After the case when the attempt of returning back the daughter to Laimute
Stankunaite turned into drama and pulling the child on the March 23th, the
responsible authorities have puzzled over and brainstorming, how to enforce
the judgment and return the girl to the mother. There are no instructions on
how to handle such a situation. Stankunaite‘s lawyer Gintaras Cerniauskas
assures that they are looking for examples abroad in solving similar
problems. True, it seems at a first glance, that one still hasn‘t gone very
far in developing the new plan.
G. Cerniauskas admits that such a complex situation has not yet occurred
either in his practice, or perhaps in Lithuania in general. At the same time,
there is no determination (definition) how to behave in such circumstances.
Therefore, the responsible authorities tend to look at foreign practice
(experience).
"How to make a judgment to be enforced properly, when you come into the room,
and one, two or more people can stop you – rules are not provided (there is
no definition). There are instructions of freeing hostages, there are
planners - everything is clear. And here - no such instructions. (...). We
appear at a place, when there were no such cases in practice. We can only
rely on foreign practice on not enforcing judgments (not obeying court
decisions). And we ourselves have to set up a full implementation plan how to
behave in one case or another, and what to do'- the lawyer said to DELFI.

G. Cherniauskas also assures that consultations with psychologists are taking
place on how to make the least possible harm to the child while enforcing the
court decision.
"I consulted psychologists, and I got a lot of useful, valuable, interesting
tips by foreign practice, how one should treat a child, and so on. We could
never find all these things, in any instructions, and the bailiff - couldn't
2. find them in any Civil Procedure Code (...). It turns out that there are
nuances that are completely unknown to us. We will develop the practice" -
the lawyer representing Stankunaite said to DELFI.
They say that recently the responsible agencies - bailiff Sonata
Vaicekauskiene, the specialists of the Child Rights Protection Service,
representatives of the police – are actively coordinating their actions they
are going to take while the transfer of the eight years old girl to
Stankunaite. True, G. Cerniauskas did not want to talk more about it, but
made it clear that in the coming days they are not planning to take the girl
from the temporary guardian Neringa Venckiene. (<-- we do not believe that
stuff! They just want to us to lose our alert.)
DELFI remind that the Kedainiai region District Court returned the girl to
mom L. Stankunaite on the 16th of December last year, but this decision is
not taken so far.
N. Venckiene assures that the girl does not want to live with her mother.
For the same reason none of the girls and mothers meeting has taken place in
a neutral environment until now. (<-- they insist to take the girl to
“neutral environment” in order to lure the girl out of home to their hands)
Stankunaite was visiting the girl several times in Garliava, however, G.
Cerniauskas said they are not planning to do this again for the security and
poor quality of the meetings. L. Stankunaite said that the members of Venckus
and Kedys families intervened in the communication between her and the
daughter.
