    • 4.  AB 9 (Effective July 1, 2012) AB 746 (Effective January 1, 2012) AB 1156 (Effective July 1, 2012)
    • 5. “Any severe or pervasive physical or verbal act orconduct, including communications made in writing or bymeans of an electronic act, as defined, including, but notlimited to, sexual harassment, hate violence orharassment, threats or intimidation that has the effect or canreasonably be predicted to have the effect of placing areasonable pupil, as defined, in fear of harm to that pupil’s orthose pupils’ person or property, causing a reasonable pupilto experience a substantially detrimental effect on his or herphysical or mental health causing a reasonable pupil toexperience substantial interference with his or her academicperformance, or causing a reasonable pupil to experiencesubstantial interference with his or her ability to participate inor benefit from the services, activities, or privileges providedby a school.” AB 1156(3)
    • 6.  AKA: Seth’s Law Adopt a policy that prohibits discrimination harassment, intimidation, and bullying based on the actual or perceived characteristics set forth by Penal Code Section 422.55 and Section 220 Policy applies to all acts related to school activity or school attendance occurring within a school under the jurisdiction of the school district’s superintendent
    • 7. • Adopt a process for receiving and investigating complaints of discrimination, harassment, intimidation and bullying • School personnel shall take immediate steps to report and intervene • Timeline to investigate and resolve complaints • Appeal through Uniform Complaint Process • Publicize and post policies at all school sites • Maintain documentation for one review cycle • Protect complainants from retaliation
    • 8.  Specifically defines an electronic act Suspension/ expulsion for bullying “An electronic act means the transmission of a communication, including, but not necessarily limited to, a message, text, sound, image, or a post on a social network Internet Web site, by means of an electronic device, including, but not necessarily limited to, a telephone, wireless telephone or other wireless communication device, computer, or pager.”
    • 9. • Comprehensive school safety plan will include policies and procedures for bullying prevention• Encourage interagency strategies and trainings to address all types of bullying• Department of Justice and California Department of Education are required to contract to provide training in the prevention of bullying• A bullying victim, as determined by District Personnel, is given priority for inter-district transfer

AB 746 Encourages school districts, countyoffices of education…to develop and implementin-service training programs and activities thatwill: • Improve school attendance • Reduce school crime and violence, including…  hate crimes  bullying, including bullying committed personally or by means of an electronic act  teen relationship violence  discrimination  harassment
