    16. Contract Law - Classification A contract can be classified as an Executed or an Executory
      • An Executed contract is one that is performed wholly on one side.
      • This would indicate that the buyer has credit facilities with the seller.
      • Therefore the seller ships the goods and the buyer pays for them in line with the agreed credit arrangements.

    20. Bills of Lading - History
      • It is safe to say that in the 11 th Century the Bill of Lading was unknown.
      • At this time, trade between the Mediterranean ports began to grow significantly.
      • The ship’s mate would record details of the goods in the way of a ship’s register.
      • The accuracy of the register was paramount, and around 1350, a statute was enacted.
      • If any mistakes were made in recording this information, the mate would lose his right hand, and his forehead was marked with a branding iron.
      • In the early days of international trade, the shippers travelled with their goods, and therefore there was no need for a separate record of the goods loaded, just the ship’s register.

    21. COGSA International Conventions At a convention in The Hague during 1921, a set of rules were drawn that set the minimum standards of liability for carriers. This set of rules became known as The Hague Rules 1921, for obvious reasons. To become English law, these had to be passed through Parliament. It took three years for them to be ratified in the United Kingdom and they became known as the ‘Carriage of Goods by Sea Act 1924’ (COGSA 1924).     22. The main document for the shipment of dangerous goods is the ‘Dangerous Goods Note’, and it must be completed by the shipper prior to the goods being collected. D angerous Goods Notes The Dangerous Goods Note, if completed properly, removes the need to complete a ‘Standard Shipping Note’. The Dangerous Goods Note will also double as a ‘Packing Certificate’. A Packing Certificate is a certificate that states that the goods are packed properly in accordance with applicable legislation – see Box 15. Box 15 to be signed by the loader/packer, NOT an employee of a freight forwarder or a shipping clerk. This must be signed by the shipper. I T S Training Services Training & Consultancy
