wife, who simultaneously and mysteriously disposed of all the company records, accountsand administration leaving investors high and dry with not even the slightest chance of locating theirinvestments or funds. A very elegant sleight of hand that may have worked had he got the timingright and not attempted to clumsily just push it through smilingly, hoping it had not been noticed.But just like the magician who amateurishly and embarrassingly stumbles, fumbles, falters and thenblushes when his trick goes awry, Dr DS Grieve bumbled along in a state of public denial “believe meI’m a doctor” along with his entourage, pacifying all that his “ship” was still afloat and that any lossesincurred had been legitimate.Today for the collaborative pair of initiators a very different picture of life emerges, a pair of socialpariahs, unwelcome in social and professional environments and isolated in the community inPretoria and Gauteng they once thrived in. The effects of personal greed and a gold digger wife are

tangible, the notoriety distinct and the inevitable consequences dramatic with a longevity exceedingsimple measurement. So, as Dr DS Grieve, Provincial netball player, tennis player, philatelist, thiefand his former waitress wife Sanet Grieve Botha of South African disinvestment notoriety stumblethrough the Rainbow Nation White Collar Criminals Hall of Fame in search of their final resting placein the short annals of career criminal history, the bell tolls for them together, but mainly forinvestors, in a most unwelcoming way, singing out their mermaids warning, like the sirens of the seathat both beckoned and warned the sailors passing the horn of Africa so many years ago……warningaway investors….”beware” they call out, “beware South Africa”…...”Beware” and what a shame it is,that the beaches of the land of promise will continue to lie undeveloped instead of having the richwellness of development upon them. All it takes is the will to do it, the will to draw a line in the sandand say enough is enough, the will to sacrifice a prestigious member of society for wrongdoing, topunish him, effectively, properly – in public – as a preventative measure, an example. To show theworld – there are consequences regardless of station. To use that age old saying introduced at thetime of the execution of Admiral Byng – “it is wise to kill an admiral from time to time to encouragethe others" (Dans ce pays-ci, il est bon de tuer de temps en temps un amiral pour encourager lesautres….especially in age like this when old people are the victims and the heinous deeds committed by members of our society who should, like Admiral Byng, do their utmost, to serve and protect. A clear example is called for. A ruthless message needs to be sent from society. South Africa is a land of great promise, of great hope and of great potential. At present it seems there is a distinct lawlessness second to none and that the criminals are ruling the roost. It seems that specifically White, well educated, highly placed renegade members of society particularly those with an inclination to gather back the past dark years, are determined still to take down the peaceful developing African wonder of South Africa and wreck whatever they can when-ever they can. These are dark individuals who scurry amongst the genuine contributors and builders of society, deceiving and destroying where they can, leaving a trail of dishonesty and creating distrust, mistrust and hate where ever they go – a legacy of the past they simply will not let go of. However, the law has it’s own take on this and the Commercial Branch of the SAPS have a determination, skill and calculated cunning second to none in catching white collar criminals. They have seen almost all of it before and this one is not inventive enough to be classed as unique.The SAPS has a well-deserved reputation of “turning Lions into mice” and at the entrance to themain door in their building in Pretoria, in very small fine print are the words “We tame Lions….” Andso with the eyes of the world on South Africa in this case, we wait with baited breath in anticipation

for clarity to come and responsibility to be apportioned, accountability to be called for, legal justiceto work its way through this, and for white collar crime, to ultimately be paid for. For an example tobe set and a clear message to criminals sent out. In the eyes of the law, all people are equal, theSAPS and the justice system in South Africa is doing a tremendously good job under difficultcircumstances and what it certainly does not need, is highly placed people, well educated, leaders insociety, taking advantage of unsuspecting local and foreign investors and bringing the name of thecountry into even further disrepute internationally.South Africa, at this time, one of your leading prestigious legal firms is being watched by law firmsand bodies like Lex Mundi around the world.
