SB 575 does the following:<br />Removes hours as a negotiable item;<br />Makes hours a mandatory part of discussion.<br />Includes number of hours per day a teacher within the bargaining unit is expected to work be included in each certificated employee’s regular teaching contract.<br />Indiana State Teachers Association - 2011<br />2<br />

Clarification of Local Contract Status for Negotiations<br />Contracts ratified and extended prior to April 21, 2011, for implementation past July 1, 2011, may include an evaluation tool and criteria until contract expiration. After expiration dates of such contracts, new contracts may only contain Section 4 items.<br />Contracts ratified and extended after April 21, 2011, and prior to July 1, 2011, may not include an evaluation tool and criteria. Bargaining<br />A contract entered into after April 21, 2011, must expire at the end of a state budget biennium. <br />The state budget biennium is defined as beginning July 1 of an odd-numbered year and ending two years later on June 30 in the odd-numbered year.<br />The upcoming state budget biennium runs from July 1, 2011 to June 30, 2013.<br />Indiana State Teachers Association - 2011<br />4<br />
  5. 5. Bargainable Items<br /> Salary and salary/wage-related fringe benefits are mandatory subjects of bargaining. (Known as Section 4 items.)<br />Wage-related fringe benefits include accident, sickness, health, dental, vision, life, disability, retirement benefits and all other paid leaves/absences. (These are also Section 4 items.)<br />A grievance procedure may be bargained. Grievance procedures are permitted to remain in agreements.<br />Indiana State Teachers Association - 2011<br />5<br />
  6. 6. Discussion<br />All items that were previously mandatory subjects of discussion remain, except working conditions. Working conditions were removed as a mandatory subject of discussion; however, there is NO statutory prohibition disallowing the association and administration to agree to discuss working conditions.<br />Added mandatory subjects of discussion including evaluation, safety of employees and students and hours.<br />Discussion with the administration continues to be the exclusive right of the local association.<br />Indiana State Teachers Association - 2011<br />6<br />

Committees<br />All statutory and locally created committees in the school corporation, except bargaining, may not exceed the percent of Association members in the school corporation. <br />This percentage ONLY applies to the number of teacher positions on the committees. The percentage DOES NOT apply to the total number of members on the committees. The committees may NOT address subjects of bargaining. <br />Corporation-Level Discussion Teams should never be referred to as “committees.”<br />By Sept. 15 of each year, the local association president or designee shall certify the number of teachers in each school and in the entire school corporation who are association members.<br />Indiana State Teachers Association - 2011<br />7<br />
