DEFINITION, SCOPE AND PERIODS SERVICES UNDER THE SCOPE OF NOTIFICATION NOT REQUIRING RESOURCE ALLOCATION 1.1. UHH Satellite Communication Service covers providing of voice, data, image communication services Satellite Communication for its subscribers/users excluding telephone services between geographical far points via Service electromagnetic waves as single or two-way via satellites and satellite ground stations and/or satellite terminals and installation and operation of relevant infrastructure. 1.2. UPH Satellite Platform Service is the service for converting voice, data and image signs excluding Satellite Platform Service telephone services taken from different transmission environments with the assistance of encoder and multiplexers groups in digital satellite platform and their transmission to satellite as digital packages and transmission of digital signs received from satellites to subscribers via proper terminal devices. 1.3. AİH Infrastructure operating service is the installation and operation of transmission infrastructure Infrastructure Operating providing opportunity for serving operator and users electronic communication services excluding Service telephone services. 1. Operator has right to provide connection between Points of Presence of other operators. 2. Operator has right to install and operate transmission infrastructure between a point within the boundaries of the country and a point out of countries boundaries for the purpose of establishing terrestrial and/or submarine transmission infrastructure. 3. Operator has right to install and operate poles, towers, cabins, container, antenna and similar facilities under the scope of infrastructure installation and right for operation. 4. The transmission infrastructure must be installed via every kind of wired transmission facilities such as fiber optical cables, coaxial, cooper against the limited scope of operators’ right for frequency use, electromagnetic interference problems and security. 4
  • DEFINITION, SCOPE AND PERIODS OF ELECTRONIC COMMUNICATION SERVICE, NETWORK AND INFRASTRUCTURE 1.4. İSS Internet Service Provision covers accessing of its subscribers/users to Internet network to provide Internet Service Provision their benefiting from electronic communication services and hosting services provided over Internet. 1. Operator may serve to its subscriber/users by creating virtual networks within the Internet network. 2. Operator besides hardware and devices required under this scope may also install required access systems for the purpose of providing Internet access services. Devices which are set up by operator in the access systems shall not be protected against electromagnetic interference and shall accept electromagnetic interference occurring because of operation of other wireless systems operating in frequencies previously allocated and registered. 3. The conditions of usage of frequency bands to be used for access system are specified below. Technical Criteria specified under the By-Law on Wireless and Telecommunications Terminal Equipments and the By-Law on Short Distance Radio Devices (KET) shall be applied for utilization of these frequencies. Frequency bands to be allocated in the future by the Authority relevant to the subject matter can be used under the scope of this authorization. Frequency Band Operation Status Definition (MHz) 2400-2483.5 Internal/External It can be used in indoors such as hotel, restaurant, houses, hospitals, conference halls, shopping centers and outdoors such as campus, marina, plant area, streets, avenues. 5150-5350 Internal It can be used in indoors such as hotel, restaurant, houses, hospitals, conference halls, shopping centers. 4. Operator may interconnect access systems by utilizing frequency bands which their operation status is defined above with the condition to obey technical criteria specified under above mentioned By-Laws. 5
  • DEFINITION, SCOPE AND PERIODS OF ELECTRONIC COMMUNICATION SERVICE, NETWORK AND INFRASTRUCTURE 1.5. STH Fixed Telephony Service covers providing of fundamental and value added phone services to its Fixed Telephony Service users/subscribers over phone network without any technology limitations. 1. Operator has right to provide all fundamental phone services and voice mail or short massages, fax, videophone, recalling and other similar value added phone services including provincial, inter-cities and international phone services over fixed terrestrial phone networks to its users. 2. Operator has right to transport provincial, inter-cities or international phone traffic of persons utilizing electronic communication facilities those not subject to authorization or operators providing termination and phone services to relevant operators providing international calls phone services without any technology limitation. 3. Operator may serve via carrier pre-selection. 4. Operator may serve as call office via its won or its agencies. Prepaid phone terminals may also be used for call office service. 5. Operator can not provide service by initiating call over mobile networks under this authorization. 6. Operator may provide coin box telephone system under the scope of this authorization. 1.6. KYH Wired broadcasting service; is the electronic communication service covering transmission of Wired Broadcasting signals (excluding phone and Internet) relevant to auxiliary services with digital/interactive such Service as encoded / clear radio, TV and video signals, games, instant massaging to subscribers over wired networks such as coaxial, copper, fiber. 1. Operator may install and operate required platform, software and devices on its own. Relevant operator must supply all infrastructure required for transmission and distribution of services excluding these and/or may install on its own by having the relevant authorization. 1.7. GMPCS Mobile Phone GMPCS Mobile Phone Service, covers providing direct voice, data, fax and similar services Service besides providing of services estimated under the framework of GMPCS-MoU for users/subscribers over a satellite group which its position and operating frequencies are determined or supplied by ITU, fixed or mobile, wide or narrow band, global or non-global, immobile or mobile, current or planned. 1.8 SMŞH (MVNO) It covers mobile electronic communication services to its subscribers with its own brand under the Mobile Virtual Network scope of authorizations granted by the Authority for the operator hosting over infrastructures of Service operators signing Concession Agreement with the Authority to provide mobile electronic communication service without having frequency band assigned to himself. 1. Operator, are entitled freely to determine provisions and conditions relevant to servicing over infrastructures of host operators by negotiating with host operators with the condition of obeying relevant legislations. 6
  • DEFINITION, SCOPE AND PERIODS OF ELECTRONIC COMMUNICATION SERVICE, NETWORK AND INFRASTRUCTURE 2. Operator is not entitled to install or have other install Radio Access Network. However, it is entitled to install, have others install or may supply via estimated methods in the legislation including renting other network units it may require. SMŞH Operator shall supply required transmission lines from operator having required infrastructure operating right and/or hosting operator for the purpose of installing connections among its won network units. 3. Operator, incase of requiring MNC, shall apply to hosting operator for the purpose of meeting its MNC requirement. Incase SMŞH Operator agrees for utilizing MNC of the hosting operator; this situation shall be informed to the Authority within one month after agreement with the hosting operator. 4. Operator, incase of requiring a mobile number, it shall apply to hosting operator to utilize numbers of it. Incase if SMŞH Operator agree for the utilization of mobile numbers of hosting operator mobile number block /blocks to be utilized shall be informed to the Authority within one month by hosting operator. 5. Operator may provide SIM card to its subscribers with its own brand. 6. Operator is obliged to conclude a subscription agreement with its subscribers. 7. Operator, under the scope of this authorization shall not provide Infrastructure Operation. However, SMŞH Operator may share his own network units with other SMŞH Operators. 7
  • DEFINITION, SCOPE AND PERIODS OF ELECTRONIC COMMUNICATION SERVICE, NETWORK AND INFRASTRUCTURE 1.9. GSM 1800 Mobile Phone This service, covers providing of GSM 1800 mobile phone services for air vehicles within Turkish Services for HT-GSM 1800 Air Space within 1710-1785 MHz and 1805*1880 frequency bands. MTH Air Vehicles 1. Operator is obliged to obey every kind of national and international Resolutions, Recommendations, etc. relevant for the providing of this service. 2. Operator is obliged to take necessary measures for the purpose of preventing any hazardous electromagnetic interference of the system over any other system and is not entitled to request for its own system to be protected from hazardous electromagnetic interferences those may originate from these system. 3. Operator is obliged to take necessary precautions to keep the said system off position under 6000 meters altitude in Turkish Air Space for air vehicles. 4. Operator is obliged to have necessary allowance from Air Transportation Directorate for the providing of this service. 5. Utilization of GMS 1800 mobile phone system to be installed and operated for air vehicles using Turkish Air Space but not registered in Turkey; is not subject to authorization with the condition of obeying provisions set out under 1.9 and relevant legislation and having permission of the Authority. However persons operating the said system are obliged to have necessary allowance from the country where the said air vehicle is registered for the installation and operation of GSM 1800 mobile phone system. SERVICES UNDER THE SCOPE OF UNLIMITED NUMBER OF RIGHTS OF USE In case it is necessary to allocate resources for services provided under notification, in addition to provisions set out under the Section For Services Under The Scope Of Notification Not Requiring Resource Allocation, the following provisions are valid. 2.1. GMPCS Mobile Telephony 1. Number allocation is performed for the Operator under National Designation Plan. Service 2. Operator under the scope of GMPCS service may provide value added services for end users by utilizing satellite group and obeying regulation of the Authority relevant to designation and number portability. 8
  • DEFINITION, SCOPE AND PERIODS OF ELECTRONIC COMMUNICATION SERVICE, NETWORK AND INFRASTRUCTURE 2.2 OKTH (PAMR) Public Access Mobile Radio Service covers, electronic communication service accompanying one Public Access Mobile or more closed user groups within the same system by utilizing analog and/or digital technologies, Radio Service consisting of minimum one central wireless or role and adequate numbers of subscriber wireless devices, consisting of providing service for its subscribers such as voice, data and optimized package data, massage, call, video services as single and/or two-ways, cellular and/or non-cellular, local and/or regional and installation and operation of relevant infrastructure. 1. Operator mat may install and operate electronic communication infrastructure under the scope of service providing and shall have right to supply its infrastructure requirements from other operators including OKTH operators. 2. Operator may repeat frequency channels provided to its won by the Authority by having required allowance from The Authority within its area of authorization. Operator moreover may perform role displacement within its own area of authorization having the allowance of the Authority. Incase of performing frequency repetition in the same authorization area no additional fee for right of utilization shall be collected. 3. Operator is obliged to obey “Regulation for Procedures and Principles for Wireless Operations”. 4. Operators are not entitled to utilize frequencies supplied to themselves for the purpose of transmission. 5. Operator shall also have right to have local authorization for the provinces within the boundaries of its regional authorization or relevant to the geographical region where the province of its authorizations locates. 6. Operator is entitled to interrelate systems within its local and regional authorization zone. 7. Operator is not entitled to interrelate local-local and local-regional authorization zones with each other. 8. Incase operator request interrelation of his authorization areas within multiple geographical zones, calculation shall be made over the value of the region having highest EGF values for the calculation of frequency utilization fee. 9. Operator may have its subscribers use simplex frequency channels supplied by the Authority to serve OKTH with the condition of notifying coverage area. Moreover operator is obliged to erase simplex frequencies in the radios of persons discharged from subscription. 10. Authorization period is fifteen (15) years. 2.3. AİH Operator may request to install R/L system under the framework of difficulties for wired Infrastructure Operating transmission, frequency utilization right being scarce source, qualification of the service to be Service provided and other conditions specified under relevant legislations. Incase if the said request is approved by the Authority, R/L system can be installed to provide point-to-point communication. 9
  • DEFINITION, SCOPE AND PERIODS OF ELECTRONIC COMMUNICATION SERVICE, NETWORK AND INFRASTRUCTURE In such case, operator may be granted R/L system installation and utilization permission by allocating frequency under the framework of National Frequency Plan. Operator shall be authorized in local or regional basis. 1. Incase if the R/L system requested to be installed by the operator relates with more than one authorization area regional authorization shall be applied. 2. Incase if the operator requests to interconnect authorization areas multi geographical zones calculation shall be made over the value of the region having highest EGF values for the calculation of frequency utilization fee. 3. Authorization period is maximum 25 years in connection with frequency utilization right. 2.4. STH 1. Operator may serve with two levels call method and carrier selection. Fixed Telephony Service 2. Incase of its request, operator shall be granted an access number from the zip code to be determined by the Authority shall be allocated for the purpose of serving via two levels call method with the condition of meeting the provisions set out under the relevant legislation. 3. Incase of its request, operator shall be allocated a carrier selection code with the condition of meeting the provisions set out under the relevant legislation. 4. Incase of its request, operator shall be allocated numbers under the scope of the Authority’s regulations to be used for the services to be allocated for its subscribers or under the scope of authorization with the condition of meeting the provisions set out under the relevant legislation. 5. Operator is obliged to use access numbers allocated by the Authority for the services to be provided with two level calling method. Operator is entitled to have other STH operators use access number and carrier selection codes allocated to itself with the condition of having the required permission from the Authority. In such case, responsibility relevant to the service before consumers shall belong to STH Operator utilizing the number. However, this situation shall not supersede the liabilities of STH Operator having use its number to other STH Operator specified under relevant legislation provisions. 6. Authorization period is fifteen (15) years. 10
  • DEFINITION, SCOPE AND PERIODS OF ELECTRONIC COMMUNICATION SERVICE, NETWORK AND INFRASTRUCTURE 2.5. RH Directory Information Service is to supply information obtained from phone operators by Directory Service accessing to their directory databases to its users. Data obtained from directory databases and other data such as fax, electronic mail and profession those possible to be added shall be transmitted to users via one or several interrogation methods such as electronic mail, internet, short massage, printing and other means as to be short interrogation method that was allocated for this service to be mandatory and in addition added value services excluding sexual content live chat can be served to users by informing to the Authority. 1. Operator is entitled to edit subscriber information by accessing directory databases of all operators who allocate fixed, mobile and other phone numbers to their subscribers as on-line or off-line against a fee and to make interconnection. 2. Information such as address, e-mail, fax, gender, profession shall only be supplied by having the consent of the subscriber. 3. Maximum three (3) short numbers in 118xy structure shall be allocated to operator in order to be utilized for service providing. Commissioning of short numbers starting with 1180 shall be decided separately. 4. Operator may route the call to terminate it to the interrogated number provided that the user is informed about the fee to be charged. Operator shall bear liabilities arising from this routing. 5. Operator is obliged to measure statistical data relevant to the service quality parameters in ETSI EG 201 769 recommendation according to these recommendations and to retain them for 2 years. Authority may request publishing of these data. 6. Operator is obliged to provide restriction for interrogation of phone numbers of real persons. 7. In case of utilizing off-line interrogation method operator is obliged to update the database in maximum seven (7) days periods. In this update, changes in preferences of subscribers about personal information and if subscribers appear in the directory or not shall be included. 8. Operator is obliged to have all necessary measures for processing personal information and protection of confidentiality. Operator is not entitled to utilize the information it owns to cause them to be subject to involuntary voice mails and other messages and to cause this possibility to rise or shall not transfer to anybody as free of charge or against fee and is obliged to take the possible measures to prevent a customer to perform a mass interrogation. Operator may only use data it has obtained under the scope of this service. 9. For interrogations performed over phone, the traffic arises from the service shall be received or delivered in the nearest interconnection point where the operator is located or in other interconnection points in case the operator requests. 10. Phone operators providing the similar services shall also provide conditions and opportunities they use in a fair, cost basis and non-distinctive manner for Directory Information Service 11
  • DEFINITION, SCOPE AND PERIODS OF ELECTRONIC COMMUNICATION SERVICE, NETWORK AND INFRASTRUCTURE 2.6. SMŞH (MVNO) Operator in addition has the following rights excluding number 3 and 4 provisions set out under Mobile Virtual Network his rights and responsibilities specified in 1.8. Service 1. Operator excluding the condition of his utilizing both mobile number block/blocks and MNC of hosting operator; may apply to The Authority or hosting operator with the request of allocation o MNC and/or mobile number. The Authority after investigating said applications shall allocate required provisions under the framework of relevant legislation. Operator, incase of agreeing for utilizing MNC and other mobile numbers of hosting operator the MNC or mobile number lock/block to be used shall be informed to the The Authority by the operator within one month time slot. 2. Authorization period is fifteen (15) years. SERVICES UNDER THE SCOPE OF LIMITED NUMBER OF RIGHTS OF USE 3.1. GSM GSM Mobile Phone Service covers installation and operation of a GSM Network and providing of services estimated under the framework of GSM MoU applied by GSM Association as compatible with standards of ETSI for GSM Mobile Phone Networks. Electronic communication services excluded from the scope of GSM MoU shall be provided with the consent of the Authority. Operator is obliged to provide all necessary software and hardware (including CCOSS7) for the purpose of connecting GSM mobile phone exchange to main electronic communication network. 1. While intra-network call blockage rate for the areas in the coverage area shall not be more than five (5%) percentage and rate of failure shall not be more than two (2%) percentages. Operator is obliged to obey every kind of service quality criterion determined by the Authority in these areas. 2. The Authority when find appropriate shall check service quality levels and blockage levels of networks under the framework of its regulations and performs necessary transactions. For this purpose the Authority is entitled to request every kind of report and information for operators, to request for site measurement and to investigate the efficiency of GSM network. 3. Operator shall provide its won GSM mobile phone network to be compatible for communication with foreign GSM mobile phone networks. Moreover operator shall provide opportunity for its subscribers leaving abroad to use foreign GSM mobile phone networks. 4. The request for operator to establish its own infrastructure among GSM network equipments shall be assessed by the Authority and issues for the subject matter shall be determined by the Authority by also considering the changing conditions. 5. The operator is entitled to establish a wireless local internet access system for the purpose of providing these services for its subscribers for whom it serves GSM Mobile phone service over 12
  • DEFINITION, SCOPE AND PERIODS OF ELECTRONIC COMMUNICATION SERVICE, NETWORK AND INFRASTRUCTURE frequencies only allocated to its name and also it is entitled to establish and utilize this system. 6. Areas where operator provides services over wireless local internet access system shall not be considered for the calculations made for coverage area. 7. Service quality standards for services provided under the scope of concession agreement is also obliged to be provided incase of said services utilizing wireless local internet access system. 3.2. GTE Broadband Wireless Access Service, covers providing of every kind of voice, data and image Broadband Wireless Access services including transmission of radio and television broadcasts with phone services and internet Service access service over this network by installation and operation of Broadband Wireless Access Network via radio transmission method on a frequency band to the determined by the Authority as single and/or double routes. 1. Frequency bans to be determined under the scope of GTE Service authorization, frequency interval to be allocated, service definition and scope and issues such as area of authorization shall be specified in the relevant tender specification. Incase of authorization area being a regional area operator shall have right for authorization for maximum six (6) geographical areas. 2. Operator is not entitled to have more than one authorization in the same authorization area on the same frequency band relevant for the providing of GTE service. 3. Operator is entitled to provide wireless internet access service under the scope of “Internet Service Providing” in the authorization area. 4. The Authority incase requested by the operator, may allocate sources such as numbers and R/L frequencies by paying the fee for right of use relevant to the legislation. Unless contrary is specified under the relevant tender specification, incase if the authorization area is regional, the period of authorization is fifteen (15) years. Authorization period for national authorizations shall be specified under the relevant tender specification. 3.3. IMT-2000/UMTS This service, covers providing of electronic communication services under the scope of its authorization with the condition of not acting against communication confidentiality principal, national security, public order and relevant legislation over the network to be established and operated under the standards those developed by taking these standards as basis or in IMT-2000/UMTS standards by the operator. 1. Operator may only use wireless local internet access system for the purpose of providing the services under the scope of concession agreement with its subscribers where it provides IMT-2000/UMTS services over frequencies allocated to itself. 2. Areas where operator served over local internet access system shall not be considered for the 13

Service quality standards relevant to the services provided under the scope of concession agreement is obliged to be provided incase of utilizing the wireless local internet access system. 4. The Authority may impose liabilities for the operator for establishing direct relationships for electronic communication operators or institutions in foreign countries. 5. Operator may install required transmission lines on its own for the purpose of providing connection among its own base stations control stations, switches and other equipments of IMT-2000/UMTS network and may also hire them from operators whom are authorized by the Authority. 6. Operator may not provide telecommunication infrastructure which he utilizes for executing his services under this authorization for the use of operators who are unauthorized to provide service by using foreign mobile telecommunication networks. 7. Incase of 3N operator to be also 2N operator, numbers allocated under the framework of GSM concession agreement, shall be utilized in accordance with the following provisions. a. The current 2N subscriber incase of his request may be transferred to 3N subscription with the same number and the current 3N subscriber may be transferred to 2N subscription with the same number. b. For the persons who are not currently 2N subscribers but requesting to be a 3N subscriber number allocation can be performed from 2N numbers those allocated under the framework of GSM Concession Agreement. c. Operator is obliged to keep records of 3N and 2N subscribers separately and obliged to inform to the Authority incase of its request. d. Transfer of 2N subscriber to 3N subscription of another operator and transfer of 3N operator to 2N and 3N subscription of other operator is under the scope of operator number portability. 14
