  • What is the HITECH Act? The Health Information Technology for Economic and Clinical Health Act, or HITECH Act, is designed to encourage medical facilities both large and small to utilize electronic health care records. The HITECH Act is one section of the Omnibus Rule that was passed in September of 2013. What is HITECH Act provisions may be best answered by examining the changes that occurred or will occur when the Final Rule is put into practice? One of the major provisions that changed the Omnibus Rule was the HITECH Act. When the HITECH Act was released it made changes to several aspects of the HIPAA regulations that were in place. For instance, the HITECH Act made entities and organizations within the healthcare industry liable for inappropriate sharing of patient health information. Infringements of HIPAA privacy guidelines can result in fines up to $1.5 million. Individuals are also affected by the HITECH Act. Patients now have greater access to electronic medical records and can be notified of any unusual sharing of their personal health information. Patients now have access to the new privacy policies of their healthcare providers on-site. What is the HITECH Act may include a focus on how electronic patient health information is protected within the medical industry. HIPAA compliant software can be used to maintain confidential medial records and prove that guidelines are being followed to protect patient health information. According to the Omnibus Rule, medical organizations must follow specific guidelines for accessing and sharing patient health information within their organization and with third parties.
  • Organizations and entities must complete changes indicated by the Omnibus Rule and HITECH Act before September of 2014.
