Analysis/Comment/Critique:This is the case where the documentary evidence was available to show thatthe judge has purchased the property worth crores in few lakhs in the nameof his wife from well-known criminal who have illegally grabbed the land.There were inquiry reports of the Additional District Magistrate andSuperintendent of Police which attested to these facts. However, despite thisdocumentary evidence being brought to the notice of the then Chief Justiceof India, he neither ordered an independent investigation nor did he allow theCommittee on Judicial Accountability to get a regular FIR registered, so thata normal police investigation could have taken place. This was despite thefact that under the in-house procedure, supposedly adopted by the SupremeCourt of India in 1999 for investigating charges against the judges, at leastan in-house committee of judges could have formed to investigate thecharges against Justice Bhalla. However instead of doing that, the then ChiefJustice Y.K. Sabbarwal recommended Justice Bhalla to be the Chief Justice ofKerala High Court. His appointment as Chief Justice was stopped onlybecause of the complaint made by the Committee on Judicial Accountabilityto the President of India, who sent the matter back to reconsideration to theSupreme Court collegium, which thereafter could not reiterate itsrecommendation because of the opposition of one of the judges of thecollegium, Justice B.N.Aggarwal. However, thereafter Justice Bhalla has beentransferred as a judge of Chattisgarh High Court where he has beenappointed as acting Chief Justice by the notification of Law Ministry. This wasdespite of the objection of the Committee on Judicial Accountability, that ajudge, who was not found suitable as Chief Justice of Kerala, cannot beappointed as Acting Chief Justice of another High Court.The case of Justice Bhalla demonstrates the hollowness of the so-called in-house procedure supposedly adopted by the Supreme Court for investigatingcharges against judges. It also demonstrates the pernicious impact of theVeraswami judgement which prevents any police investigation against ajudge without the prior permission of the Chief Justice of India. Thebrotherhood among the judges and the fear among judges that any criminalinvestigation against the sitting judge would tarnish the image of Indian
