  2. Relevant Facts
    • 1985 - 10 year old girl named Justine Blainey from Etobicoke, Ontario.
    • Wanted to play hockey for the Men’s Metro Toronto Hockey League.
    • Blainey's choice to play on a boys' team was because:
      • Men's hockey in Canada was better funded
      • Had more ice time and competition opportunities
  3. Issues
    • At the time the Ontario Human Rights code permitted sexual discrimination in amateur sports.
    • They had the right to discriminate on the basis of gender.
    • It took her five court battles to win and $110 000 for legal costs.
  4. The Decision
    • June 1987 - the Supreme court of Canada ruled in her favour.
    • Allowed Justine Blainey permission to play on men’s team.
  5. Reason Behind the Decision
    • Supreme Court ruled that the exception for sports teams violated section 15 of the Charter .
    • Secton 15: Equality Rights
      • “ Every individual is equal before and under the law.”
  6. Significance of the Decision
    • Allowed her to play on the men’s hockey team, in the following year.
    • Set a precedent for future decisions about sport related gender discrimination.
    • There are now 20 women playing hockey in the men’s league.
